Consumer Complaint: I am writing a letter of complaint below against M & T Bank. I On Wednesday, XX/XX/XXXX, I had a package from M & T Bank that M & T Bank set up a new repayment plan and I found there is {$9700.00} of Bank Attorney fee and other charges for setting up another repayment plan. I had already a repayment plan set up ( M & T Bank v. XXXX, XXXX, Index No. XXXX ) in the year of XXXX and the bank said that the existing repayment was suspended due the returned check payment in XXXX, XXXX. My repayment plan started XX/XX/XXXX and I've been paying every month over the phone with the help of XXXX of M & T Bank until now. The payment of XX/XX/XXXX was supposed to be taken out on XX/XX/XXXX but I confused the date as XX/XX/XXXX and I only recognized on XX/XX/XXXX that the check was returned. Immediately, I called XXXX and M & T Bank to solve the problem and advised redeposit. XXXX Please see attached copy Doc # 1 of my phone bill to see that I called to M & T. ) Since XXXX was not in the office I left a message on her voicemail explaining what happened and asking for returning my call to redeposit and also called the other M & T staff. I asked the other agent to redeposit the check but he kept saying that the payment went through. Finally, I spoke to XXXX telling what happened. She just advised me for the payment of {$7600.00} in XXXX and paid another {$7700.00} in XXXX. I thought everything is fine since I've been paying the repayment every month and XXXX was taking the payment as usual. I don't know how much I should pay each month and that is why I called XXXX and she helped me. I did not know either the money I paid went to XXXX payment or XXXX payment since no one from M & T explained to me when I call M & T for the payment. Normally at the end of the repayment plan, the bank will recalculate all the payments and they will let me know the final balance. Recently I've kept calling XXXX to arrange the payment and left a message and I spoke to the other agent for the payment and he said he can't take the money since the system doesnt allow and said I need to talk to XXXX about this issue. Both he and I left a message to XXXX and she returned my call. She said the system does not allow her to accept my payment and she will find out the reason. Since I have no returning phone call from XXXX, I called her again and she told me since the check was returned on XXXX, the system is not allow and she need to ask to the bank attorney what to do. At this point, since I don't know much about the bank system, I told her that I paid each month with her as she knows and I don't want to pay any more to the bank attorney and I insisted that I wanted to pay to the bank. She kept saying that she can't take the payment since the system doesn't allow and send my case to the attorney. The above is the situation that I know of. And the below is my defense. 1. I've been trying hard to pay each month. As you see the attached document, I misunderstood the payment date as XX/XX/XXXX and the balance was available there on XX/XX/XXXX and thereafter to pay the XXXX payment ( See attached Doc # 2 from the XXXX XXXX ). When the XXXX payment was returned, I've been calling so many time to ask for help and redeposit. I did not neglect the situation ( See the attached Doc # 1 from XXXX XXXX XXXX ) but I only had a chance to talk to XXXX on XX/XX/XXXX. Neither XXXX of M & T Bank who I always spoke in each month nor I was knowing that there was an issue so I paid and XXXX received the payment as usual without letting me know what to do to prevent the suspension of my repayment plan. So I paid 2 more payment after XXXX without any objection and tried hard to pay XXXX and XXXX. And also I thought I am supposed to pay more at the end when the M & T finalize the XXXX repayment plan in XXXX, XXXX. 2. M & T should have let me know for the arrear before they stop and reissue the repayment plan with huge fees. It is obvious when people see my payment history that I've been paying each month without skipping. XXXX is the one who I always spoke in each month for the payment. She shouldve given me an exact payment amount and an answer when I asked her for help before she just sent my case out to the bank attorney for a new repayment plan. 3. The most important thing is that me and my husband can not afford to pay {$9700.00} of the bank attorney fee again. I've already paid the fee 2 years ago and this is the same case. I remember also, in XXXX, I was in the middle of applying for the mortgage modification with M & T Bank since we had a financial difficulty at that time but it was declined and all of a sudden we've received a foreclosure notice from M & T Bank and paid the bank attorney fee and other fee unneccesarily for setting up the repayment plan without other choices. I can't pay another {$9700.00} again for the same case at this point. 4. I am hardworking person and not a rich person. Last 2 years, we tried very hard in each month. You can see my bank account balance, mine always fall low the end of each month but we still working hard to keep the house and pay the debt to the other credit card company. 5. We want to pay off {$34000.00} or so of the balance of XXXX repayment plan and close the case by the end of XXXX. I don't need another repayment plan which costs money and time for us to struggling hard to keep the house. The M & T Bank suggested me for 10 % down and 36 month repayment plan on the new letter. That means in worst case, if something happens in next 3 years, if I miss even 1 month payment by accident ( I hope this will not happen ), the bank will stop the repayment plan and charge me another {$10000.00} fee again and again. The law should exist against bad person who doesn't pay with bad intention or someone who neglect their duty. But us, we were trying hard to keep the rule and keep the word. Consumer Complaint: M & T Bank is adding so many charges to my account, and saying I am behind in escrow, which I confirmed today, XX/XX/2019, with my insurance company I am not behind. I have spoke with the bank about giving me an explanation of charges and they can't seem to. Nor will they do a new escrow analysis to show that I am not behind in escrow. They have done nothing to help or prove anything. XXXX XXXX sold out to them back in XX/XX/2019, and it was the worst decision they ever made.

