Consumer Complaint: This is my second complaint against M & T Mortgage regarding the same issue. In XX/XX/XXXX I had some financial issues due to a sick child and my home went into foreclosure. I as able to take care of that issue and it was resolved in XX/XX/XXXX. I made all of my payments as I was supposed to but In XX/XX/XXXXI received a letter from M & T bank stating that I had missed my XX/XX/XXXX mortgage payment. I first contacted the company via email and gave dates when my payments were made. The answer I received was that I had not made a payment on XX/XX/XXXX so I sent in a copy of my bank information. After many hassles, I gathered all of my information and complained here. After 30 days, I was told that I was behind on my mortgage and that I owed. On XX/XX/XXXX I had scheduled for the XX/XX/XXXX payment to come out of my bank account and they refused payment stating that I had to pay for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX for a total of {$1700.00} and pay this by XX/XX/XXXX or they would accelerate sale of my house because I did not pay as the contract stated. It was also noted that the charges would go up daily and to call before I paid. I am attaching copies of their statements, the account activity that their employee mailed to me and copies from my bank account. After going through the activity on my account provided to me by M & T Bank, this is what I have found. From XX/XX/XXXX thru XX/XX/XXXX all of our records match. Then, I made a payment for XX/XX/XXXX which was taken out of my account on XX/XX/XXXX and it does not show that it was applied to my account but I have provided the information from my bank. I made a payment for XX/XX/XXXX early trying to help improve my credit score - it came out of my account on XXXX according to M & T Bank , this was applied to my XX/XX/XXXX payment. Once I made the two payments in XX/XX/XXXX, the activity for my account does not match anything. According to my M & T statement dated on XX/XX/XXXX- I had only one payment due for XX/XX/XXXX and the transaction activity is also wrong. The date on my bank statement showing that that the payment for XX/XX/XXXX came out of XX/XX/XXXX but I had already made XX/XX/XXXX payment on the XX/XX/XXXX. My XX/XX/XXXX statement shows that I still owed for XX/XX/XXXX but that is untrue because I made the payment in XX/XX/XXXX. I made my XX/XX/XXXX payment of XX/XX/XXXX and this is backed up by my bank statement. On XX/XX/XXXX, I scheduled a payment for XX/XX/XXXX to come out of the wrong bank account and the funding was not there. M & T reversed the payment on XX/XX/XXXX which I have provided the proof of that in my activity report. I did rectify the situation and made XX/XX/XXXX payment on XX/XX/XXXX and added an extra {$20.00} for the NSF fee - I have provided my bank statement for that also. Once I had rectified that, I even received an email from Credit Karma congratulation me for getting my account with M & T current. I have attached a copy of that email also. M & T 's explanation, shown in the letter from XXXX states that the payment on XX/XX/XXXX was for XX/XX/XXXX but I have provided my bank statement showing that was not the case, I had indeed paid on XX/XX/XXXX. My XX/XX/XXXX payment I made on XX/XX/XXXX, again, I have provided my bank statement. My payment for XX/XX/XXXXI did not pay until XX/XX/XXXX but I have provided my bank statement for that. I had scheduled for my XX/XX/XXXX payment to come out on XX/XX/XXXX but M & T refused that payment. The explanation given to me is that they can't take any payments from me unless I pay the full amount due. They can not make any kind of payment arrangements. Considering that fact that I made my payments on time until they refused to take anymore, that is absurd. The second part of my complaint had to do with the fact that my house payment went up because my home owners insurance lapsed. I was informed that I did not have insurance from XX/XX/XXXX until XX/XX/XXXX which is when they credited my account. Well, I have had insurance since XX/XX/XXXX. When I set up the policy with XXXX, they were going to collect the money from M & T and I would pay monthly through escrow. My agent was unable to get any response from M & T and that policy ultimately was cancelled at the beginning of XX/XX/XXXXbut I got ANOTHER policy going with XXXX and AGAIN they received zero response from M & T. I panicked and changed the policy so that I would pay monthly because I did not want to be screwed yet again when I was trying to follow the rules. I over paid on my mortgage payment in XX/XX/XXXX and XX/XX/XXXX by the amount of {$290.00} because I should have had a credit to my account in XX/XX/XXXX, not in XX/XX/XXXX, which is when they added the credit. My first insurance policy number with XXXX was XXXX XXXX XXXX which I have provided a copy of the bill. The second policy number is XXXX XXXX XXXX Which is my current policy. I have two special needs children and all I want to do is get this issue resolved. I do not want to lose my home, but it seems like they just want to take it from me. In conclusion - I paid made my payments on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and the XXXX payment came out on XX/XX/XXXX, XXXX through XX/XX/XXXX and M & T is insisting that I owe for XX/XX/XXXX, XX/XX/XXXXand XX/XX/XXXX when actually, because they refused my XX/XX/XXXX payment ( not my fault ) I do owe XX/XX/XXXX and XX/XX/XXXX and now, since XX/XX/XXXX is tomorrow, I owe for XX/XX/XXXX.

