Consumer Complaint: In XXXX, 2015 while at work, I received emails and phone call from M & TBank stating there was suspicious activity on my account. When talking to the young lady from the bank she said a purchase was being made at XXXX in my area for {$400.00}, I said I am at work and I initially thought one of my clients stole my card from me. I immediately left work to try to get to the bank before closing, and I found that my debit card was actually in my car arm rest where I left it a few days prior. I asked the bank officer how could someone make purchases with my card when it was in my car. He said that people are able to steal your identity and scan your card to make duplicate cards. Because of fear of more frauduelnt activity, I looked at all of my credit cards and bank statements and found that no other activity was observed. I also filed a police report. The money was credited to my accoung within 10 business days, however as of XXXX XXXX, 2015 the money has been taken from me again and now there is overdraft fees accruing on the account. I have talked to several representatives and no one has offered any real resolve.

Consumer Complaint: On M & T Bank 's official website, it was offering a {$150.00} bonus when you open a MyChoice Checking account by XXXX XXXX, 2015. Since this is a public offer so there is no mailer required to open an account. I opened my account on XXXX,2015 and also set up the direct deposit with amount of {$100.00} to satisfy this bonus requirement. I sent a message to M & T bank online customer service to check my bonus status on XXXX XXXX, 2015. M & T bank 's CS confirmed that I am qualified for the bonus and all I need to do is wait for 90 days after the initial direct deposit which was XXXX,2015. I waited to XXXX XXXX, 2015 and I did not see any bonus on my account. Therefore, I messaged M & T bank CS again. To my surprise, the CS declined my request by saying I am not qualified and I need to have a mailer with the bonus to bring to a branch to verify my status. M & T bank always puts up this type of promotion on its official website and no mailer is required to open on account online. For example, if you go to XXXX, you can see the current promotion they are running. NO mailer is required. I strongly believe the customer service from M & T bank was lying to its customer and tried to avoid fulfilling the promise they made to award the bonus. I have attached the confirmation message sent from M & T confirming that I am qualified for the ongoing bonus.

At the moment, my credit report shows I have n't paid my mortgage for XXXX months. This is not true, since they have been cashing the money I send them every month. Consumer Complaint: I applied for a modification over a year ago at M & T Mortgage Company. It was a long and grueling process, but I patiently and cooperatively did EVERYTHING THEY asked me to do, and I was approved for the modification. I made my XXXX trial payments on time, as required. Then I got the final modification documents to be signed and notarized. I did just that. I did n't notice that they were requiring my wife to sign on the documents, due to the fact that she is not on my loan nor Deed, so I did n't think I needed to look for a place on the documents for her to sign. So I signed, notarized, and returned documents to the bank, and I also continued making my payments as required. To my surprise, almost 3 months later, M & T Mortgage informed me that they have cancelled my modification because my wife did not sign the documents. PLEASE TAKE NOTE ... THEY NEVER SENT ME ANY NOTICE OF AN OMMISSION OF ANY SIGNATURE, OR IT WOULD HAVE BEEN DONE, and sent back in a timely manner. They had the documents for months and never bothered to contact me about the missing signature, instead, they went ahead and cancelled my modification, JUST FOR A MISSING SIGNSTURE OF SONEONE WHO IS NOT EVEN ON THE LOAN, AFTER I WENT THROUG SO MANY MISERABLE MONTHS TO GET THE MODIFICATION.

Consumer Complaint: On saturday XXXX XXXX 2015 I had made a cash and check deposit at an M & T Bank branch location at XXXX XXXX XXXX XXXX XXXX, NY XXXX ( XXXX ) XXXX. The cash deposit was for {$960.00} and XXXX checks. XXXX check for {$150.00} and the other for around {$37.00}. I ca n't recall the exact dollar amount because I do n't have copies of the checks. As the deposit was being processed, the atm shut down and ate the deposit. No receipt was provided. I immediately called the M & T customer number for the bank to report the issue as the branch was closed. I was advised that when the branch opened on Monday morning they would balance the atm and my deposit would be completed. The representative said there was no way for them to make a service call to ( XXXX ) whom services the atm 's if there is an issue. The representative assured me that it would be corrected upon the balance of the atm and there would be no need to worry. She stated that there would be no discrepency. I was advised that a provisional credit would be issued to my account within a few business days. At the end of the call the representative said that they would have a technician service the atm but the would not be able to get out there for a few hours. That contradicted her previous statement. Never the less, I was upset over the situation and in a panic as well. A few days past and I received a provisional credit to my account for {$1000.00} and {$98.00} for the XXXX checks which did not add up to my initial deposit. There may have been a discrepency with the cash amount listed in the dispute due to the fact that I had counted the cash hours beforehand then spent {$40.00} of the {$1000.00} prior to the deposit. I had advised the representative at M & T when making the dispute of this. She advised me that they would issue the credit for the {$1000.00} and if there was an adjustment it would be done the following monday when the teller at the bank balanced the atm. On XXXX XXXX, 2015 I had recieved XXXX letters from M & T. XXXX stating that the {$98.00} provisional credit was determined to be accurate and they closed the dispute. The other letter stated that after a review of my account through investigation, they determined that no error had occurred and the transaction in question was processed corectly. They stated that they would be debiting my account for the {$1000.00} on XXXX XXXX, 2015. I have been a long standing customer of M & T and am beyond concerned as to their banking practice and consumer protection capabilities. My assumption is that either a teller at the branch pocketed the money or someone that may have serviced the atm obsconded it. I have advised M & T to pull video footage of myself attempting to make the deposit as well as the teller whom balanced the atm. This is beyond upsetting and frustrating. It will be a financial devistation to me should they debit {$1000.00} out of my account. I am also considering filing a police report and going to the news. Should the bank not rectify this I will seek an attorney to file a civil suit.

