Consumer Complaint: 2 years ago I went into a payment program when the house was going into foreclosure. I was not able to get the final payment in and was 3 days late they would not accept it till you called. It almost went into foreclosure again last winter but was able to pull out of it. They never disclosed to me there would be evaluation fees involved so two years later I receive a bill for {$470.00}. This is clear extortion of the customer and they will not waive the fees they never told me about. This bank has a history of this behavior and it needs to stop. We are current on this account and for the first time in a long time we are financially sound but can not afford for the bank to continually charging fees that we were never told about. This financial institution needs to be fine heavily and continuously and this will stop. please contact me for further details at XXXX. I want these fees waived and they need to be held accountable because this is more than ridiculous.

Consumer Complaint: In XXXX XXXX, I entered into a modification agreement with M & T Bank, a modification I believed was to make owning a home affordable for those who have had trouble in the past making mortgage payments, all it did was start my mortgage over again as if I 'd just walked out of settlement. I 've gone through bankruptcy trying to keep this property out of foreclosure and all this bank tries to do is sabotage this mortgage every chance they get. I received a notice telling me that I have not fulfilled my modification agreement and that the property will be entered into foreclosure. I have spoken with an M & T Bank representative and have asked for the latest date my payment can be in that bank, I was told no later than the XXXX. My XXXX XXXX payment will be made via walk in branch on XXXX XXXX, XXXX or via electronic online delivery, nonetheless, it will be in office before XXXX XXXX, XXXX. However, I do n't recall reading my agreement and seeing that M & T Bank is required to call me every month to ask me when I plan on forwarding payment. One month, I believe XXXX XXXX, they tried to tell me they had n't received payment ( typical M & T bank procedure ) I also noticed that for that month, a date was n't stamped on the check they cashed, things that make you go hummm?, why was that? I have made every payment since the agreement and XXXX XXXX will be no different.

Consumer Complaint: M & T Bank was servicing my mortgage at the time I filed for divorce. My ex-husband kept the house. Once the divorce was finalized, I contacted M & T Bank regarding how to remove my name from the mortgage, and provided them with the necessary documentation. They then requested additional documentation, much of which had already been provided, from both me and my ex. We provided the information to them in XX/XX/XXXX and according to the letter they provided, it would take up to 8 weeks to process and have me removed. I had not heard anything 8 weeks later, so called and was told they were unable to provide status. I then spoke with a supervisor who was able to get me in touch with the correct department. I left a message as it was after hours for that department and got no response. I called again, went through the same process of getting a supervisor on the line and trying to get to the correct department. This time I got a call back and was simply told it was still " in process ''. I continued to call back over the next few weeks for status, all resulting in a significant amount of time, and consistently being told they had no updates. On XXXX/XXXX/XXXX, I received an emailed copy of an unrecorded Release of Liability, advising I would be sent the recorded copy once it was recorded with the county. I continued to follow up for status on XXXX/XXXX/XXXX and XXXX/XXXX/XXXX. The document had still not been recorded but I was advised on XXXX/XXXX/XXXX that my name had been removed from the account. I responded to this email and requested the documentation showing removal of my name and got no response. After a second request, I received a copy of a letter stating my name had been removed on XXXX/XXXX/XXXX. I followed up again on XXXX/XXXX/XXXX, and again got no response. I continued to attempt to contact the woman handling this issue multiple times and got no response until XXXX/XXXX/XXXX, when I was advised the document still had not been recorded, and in fact had not even been sent for recording until XXXX/XXXX/XXXX, meaning it sat for 2 months before they even sent it out to be recorded. I checked again in XX/XX/XXXX, and finally on XXXX/XXXX/XXXX I received the recorded document, 7 months after the initial paperwork was sent in for what was supposed to be an 8 week process at the most. During the months after I received confirmation my name was removed, I continued to received XXXX letters from M & T Bank and XXXX with refinancing offers. These were related to the mortgage I had been removed from, listed that mortgage number, property address, and my ex-husband 's name, yet kept coming to me, even after the Release of Liability was recorded. I called and asked them to stop and was told I was n't getting them because nothing was in the system. I received no less than XXXX of these ; possibly more. Even after I moved in XXXX to a new address, I received XXXX more of these. I called each time and advised that I had already requested to be removed multiple times and each time was told they 'made a note ' and could n't do anything else. Then today, XXXX/XXXX/XXXX, I received phone calls to both my cell and work numbers from M & T Bank asking for my ex-husband to discuss a notice regarding the mortgage. Not only were the customer service representatives unhelpful, unresponsive, and sometimes rude while I was dealing with the Release, but they continue to send me information ( via XXXX nonetheless ) and call me, despite my multiple requests to be removed from their lists and system. Their entire handling of the situation from start to finish was unacceptable ; the fact that they continue to contact me is starting to border on what I would consider harassment, particularly since they seem to disregard my requests to not receive letters and calls from their company and specifically related to a mortgage that I am no longer responsible for. It is stressful & frustrating that this is continuing over a year later