Consumer Complaint: On XX/XX/2019 I transferred {$390.00} dollars from my XXXX account to my M & T bank account like I have done many times in the past except this time it never showed up in my M & T bank account. XXXX charged me {$4.00} for the transfer to be instant but I never received my money. XXXX performed numerous traces on the transaction but every time they came to the same conclusion that the money went to M & T bank and thats all they can tell from their end. XXXX says M & T bank must of put the money in someone elses account. XXXX gave me a tracking number and said the bank could use it to find my money but the bank said that number was useless to them and they didnt know what happened to my money. I made several phone calls to them and they were less than helpful. Nobody at the bank really even tried to help me.

My only thought is that my monthly statement did not get to me, or the payment was not applied as fast as expected. I checked my bank account and noticed that you deducted the money out of my checking account that on the month that you marked me late on my credit report.

Consumer Complaint: In XXXX, 2018, I learned that my M & T checking account was overdrawn. I discovered that someone had used my account to make a purchase on XXXX. I contacted XXXX and the charge was reversed. I also notified M & T bank. However, insufficient funds charges and penalties had already been imposed. XXXX restored the money to my account, however M & T did not remove the insufficient funds fees and penalties. Furthermore, the bank took the money returned by XXXX, approximately {$8.00}. Now there is a collection agency demanding {$89.00} for the improperly assessed insufficient funds fees and penalties threatening to damage my credit. M & T must be held responsible for its error and continuing harm it is causing to me.

Would not dispense escrow money account.This company has been pretending to be a mortgage company from some time. Consumer Complaint: My account with M & T Bank was opened on XX/XX/XXXX. I was told that after XX/XX/XXXX, checks I deposited would no longer be held for 5 business days. On XX/XX/XXXX I deposited my payroll check, which was available the next business day. Since that went through fine I figured I was okay to transfer, via check, money from a separate account I own, but had lost my atm card for. These transfers were time sensitive because my daughter is supposed to be having XXXX and I needed access to those funds to pay for it. On XX/XX/XXXX I deposited a {$1000.00} check. I was told {$250.00} would be available immediately and {$750.00} would be available the next day. So on XX/XX/XXXX when the funds weren't available I called and was told that there was a 1 business day hold and the funds would be available on XX/XX/XXXX. Believing that, I wrote another {$1000.00} to transfer more money from my other account. Based on what I'm STILL seeing online {$250.00} would be available on XX/XX/XXXX and the balance 1 business day later. This morning I woke up expecting to see a balance of about {$1000.00} in my account. So when I looked and there was only {$1.00} I was deeply worried. I immediately called M & T Bank where I was told that a 4 business day hold was placed on these checks. Now, per their OWN funds availability documents, they are to notify when a hold is placed. I received no notification. Not a call, not an e-mail, even my online account STILL shows that these checks should have cleared by now. But instead I had to put off my daughters XXXX yet again, while M & T secretly changes hold dates with no notification to me. Additionally, something I find troubling. Late at night when I was checking my account, it was showing as - {$990.00} overdrawn. I have NEVER been overdrawn by that kind of money. The most I was ever overdrawn was {$5.00} when I forgot about atm fees. And immediately resolved the problem by depositing cash into the account. I also received a notice on XX/XX/XXXX via M & T website that was a Notice of Insufficient Funds. Again, they were showing my account hundreds and hundreds of dollars overdrafted when it's NEVER been overdrafted like that. I would like answers to why M & T is falsely sending these notices to make it look like my account is always in the negative and WHY they are holding my money with no notice to me, but making it look like it should be available on their website. When I called and spoke to a supervisor he basically said he'd reach out to the department responsible but that I wouldn't hear back from him until Monday because he was leaving the office today at XXXX. Not even an offer to have another supervisor reach out to me. Just ... wait til Monday. No concern for my kid who will now have XXXX pushed off yet again. Which is costing me money every time I rescheduled.