Consumer Complaint: In XX/XX/2019 my loan was transferred to M & T Bank. In XXXX I changed my home owners insurance to a better rate. I was billed an incorrect amount of $ XXXX monthly payment when my payment has never been over {$620.00} for the last 11 years. I called M & T Bank and was told there was a mistake that should have been handled previously, but wasn't. I was told to wait 5 business days for correction but nothing happened. After calling back XX/XX/XXXX, I was told I must pay the {$910.00} and they will fix it when they get to it. After speaking with a supervisor they calculated the corrected payment which was still higher than normal at {$660.00} which I paid at that time. Today XX/XX/XXXX I receive a letter of unapplied funds of {$660.00} and a statement for XXXX bill for {$910.00}.

Consumer Complaint: I originally had a car loan with M & T Bank that was taken out in XXXX of 2013. The car was totaled, and my insurance XXXX paid almost the entire balance with the exception of a few hundred dollars. I advised M & T that my GAP insurance would cover the rest, but they insisted that I pay the remaining balance immediately to avoid being sent to collections. The amount was approximately {$360.00}. I ended up paying out of pocket the remaining balance owed to M & T, they confirmed that the balance was {$0.00} and closed the account. Months later I received a check for the amount that I paid to them. I called them to confirm that the check was accurate and they told me yes. I have been calling to confirm that the balance on that account is {$0.00} and the account is closed. They continue to tell me that the account is closed with a {$0.00} balance and they can not explain why they are still reporting to the credit bureaus that I have a delinquent account.

M & T Bank claims it did not receive payment until XX/XX/XXXX, thirteen days ago. After not receiving lien release I spoke with M & T representative today and was told they have to wait for check to clear but the automated system said the account was paid off on XX/XX/2019. I can not sell this car without a title and getting the lien release is just the beginning of the process. I believe this should have been done before this.

