Consumer Complaint: Mortgage was taking out in XXXX with XXXX. Due to divorce and declared bankruptcy. I have been trying to work with XXXX since XXXX to have my mortgage modified. I also made payments and applied for modifications. After being denied modification I stopped making payments on the loan. Currently I am not sure who owns the loan or services. As I have never gotten a formal letter notifying me. I receive a bill from M & T and Service request from XXXX XXXX Servicing on mortgage refinancing. Consumer Complaint: I have recently been approved for Mortgage Assistance payments though a State program, and the lender, M & T Bank is a participant of this program. In XXXX XXXX, the Mortgage Assistance Program paid for XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX mortgage which caught up all that I had got behind in payments. The agreement made between the State Program and the Lender is to pay {$760.00} Mortgage Payments during the need of my assistance. I noticed that my XXXX XXXX and XXXX XXXX Mortgage Statement has XXXX Dollars ( {$70.00} ) Return Item/Other Fee ( XXXX ) listed where it was 'NOT LISTED ' BEFORE. This bank ( M & T ) is trying to sneak in fee XXXX s ) that is not warranted. I called M & T Bank on XXXX XXXX, XXXX regarding this charge of {$70.00} and was told it was a monthly inspection fee. There was no inspection ( s ) done - I have been unemployed since XXXX XXXX, XXXX and " NO ONE '' on behalf of M & T Bank came by to do a inspection. The next excuse was " someone could have rode by ''. Riding by is not an inspection to determine if the house is vacant or abandoned. This fee of {$70.00} " WAS '' added after the State Mortgage Assistance Program caught up my payments that I was behind.

Consumer Complaint: ***This is my 2nd complaint against M & T bank for deceptive mortgage practices On XXXX XXXX, XXXX I filed for Chapter XXXX bankruptcy and surrendered my house located at XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX as part of the bankruptcy. The mortgage was held by XXXX Bank. My mortgage with XXXX XXXX XXXX in the amount of {$150000.00}, Account # XXXX, was discharge in Chapter XXXX bankruptcy on XXXX XXXX, XXXX. The amount was reduce to zero and I am no longer financially responsible for the mortgage. On XXXX XXXX, XXXX, after the mortgage was discharged and I was no longer financially response for the mortgage, XXXX Bank transferred the mortgage to M & T Bank. After that date I started receiving calls from M & T Bank / XXXX XXXX XXXX that I need to make payments on the mortgage to them. I filed a complaint with Consumer Financial Protection regarding M & T Bank / XXXX XXXX XXXX. M & T responded that I was correct, the loan had been discharged in bankruptcy, and I was no longer response for the loan. On XXXX XXXX, XXXX I received a XXXX from M & T bank showing cancellation of debt in the amount of {$150000.00}, and a XXXX.However, since the debt was discharge in bankruptcy on XXXX XXXX, XXXX, no actual debt was transferred to M & T and I should not have received a XXXX. M & T need to correct their mistake. I have attached the following : copy of the XXXX & XXXX, response from M & T on XXXX XXXX, XXXX regarding my previous complaint, Florida assignment of mortgage document showing mortgage was transferred from XXXX to M & T after bankruptcy discharge, Schedule D from my bankruptcy documents showing the XXXX mortgage was included in the bankruptcy, page from the bankruptcy showing that the property a XXXX XXXX XXXX XXXX XXXX XXXX Fl XXXX was surrendered in bankruptcy, my bankruptcy discharge document dated XXXX XXXX, XXXX, letter from the bankruptcy showing that I completed all payments on my bankruptcy plan & the bankruptcy trustee 's report of receipts and disbursments.

