Consumer Complaint: Hello, It's currently XXXX XXXX and I am up writing this complaint because I overwhelmed with the current situation with my mortgage company, M and T Bank. On XXXX, XXXX, I had a pipe that burst in my kitchen and caused water damage. I immediately had the pipes repaired and started the drying process. I submitted the claim to my insurance company and they released the check which arrived this week. When I contacted M and T Bank to get an address to mail the check, I was told that I have to wait for the approval process to release the check because my mortgage is delinquent. I mentioned that my mortgage is in forbearance because I lost my job due to the pandemic and that I don't believe it's considered delinquent. I was then told how the process would work and the money I have already paid to start the work, I'm welcome to send receipts and they will reimburse me. I was a single mom of XXXX daughters when I purchased my home. I supported my daughters through college and worked as a XXXX XXXX until my office closed due to XXXX. The home I purchased was almost in foreclosure and a lot of work when we moved in. I have invested more than XXXX into my home and have every intention to restore my home to the way it was. When you read about the insurance payment process online, they articles tell the homeowner to be kind, patient and polite to the lender if you want to get the funds released in a timely manner. We need our home restored and I have no intention to lose our home. I felt like the conversation was threatening and I was even told by an employee when I first called that I do not want to go down the road as if my loan was delinquent and have them micro manage the process. I have had my home for 5 years and have never defaulted on a payment. I am asking for help to get the funds released so I can complete the work and move forward with our lives. Once I go back to work, my plan is to refinance the home and the pay off the forbearance payment.. If you look at the website to submit a request for payment, the process will take months to complete and I believe I will be hararrased as we go along. I know they have an invested interest in the property and so I do. Are there any guidelines that can protect this process and ensure the work in my home will be completed efficiently? I live in California and the company in PA. They told me they have to find an adjuster to come by and review the progress. I am willing to upload pictures which should suffice or the adjuster can come upon completion, Do I have rights and if so, can I please be advised?

Consumer Complaint: Lenders do not use the standard Loan Estimate form. Lenders give customers a very hard time when the standard Loan estimate form is requested. In some instances, lenders refuse to provide the form. I believe the use of a form that deviates from the standard document is intentional and a way to confuse customers and make it harder for us to comparison shop. I was not aware that the standard form existed, or that it was a requirement that they provide it until 1 of the 3 lenders I spoke with told me.

Back in XX/XX/2020 I recieved a SBA loan for my XXXX that I am XXXX XXXX of, everything was fine I was rebuilding my XXXX everything was going well. Until XX/XX/2020 my account was frozen. I was told it could take 48 hours to review. I patient ly waited, heard nothing from them called back for them to tell me they had no new information. So of course I offered to give them my LLC, EIN, and loan application which I emailed to the bank manager XXXX XXXX. I call literally every single day up until last week when I was told the bank manager would be going on vacation. Then started back calling everyday just for a update. The 1800 # as well as rhinebeck back, have no information. I've asked for a time frame. Still nothing. So now its been over a month and their withholding my money that I am paying interest on.

M & T has caused me to not be able to get access to COVID 19 funding or any type of funding because they incorrectly reported to my XXXX payment to my credit because I'm XXXX American. See original complaint below. Original complaint XXXX XXXX XXXX M & T Bank Account Number : XXXX Home Address : XXXX XXXX XXXX XXXX XXXX, MD XXXX I called M & T bank in XXXX between the XXXX and the XXXX. I requested and was approved for a loan extension for the months of XXXX and XXXX. I was told that I will receive the documents to sign via USPS mail. I received the documentation on XX/XX/2020. I signed the documentation, scanned it and sent it to the email provided on the paper. Today XX/XX/2020 I get a notification that M & T bank has reported me 30 days late for the month of XXXX. In addition to me being approved and submitting loan documentation my XXXX payment is NOT 30 days late at this current time. My XXXX payment is due on XX/XX/XXXX and today is XX/XX/XXXX which is ONLY 25 days. There is no reason for me to be 30 days late at this current time ( especially since an extension was granted ). Attached are : Screenshot of submitted email, screenshot showing 30 days late on my credit. Also the approved and signed extension agreement. This brings me to my next point. This bank does anything to suppress and attack XXXX Americans. I have reported them over and over for interactions like this and in-person interactions at the local branches. It's obvious to me that local, state, and federal officials are in bed with M & T. When I complain M & T responds by retaliating. I am XXXX and XXXX of this XXXX XXXX, what it represents and the XXXX that it spreads. I've said it before and i'll say it again. This organization is run by XXXX XXXX.