Consumer Complaint: XXXX XXXX XXXX delivered on XX/XX/XXXX, HOWEVER, XXXX XXXX now called XXXX XXXX locates in XXXX, PA ) I allege performed unethical, illegal auto sale taking advantage of a single older female. I hold two originals of all documentation pertaining to a XXXX XXXX ( complaint filed with CFBP previously against XXXX XXXX XXXX wherein XXXX actually had to call me for my SSN to find me in their system ; no resolution since they stated which is opposite to dealer paperwork that they did not possess the insurance policy costing me somewhere in the area of {$2300.00} with the dealer not being cooperative and some individual actually retitled car in XXXX, NJ unbeknownst to me and confirmed by XXXX in XXXX when they stated was I aware the State of NJ did not recognize me as the registered owner. XXXX XXXX was never cooperative after XX/XX/XXXX purchase and it took year of badgering them to receive the XXXX I should have received on XX/XX/XXXX. In addition, XXXX stated the model sold was misrepresented to me which caused a more expensive loan. I contacted XXXX but because I purchased the truck at a non-XXXX dealership they could not help me. I only recently handed in the tags to that truck in XXXX, NJ after going online to see the tags were bogus. For record purposes on prior CFPB complaint : no resolution except brief letter from XXXX ( which changed their name & address during the length of the loan ) stating the balance was paid off by XXXX and the title forwarded to them and never did they acknowledge the truck was indeed mine. This truck purchased after leaving an abusive spouse in XX/XX/XXXX is actually shown on the Divorce Decree as the vehicle I was entitled to leave withunethical and illegal since it was bought after I left spouse and during a two year separation no attorney filed a motion for financial support! I should have left with a XXXX XXXX XXXX XXXX presented to me at XXXX of XXXX in NJ ) which was sitting on the showroom floor with a big red bow on it. I was handed the keys and congratulated on the car which my former spouse enabled on the day prior. Against family law regulations, never did spouse deliver documentation as to the XXXX as to whether it was leased or purchased nor would he meet me at the dealer to allow me to takeover the financing of the XXXX loan. This complaint actually encompasses all vehicles purchased during a 10 year marriage with ex a business owner and my first husband being a XXXX in various dealerships throughout his life. I am XXXX and incapable of trying to discover how all cats I purchased and paid for and believed to be mine but during divorce discovery is when I found out via XXXX XXXX from a fax sent to my second counsel that all autos were registered as business and registered to ex. Despite calls to DMV, XXXX XXXX, the manufacturers, the banks, calls to first spouse have yet to resolve a massive conspiracy of some sort whether its title washing, etc. which needs to be investigated so that the manufacturer knows I purchased one of their vehicles which provides discounts usually not given. Cars involved : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX XXXX, XXXX XXXX, XXXX truck, XXXX XXXX which I know was paid for via {$23000.00} laid out on purchase as witnessed by exs cousin XXXX XXXX who received a {$50.00} fee referral/copy of check in my possession ), XXXX and lastly the XXXX XXXX XXXX which as of this date XXXX refuses to note me as the owner with a major collision occurring on XX/XX/XXXX with the vehicle parked in XXXX, PA ) and towed away that date and not returned until late XX/XX/XXXX. XXXX notes collision under first owner. All other data falsified pertaining to me as the second owner. I have evidence to show there is another Indivifual using my identity to retitled this car in XXXX XXXX at the DMV in XXXX, NJ. In a fluke incident in going to FL earlier via XXXX XXXX, the XXXX Rep at the airport pulled up my profile and an individual who lived at XXXX, XXXX, NJ registered in their rewards program. It was later changed but that doesnt stop ongoing impersonation of myself. XXXX shows this XXXX was retitled in XXXX, NJ and I can only assume it was my impersonator who I found via XXXX which I had to shut down years ago ). Due to XXXX now XXXX XXXX refusal of all my calls ( one of which I recorded ) along with not cooperating with XXXX the XXXX carrier can not comply XXXX with the correct Purchase Contract since there are two originals involved both dated XX/XX/XXXX bs XX/XX/XXXX ; impossible delivery date based on insurance not binded until XX/XX/XXXX. Only XXXX in which I sent a handwritten 26 page fax which could not be sent online due to cybercrime to this day ) is the only entity that can confirm the statements made herein. XXXX XXXX the carrier fully liable for this collision should have declared car a total loss but it was myself who actually forwarded pictures of the collision to them AFTER the body shop started the work. Many other issues with communication between XXXX and XXXX caused months of financial hardship on my end ; a XXXX individual taken advantage of thruout my life time which I have read more times than not is the scenario for those of us XXXX. It is doubly hard for me with no family nor friends and almost losing my life on XX/XX/XXXX with my health forever deemed more compromised than before. Am sending this complaint only because I have access to WiFi while in rehab ), M & T Bank the lender verbally has stated this car is mine but they are basing their statements on what the dealer sent. Only by going to Florida this year that I discovered my impersonated and M & T would never know the car was retitled in XXXX XXXX in XXXX , NJ ) XXXX has now closed an approved GAP claim since I can not provide in good conscience one of the two Purchase Contracts which are dated wrong and the Odometer Readings are different between the two plus signed off by different individuals. I am entitled to a full refund but with M & t telling me to tell XXXX to do the leg work which will not happen and dealer refuses to cooperate to all parties and my refusal to ever retain another corrupt attorney ever again, I continue to pay for a vehicle that is a total loss, not being manufactured by XXXX as mine ( yet the DMV assures me its mine ) and buying it in XX/XX/XXXX at XXXX miles and presently has XXXX miles proves the lack of driving and time I had to use the car. No one would ever buy the car as even the initial XXXX does not know the rear was hit prior to purchase. I am resorting to filing a complaint against M & T as my only outlet to resolve GAP claim and this bank was used to finance the XXXX my ex bought during the marriage of which I have documentation to ).

Consumer Complaint: XXXX sold my mortgage account to M & T Bank. I decided to open a checking account online with M & T Bank. I entered my information ( including my SSN ) and other information. My Mortage account and checking accounts are linked. That same day of opening the checking account, I was allowed by M & T Bank to fund my account with {$250.00} via a credit card ( not sure if that is legal? ). I've held the accounts for 3-4 months. I recently inquired about closing my account and withdrawing my funds. The bank replied that it would cost {$50.00} to close my account early plus additional fees for mailing a check. The bank then stated that my account was frozen ( so that I couldn't withdraw ) until I submit verification forms of Social Security Card, Utility Bill, Drivers license. I contacted their verification department, and made the point that I was able to open the account and deposit money, so I should be verified since I gave them my ssn and they have a mortgage account for me already. The verification department refuses to unfreeze my account until i " Provide my original social security card '' to them! I told them that I was uncomfortable with doing that and then they emailed me saying, " We need your original Social Security Card and a current bill. The hold will remain on the account until we receive the requested documents. ". Every time I talk with them the verification forms they are requiring changes and I'm not sure why. As provided above, I do not want to give them my original security card as they're demanding but they're refusing to unfreeze my account so that I can close it out which seems pretty shady. Please help with this, I also dont want to take on their huge fees in closing out early and will wait a few months to do so without a fee, but I cant do anything until the account is unfrozen.