Issue: Problems caused by my funds being low

Consumer Complaint: I switched to M and T Bank to avoid small fees I was being charged by XXXX XXXX XXXX to transfer money from my savings to my checking account. I was very upset with XXXX and looked into M and T as an alternative and was impressed with what they had to offer. HOWEVER, now having been with M and T bank I will NEVER bank with them again. On numerous occasions M and T bank has imposed a {$38.00} fee to my account because they are processing pending debits BEFORE processing pending credits that will more than amply cover any pending transaction. On XXXX/XXXX/XXXX I spoke with a Supervisor named XXXX ( she was the XXXX person that day I spoke to after being on the phone for more than an hour ). I had " overdrafted '' by {$26.00} because M and T processed a pending check before they processed my pending payroll. XXXX understood this and somehow was able to reverse the fee I was charged even though it seemed that was going to be an impossibility based on previous fee reversals ( some I admit and take responsibility for and some are from these exact same circumstances ). On XXXX/XXXX/XXXX they reversed the fee per XXXX 's request. Today, XXXX/XXXX/XXXX I am in the same boat as they are charging me for " overdrafting '' by {$3.00} when I had a pending credit of a higher amount. The debit was my mortgage payment that had NOT posted as of midnight on XXXX/XXXX/XXXX ( or XXXX/XXXX/XXXX am depending on how you look at it ) however on XXXX/XXXX/XXXX at around XXXX my account shows my mortgage payment having been posted on XXXX ( which it had not, it posted on the XXXX ) and it showed a credit pending for XXXX in an amount higher than the {$3.00} I supposedly went over by. My account balance was {$0.00} ( a positive amount ) when they charged me a {$38.00} fee for overdrafting!!! This is bad business, you should not make money off of your customers based on when you decide to processing pending items. I repeatedly asked the Supervisor, XXXX ( employee id XXXX ) to send me to the retention or to the customer complaint department to which she finally shared with me that M and T bank does not have these sorts of departments within their organization. Well let 's just say, I 'm not surprised. XXXX had a grace period so that if you did happen to overdraft based on process timing such as this you would not be charged a fee. If it was due to your own error, as long as you fixed the discrepancy within ( I think ) 24 hours they would NOT assess a fee. They would also not charge a fee if the amount was under {$10.00} ( which I thought was a Federal mandate but maybe not ). M and T bank is very creatively capturing my money and I am sure many other customers money with this clever practice of charging a fee based on the timing of THEIR processes, nothing to do with the client and even less to do with overdrafting. As a single mom living paycheck to paycheck every cent counts. {$38.00} may not make most people bat an eye but to me that 's groceries for a few days or gas for the week. I believe if there was a class action suit against them that many many clients would fall into the right category to qualify to sue M and T based on this issue. I will gladly go back to XXXX XXXX XXXX and pay a fee for transferring my own funds between my own accounts before I would EVER bank with M and T again.

Consumer Complaint: This Lender was stopped from reprocessing my Vehicle ( an RV ), because I got them satisfied but they picked my RV earlier ( repo ) than they agreed, and in the process of driving/towing moving my RV they they ruined my RV. I got it back because it was drivable but ... Consumer Complaint: We have received multiple unlawful overdraft fees from M & T. We have set up automatic payments for our bills. However the amount does not come out of the account when it is suppose to. The amount is held and taken out of the account weeks after. The bank machine displays the incorrect balance. Causing the account to be overdrawn. As a result of the account being overdrawn the other bills which are suppose to get paid are rejected. The company without authorization tries to take the money from the account multiple times after rejection. As a result the bank charges XXXX for each time the company tries to get the funds after rejection. We were not notified about these fees. The account has been overdrawn multiple times due to the fact that the correct balances were not displayed at the ATM and online. We were told by M & T not to trust the ATM machine or Online balances when we complained. We are also being charged a service charge to our savings account if it is not over XXXX dollars. There was no notification of this matter. We were told that all checkings and savings accounts were free. As a result we have paid M & T bank thousands of dollars in unlawful overdraft and service fees.

Consumer Complaint: I went to the ATM on XXXX the XXXX and deposited XXXX checks XXXX for XXXX and XXXX for XXXX which brought my balance to over XXXX. I pulled my account up on line the next day Monday the XXXX, and my statement was showing my Balance as XXXX and my available balance as XXXX. My deposits were pending and so were my debits. XXXX Monday night they put all my debits through including a check for XXXX at XXXX. Then at XXXX they released my entire deposit. According to the person I spoke to at the bank ... they put the withdraws through first at midnight, but do n't put the deposit in until the am. They claim it was XXXX different days. Therefore purposely over drafting my account, and charging me XXXX. But yet if you pull my statement you will see no where, where I was in the negative. I called the bank to ask that they waive the XXXX they refused. They also did this back in XXXX. I had a direct debit come out of my bank at XXXX XXXX, and at XXXX in the morning I had a direct deposit come through my bank. They said I did not have enough money on the XXXX Knowing that I had a direct deposit coming through in the am ... something needs to be done about this how can you overdraft knowing there is a deposit coming through hours later. I think this is very confusing the way they are doing business, and they purposely do business to confuse the consumer.