However, M & T BANKXXXX XXXX XXXX BANK did not credit my account ( Account # XXXX ). In fact, M & T BANKXXXX XXXX XXXX BANK did not even have the courtesy to return my instrument. Therefore, this is an apparent case of tax fraud, racketeering, embezzlement and extortion. See attached Exhibits for further details. As a result, M & T BANKXXXX XXXX XXXX BANK is in violation of tax law as well as a few others such as UCC 3-603 ( b ), UCC 3-411 ( b ) & 31 USC 3302. As mentioned above, although a payment was made but was refused. According to UCC 3-603 ( b ), a payment refused is still discharged or settled. In addition, according to 31 USC 3302, custodians of money who or officials or agents not complying with subsection ( b ) of this section may be removed from office. Furthermore, according UCC 3-411 ( b ), " a bank which refuses to pay a dishonored teller 's check, the person asserting the right to enforce the check is entitled to compensation for expenses and loss of interest resulting from the nonpayment and may recover consequential damages if the obligated bank refuses to pay after receiving notice of particular circumstances giving rise to the damages. ''

Consumer Complaint: Questioning possible fraudulent mortgage by XXXX. I was not working at the time. This mortgage should have never been written, according to several employees at XXXX, because of suspicious appraisal. I have attached a list of at least XXXX reasons why this should have never been done. I was told that I should sign the loan documents and the problems would be resolved after the signing. A manager told me this. The issues were not resolved. Although they did refund the appraisal fee because of major inaccuracies. ( The appraisal said there are no bedrooms in the house because there needs to be a closet for the room to be considered a bedroom- There is only one room, on XXXX floor that has a closet and the appraisal does n't mention that at all ) This loan was later sold to XXXX XXXX XXXX , then before it was sold to M & T Bank , I called and warned them that this was a fraudulent loan and they should not accept.

Consumer Complaint: Hudson City Savings Bank delayed or colluded to delay our conventional mortgage application to force an increased rate - the very highest in the nation currently - even though applicants/buyers are of the highest credit standing, for a total cost increase of more than {$55000.00}! We applied for a conventional mortgage in XXXX, finalized in XXXX but a closing date was not set until XXXX XXXX. There are no credit issues with the buyer or issues with the property. Buyers have excellent credit and full financial resources to meet any bank requirement. The loan was placed through a mortgage broker, XXXX, since he helped provide pre approval rather than our bank, XXXX whom we have an excellent relationship with. All papers were submitted to Hudson City by XXXX XXXX. Clear to close was not given until XXXX XXXX. Upon speaking with a XXXX at the closing office I was told it was my own fault because there is a clause in the mortgage contract, separate from the mortgage contingency, that provides for the sellers to have three weeks AFTER clear to close so they can move. XXXX at Hudson City said she discussed this clause at length with our attorney and that it is our own fault for signing the contract. The deal of four business days will cost us {$26000.00}. Hudson city, had full knowledge and deliberately delayed as is evidenced by their representative 's remarks about our signing the contract. Such behavior is disputable and unacceptable. We are consumers and trust the bank we apply to be honest and forthright with us. We also hire an attorney to protect our rights. Neither has occurred thus far. Closing is set for XXXX/XXXX/2015 with the rate lock running out on XXXX/XXXX/2015 allowing Hudson City to charge a higher than industry standard rate by a full half percent - or more than {$55000.00} over the life of the loan.

Consumer Complaint: We are in the process of losing our home we built. Because of the bank stating after 8 yrs our loan matured. Even though we have signed legal doc. stating we have a 30yr fixed loan with at date of XXXX. The bank wants the payment in full but no one can explain how or why this is happening. They are forcing us into Foreclosure and the latest they ask if we would deed the house back to the bank. We have the house on the market trying to short sale it, our realtor XXXX had it on the market for XXXX. We had an offer but the bank refused the amount and counter XXXX. The buyer did not take that offer. We have had an mortgage specialist tell us we can afford that price but M & T bank will not work with us. After several attempts at a loan modification they approved us, but the payments were over XXXX a month. First all of that is unrealistic and totally unacceptable. They stated refusing our payment and would send the checks back to us. I had to file bankruptcy to stop them selling the house. Then they realized they did n't serve the paper and follow proper rules. I DID NOT go through with the bankruptcy but its showing up on my credit report and It will be a long time before I can provide a home for my family. I have a daughter that just graduated from XXXX XXXX and my other child is XXXX