Consumer Complaint: This relates to my existing claim, number XXXX, with M & T Bank. After the bank improperly drilled my safe deposit box and lost a coin, they sent my items to the bank 's abandoned property division. I was advised by the XXXX branch ( where the deposit box was located ) that the Bank 's XXXX M & T XXXX branch would have the bulk of my safe deposit box possessions. This afternoon, I went to the XXXX M & T XXXX, XXXX branch to claim my property. When I arrived, the bank provided me with an affidavit to sign before I could even look at my property. I refused to so sign. The affidavit had prepopulated choices for the reason that the box was drilled. One was non-payment, the other was some other irrelevant choice whose name escapes me. The bank thus wanted me to state that it was my fault that box was drilled, when it was wholly caused by the bank 's failure to update its systems and to send me certified letters to the address that I provided the bank. The affidavit also required me to state that " all '' the contents of the box had been returned to me. This is not true. First, I couldn't even look at the contents before being required to so sign. Through a subsequent conversation with bank employees, I learned that they intended to reference the itemization that they provided. I believe that a maple leaf coin is missing. I am not going to swear out a false affidavit. My failure to state that the drilling of the box was my fault, and my failure to state that the bank fully provided me with my property ( neither statement is true ) was the sole reason that I was denied my property today. I escalated to a commercial manager, who was not helpful nor sympathetic. He provided me with the name of XXXX 's retail risk manager, a woman named XXXX, and I left her a message. I have yet to hear back from her. This conduct is unacceptable. In sum, the bank 's systems were not updated. They drilled my box without cause, despite the fact that I had a current box lease for that time period. They then lost one of my coins. Upon taking five days to get my property together, they then refused to provide my own property to me without signing an affidavit stating that it was my fault, and that it was fully returned. That can not possibly be legal.