Since taking over my loan M & T Bank has engaged in a campaign of harassment concerning my HO6 insurance coverage. They initially sent several notices claiming to have no proof of my insurance however this was included with my mortgage documents. After providing them with the proof, they again claimed they had no proof and now wanted the property address to include a unit number. I complied with this request. They have now created a fictitious address and attached it to my loan and are again demanding HO6 insurance information. Each demand includes a threat to attach HO6 premiums to my loan and includes FDCPA language concerning an attempt to collect a debt. I brought the matter to their attention and was told I would be contacted last week with resolution. Instead I received a further 4 notices again referencing the fictitious property address and threatening collections.

Consumer Complaint: I had a Mortgage with XXXX XXXX XXXX that was sold by XXXX XXXX XXXX to have M & T BANK several years back. Once M & T Bank took over the Mortgage loan ; Hurricane Irene arrived, and wreaked a lot of damage to my home, located in XXXX Florida. After fighting for over two years with XXXX XXXX XXXX XXXX XXXX to get damages covered ( with the help of a professional adjuster and an attorney ), I finally got a settlement to replace my damaged roof ( not enough money to cover the Hurricane Irene damages, but close enough to begin roof replacement with the help from a personal loan ). The XXXX XXXX XXXX XXXX XXXX settlement check was made-out to my wife, myself, XXXX XXXX ( HELOC mortgage lean holder ), and M & T Bank the main Mortgage holder. XXXX XXXX did not hold the check, but issued the required signature for the release of the XXXX XXXX XXXX XXXX XXXX funds. The signed check was sent to M & T Bank Mortgage in XX/XX/2019. In early XX/XX/XXXX, I was advised by several M & T Bank Mortgage personnel to submit a list of over twelve documents to M & T Bank. I ended-up filing over twenty-pages via Fax, and via M & T Bank web page " XXXX XXXX XXXX '', and through Certified mail ( Claim Tracking # XXXX ). I have had to file the twenty-pages via Fax, and via M & T Bank web page " XXXX XXXX XXXX '', over-and-over again to insure that they have received required documents. M & T Bank still will not release the funds to replace my roof, even though my roof keeps leaking, and further damages keep surmounting. Many dozen phone calls have been placed and documented to try to get M & T Bank to comply with the releasing of the funds to begin roof replacement work, but to no avail. Almost every instance I call M & T Bank, I am advised that the case is still being looked at. It is the only answer that I normally get. Besides filing a lawsuit against M & T Bank, I do not know what other options I may have. Please Help.

Consumer Complaint: On XX/XX/XXXX, M & T Bank/Mortgage, the servicer of my home mortgage, auto debited my mortgage payment out of my checking account. They should not have done this as I had cancelled the auto debit for the XXXX mortgage payment in early XXXX, XXXX. Additionally, M & T Mortgage was paid off, in full, on XX/XX/XXXX and should not have debited the payment that was no longer due. Additionally, I have an escrow refund that is due me of $ 1600+. As a result of the auto debit, my checking account became overdrawn. I contacted M & T on three separate occasions, on XX/XX/XXXX and XXXX, to request a reversal of the auto debit and to put the money back in my account. They refused, saying it may take up to 30 days for me to receive my refund. This is not acceptable as it was their mistake, not mine.