Consumer Complaint: I was in active review for a loan modification since XXXX/XXXX/XXXX ( see attached, email receipt from M & T Bank acknowledging a packet has been received ). I had complied with all of the document requests ( see email chain between my counselor XXXX XXXX and M & T Bank, XXXX XXXX was sending the documents through the portal on my behalf ). As you can see, M & T failed many times to respond to XXXX requests for updates on my loan, and when she tried physically calling to M & T bank since she was n't getting written responses, M & T Bank told her they did not have authorization on file, when it was faxed to them once on XXXX/XXXX/XXXX and again it was sent with the packet submitted through Hope Loan Portal on XXXX/XXXX/XXXX. There were so many delays on M & T Bank 's part that XXXX XXXX had to get a 3rd party involved to try to force M & T Bank to respond ( those emails are also attached ). XXXX XXXX had to refax the authorization form twice in XXXX XXXX after trying, but failing to get an update on my file. She refaxed the authorization form to M & T on XXXX/XXXX/XXXX, and they said they did n't get it, which caused another delay. She then tried emailing again though Hope Loan Portal to no avail ; then refaxed it on XXXX in desperation. M & T finally received that one ( I have an acknowledgement letter attached ) and then told XXXX XXXX the house had already sold at foreclosure auction on XXXX/XXXX/XXXX. My house sold because I did not have a copy of my pension award letter ( you can see that was the last thing they wanted ) - I could not get it that fast because the award letter had to be mailed, my pension benefits department would not fax it to me. M & T did nothing to help stall my foreclosure sale date even though they were only waiting for ONE document, and they had plenty of time to try to stall the foreclosure to help me get my documents to them. They also caused numerous delays, as you can see, by not responding to update requests in any sort of timely manner. My house would not be sold if they were doing their job in helping me delaying the foreclosure by a few days to allow me to get a copy of my award letter. I complied with all of their requests and unfortunaltely I could n't make my pension benefits department " hurry up ''. Even though they did n't have the actual award letter, I did send them the pension statements I get in the mail each month and the amount clearly does not change ; also my bank statements I sent to them every month show the same pension deposits every month - unchanging. Despite all of this, M & T kept moving forward with foreclosure because I did n't have the ACTUAL award letter even though they see it stays the same every month.

After XXXX emails and a phone call I was sent an email on XXXX that I would be receiving {$200.00} in my account on or before XXXX. I never received the bonus so I sent another email. On XXXX, XXXX, I received anther email that they were looking into the matter. They are clearly stalling and I suspect fraud. I am sick of this back and forth stall. I want this settled now.

Consumer Complaint: I was charged over {$15000.00} in bank fees in 3 months. My cash deposits were held as pending and fees accumulated due to the timing of the deposits. Holding deposits caused negative balances, NSF checks and many bounced check fees. A detailed review of my account listed the time of many transactions as " time not available ''. My account was set up for XXXX transactions. All transactions over XXXX are charged {$1.00} per transaction. I made several requests to have my account changed to an account that would accommodate more transactions, but the account was never changed. In one month I had XXXX transactions. Information about my account was provided to third parties without my consent, which proved damaging to my reputation. Requests for reimbursement of the fees were ignored and then finally denied with out any explanation.

Consumer Complaint: M & T Bank set up a set of conditions making it impossible to pay off a commercial loan I had without paying a {$3100.00} fee even though the loan was sold as no pre-payment penalty after 5 years. I am only allowed to pay off this note on 12 individual days during any given year AND I have to give 60 days notice for that day. Here is an exert from the letter I sent them outlining the issue. ; I received a payoff letter from you on Loan # .... dated XX/XX/XXXX for an upcoming closing on the subject property. On that letter was a fee marked " Other Funds Due '' totaling {$3100.00}. I am disputing this charge and request that it be removed prior to my closing on XX/XX/XXXX. I was told in a phone conversation on XX/XX/XXXX that if I closed after XX/XX/XXXX, thereby satisfying the 60 day notice requirement, there would be NO PENALTY. This new charge did not appear on the previous payoff letter and was never mentioned during that lengthy conversation with several bank officials. To evoke a " 60 day notice '' clause AND a " close on one particular day '' clause is completely unreasonable and probably undoable. The closing date is mostly dictated by the buyer. To be able to predict 60 days PRIOR that we will be able to coordinate buyer 's attorney, bank attorney, seller 's attorney, title company, buyer, and seller to all be available on one particular day 60 days forward is ridiculous at best and certainly highly unlikely to be attained. I also feel this is tantamount to usury, robbery, and using a license to steal.

Consumer Complaint: I opened a XXXX IRA with Wilmington Trust ( now M & T Bank ) in XXXX. Five years later, they failed to notify me of the 5-year CD 10-day window, even though I had informed the bank of my new address. I resolved not to miss the next 10-day window to transfer my funds to another bank in XXXX XXXX. In preparation, I made multiple calls to M & T bank to ask questions and notify them of my intent. No one from M & T could facilitate my request to transfer funds, so I got the receiving bank to handle the transfer. When I confirmed the transfer, I discovered that M & T charged {$75.00} for the transfer -- even though it was during the 10-day " do with it what you like '' window and no one had informed me of this during my preparation period! When I called to ask them to reverse the fee, the branch manager said there was nothing he could do, and *then* M & T sent my statement declaring the {$75.00} transfer fee -- after the fact!
