Consumer Complaint: I am contacting your office because of an increasingly frustrating issue with XXXX XXXX XXXX concerning my mortgage. I have attached my original document to M & T and all the following correspondence. I believe the issues are clearly represented in my correspondence, and because of the inexplicable delays in responding to my simple requests, I can only begin to suspect that there is possible fraudulent action taking place. Please find all documentation concerning this dispute. I will continue to make the last undisputed payment amount as of XX/XX/2018 until this dispute is settled appropriately, however there are only two-three payments remaining and once paid, the likelihood of my collecting any overpaid or misapplied payments will be nil. I respectfully request you and your office immediate investigation and assistance in resolving this situation.

Consumer Complaint: I was called on XX/XX/XXXX by a debt collector, they are calling from a Tampa, Florida number. They told me the conversation would be recorded and I did not consent to the call being recorded as Florida is a double consent state. They then would not tell me who they were and what they were calling about until I had to call back to see who they were. They stated they were trying to collect a debt from XX/XX/XXXX from M and T bank. I had explained that I am no longer liable for this debt due to being over 10 years and they continued to argue with me saying I need to get my affairs in order and pay the debt. I receive constant phone calls from them even after telling them on a recorded line to stop calling. I do not know how they got a hold of my personal cell phone number as it is not a public listed number.

Consumer Complaint: In XX/XX/XXXX, M & T Bank assumed the responsibility of a mortgage loan I had with XXXX. The effective date of the transfer was XX/XX/XXXX. In my 10-plus years as a homeowner, I have made on-time monthly mortgage payments. Although the due date is the XXXX of every month, I typically pay within the 15-day grace period for mortgage loans. Thus, no late fees are incurred. However, since the transfer, M & T Bank has made recurring calls asking when payment is going to be made ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. ). The representative begins my asking to confirm personal information ( last four SSN ). This practice would seem suspicious. During the most recent exchange with an operator ( XX/XX/XXXX ), he asked when payment would be made. My reply : The same time frame as the previous month. Later, I wondered if the bank could see a record of my last payment. The representative said no since it was made online. Subsequently, he noted my response in my account. However, to my dismay, I received a phone call seven days later ( XX/XX/XXXX ).

Consumer Complaint: I had a mortgage with this bank for the past year and some months. During the time, I made all payments on time, including even some dubious increase in the monthly payment from {$3400.00} to {$3700.00}. I did my best under difficult circumstances to make timely payments. During the time, I tried I called them several times to see if we can get a refinance, but each time they flatly denied and wouldn't go any further to explain why, and at the time we were getting a lot of offers from other institutions to refinance. Nonetheless, I continued to make my payments. Last month, XX/XX/XXXX, we were finally able to close a refi with a different lender who wired M & T 's payoff to them on the same date as above. Before then, they had been made aware of this closing and were totally involved. As expected they closed my online account that I had been using to transact business with them and retrieve documents and messages on the same day the principal was paid off. The processed it and effectively zeroed out the account. On XX/XX/XXXX, I saw that the regular transfer that always went out to them on the first day of the month had been initiated and was pending on my XXXX XXXX XXXXXXXX account. I called them immediately to let them know that they my account had been closed with them and I don't owe anything to them. I made aware I had a new mortgage that was due and therefore I need that money to pay the new lender. We did a lot of back and forth on the phone and told me they would investigate and take the necessary action. As I write this complaint, on XX/XX/XXXX, they neither have returned my money nor return my call. I am having to borrow money, not only for my new mortgage, but also other expenses that we incur as a young bottom of the barrel family struggling to survive in one most expensive places on earth : XXXX XXXX XXXX XXXX of California. Every cent we earn is important for us! It is certainly not right that this bank has unlawfully taken our money for over a week without making any attempt to return it, or even providing me a simple customer service of letting me know what is going on.

XX/XX/XXXX-no money showed in either account ; reported it to bank XX/XX/XXXX- {$500.00} showed in checking ; nothing in home equity several more visits XX/XX/XXXX-bank calls central services again ; say they've figured where the money is ; will take another 3-5 days to credit account. With my vocal complaining they'll try to expedite in 2-3 days. This means ~2 weeks to credit my account for the {$9000.00}! This is far too long. It was their computer malfunction that was responsible. I have my documentation/

Consumer Complaint: i have disputed this with the credit bureaus 3 times i have contacted the bank ( m & t bank ) over 20 times over a 3 month period starting in XX/XX/2017 when i had the loan originated with XXXX XXXX XXXX who you bought it from there was supposed to be 4 months of reserves. 3 days before closing the terms were changed by the underwriter and i was not informed. after M & T Bank bought the loan i had assumed this went through. i did not receive in XX/XX/XXXX, XX/XX/XXXX or XX/XX/XXXX stating that my payment was due. in XX/XX/XXXX i received a tax bill from my town and a mortgage bill. i call m and t and asked why i received the bills and if there was money in escrow to pay it, I WAS TOLD YES THERE WAS. in XX/XX/XXXX i received the 30-day late notice from my credit report and immediately call m and t to find out what happened. they explained that there was no money in escrow for mortgage and that when i was told there WAS they were only referring to the tax bill. I IMMEDIATELY PAID ALL 3 MONTH OF BACK MORTGAGE TO CLEAR UP THE MISUNDERSTANDING. The 30 days late was not my fault, it was not m and t fault but a tragic misunderstanding by both parties and i should not be penalized for this. I have provided documentation from both the originating bank ( XXXX XXXX XXXX ) and emails stating this. the only response i get from M & T Bank is " we looked into the matter and believe the reporting is correct ''

Consumer Complaint: We were in a chapterXXXX starting in XXXX. When BK started we were 30 days late with M & T Bank ( M & T ) ( act # XXXX mortgage ) the trustee was to put the payment in arrears, however after the BK was discharged we reviewed the BK with our attorney and were informed it was not paid he recommended we pay it ASAP so we did. We were never charged a late fee either. M & T was not reporting to the credit bureau 's ( I'm informed that it part of a chapter XXXX ) M & T started reporting to the credit bureau 's XX/XX/XXXX and started the report with a 30 day late. I have disputed the derogatory report to the credit bureaus through XXXX XXXX and have not yet received a response as to a decision ( 90 days since reporting ) M & T has acknowledged a dispute has been filed but representatives say they can not remove the report at their level. I am trying to refi this loan to go forward but can not due to their report. I would like the derogatory mark removed the loan is current and I pay it on the XXXX of every month when it is due on the first ( technically paid before due ). I believe they should not ding my credit for late when they did not even charge a late fee, that implies to me the chapter XXXX rules dictate they should not even be reporting. Please help!!!