XXXX XXXX XXXX, MD XXXX From : *name and address* NOTICE OF ERROR XXXX Re : Error Resolution Notice under 12 C.F.R. 1024.35 Mortgage Loan Number : **** I am writing to request correction of the error described below in regard to the mortgage on my property at *property address*. Enclosed is a copy of the response from you, M & T Bank, to the XX/XX/XXXX request for payoff figures, sent to third party, XX/XX/XXXX, with a copy received by me via USPS today, XX/XX/XXXX. Escrow Errors : On Pg. 3 of the enclosed document under the ESCROW section is stated as follows : According to our records, listed below are your next tax and/or insurance items to be paid : {$780.00} XX/XX/XXXX HUD-risk Based Ins Prem {$1100.00}XX/XX/XXXX XXXX County {$1.00} XXXX XXXX XXXX The HUD-risk Based Ins Prem item for {$780.00} is the error that needs to be corrected. The above outlined error is Force-Placed Insurance, which under the guidelines of Federal Law, you have no right to impart on this account. Under Federal Law, the servicer must reasonably believe that the borrower has failed to maintain insurance coverage on the home before purchasing a Force-Placed Insurance policy. Furthermore, under Federal Law, the servicer must send the first notice at least 45 days before purchasing a force-placed insurance policy. The servicer must then send a second noticea reminder noticeno earlier than 30 days after the first notice and at least 15 days before charging the borrower for force-placed insurance coverage. This notice must include the cost of the force-placed insurance or a reasonable estimate of the cost. ( 12 C.F.R. 1024.37 ). You have followed none of the above outlined Federal Law requirements for Force-Placed Insurance. The enclosed Response to theXX/XX/XXXX request for Payoff is the first document that states the cost of the Force-Placed Insurance. No previous notice with the cost or a reasonable estimate was provided prior to this Payoff letter, as is required by Federal Law. Insurance coverage on my property has remained the same for the past 14 years, renewing each year in XXXX, with a renewal Certificate of Insurance provided by my insurance agent via fax to the mortgage service provider at the time of renewal each year. There has been no lapse in coverage, non-payment, cancellation or expiration of coverage during the last 14 year period, leaving no reason for the lender to believe I as the borrow have failed to maintain insurance coverage before purchasing Force-Placed Insurance as stated by Federal Law. I have submitted evidence of coverage multiple times to M & T Bank over the last several months, using various methods of communication. The insurance agent has faxed a copy of the Certificate of Insurance multiple times, I have uploaded a copy on the website more times than I can count, and I have even mailed a copy via USPS. Due to the egregious violation of Federal Law with the Force-Placed Insurance applied to my account, I will be submitting a copy of this Notice of Error with a formal complaint to the Consumer Financial Protection Bureau ( CFPB ), and I do expect a response on this matter from M & T Bank. *************************************************************************************************** I would like to add that I am in the process of refinance with a new mortgage lender provider and that the payoff of the loan with M & T Bank will occur within the next few days. However, as this is an ongoing issue with M & T Bank over the course of many months, beginning in XX/XX/XXXX and continuing to the present, with threatening letters and the addition, and then the subsequent removal of Force-Placed Insurance on my account, I am requesting intervention. I have carried insurance on my property for the past 14 years since original purchase that has not lapsed, been cancelled, expired, or changed. Evidence of this coverage has been sent to the various lenders over the last 14 years, including M & T Bank. I have had two loans with M & T Bank, leading to a refinance of one M & T Bank loan to the current M & T Bank loan in XXXX. During the last 14 year period, covering the span of two loans with M & T Bank, there has never been an issue with insurance coverage, with either M & T Bank or any of the previous lenders. My new mortgage provider, XX/XX/XXXX, scheduled to close this week, has verified and confirmed my insurance coverage with no issue, which is the exact same insurance coverage that has been provided to M & T Bank time and time again over the course of the last few months. I have received several notices from M & T Bank stating that my insurance coverage has expired or been cancelled and threatening to add the Force-Placed Insurance if I do not provide evidence of coverage. These threats began only this year, XXXX, the first of which occured in XX/XX/XXXX, although there have been no changes to my insurance over the course of two loans with M & T Bank, the current loan dating back to XX/XX/XXXX. Each time, my insurance agent faxes the certificate of insurance, I upload a copy to the website provided in the letter, and I have even gone so far as to mail a physical copy. I then receive notification that the coverage has been accepted, and the Force-Placed Insurance will be removed. A few weeks later another threatening letter arrives stating the insurance has expired or been cancelled, and they cycle continues. Obviously, this is some pathetic employee at M & T Bank trying to justify their position during the Covid-19 pandemic, but I HAVE HAD ENOUGH. I became so frustrated with the never ending cycling of verifying insurance coverage, that I chose to refinance through a completely different lender and sever all ties with M & T Bank. My last communication from M & T Bank was in XX/XX/XXXX, another letter stating insurance has expired or been cancelled. I had just provided an updated copy of my XXXX in XX/XX/XXXX, as did my insurance agent, via multiple methods of communication, as the policy renews in XXXX each year. At this point, my insurance agent will not even fax another copy to M & T Bank as she has done so repeatedly and they do not stop requesting. She has stated the dates she has faxed the policy, and the renewal and will no longer entertain this nonsense, and I can not blame her for that. I uploaded copies to the website and put a copy in the mail and thought that would be the end of it, since I am refinancing with a new lender anyway. I then received the copy of the Payoff which was requested by XX/XX/XXXX on XX/XX/XXXX. My copy arrived via USPS on XX/XX/XXXX. On the Payoff letter is a charge for Force-Placed Insurance in the amount of {$780.00} to be charged from my Escrow account on XX/XX/XXXX. M & T Bank has violated several Federal Laws regarding Force-Placed Insurance with this Payoff statement, as outlined in the Notice of Error I sent to them. In addition to the countless times and various methods I have sent evidence of continued insurance coverage to M & T Bank, XX/XX/XXXX has also verified and confirmed the coverage in order to proceed with my refinance. There is NO QUESTION here as to my insurance coverage, and M & T Bank is completely out of line and in violation of Federal Law for adding the Force-Placed Insurance to my account. I fully expect my loan with M & T Bank to be paid in full by the new mortgage service provider,XX/XX/XXXX, before the charge listed on the Payoff statement can be processed on XX/XX/XXXX. However, as the charge would be paid from my Escrow account, of which the balance is to transfer to the new loan as funds for payment of property taxes, I am taking no chances with M & T Bank fraudulently withholding funds from my Escrow account to pay for Force-Placed Insurance that I do not require, and I am requesting a review of this matter with you, the Consumer Financial Protection Bureau. M & T Bank is a disgrace to the hard-working American consumer and should be punished accordingly for their flagrant disregard for Federal Law. Thank you for your time and attention to this matter.

The mortgage itself never had my name on it ( on the monthly statements ) and never reported on my credit score or personal income taxes. In XXXX my father was diagnosed with XXXX making him unemployable. My parents fell behind on their mortgage payments. Fast forward XX/XX/XXXX the bank using the initial loan application files a lawsuit against me. Now the mortgage that has not appeared in my credit score shows up and shows over 6 months overdue. My parents are about to now go into foreclosure and I am afraid it keeps getting me dragged into this financial liability I never shouldve been involved in. I never even had title on the house giving me no legal right to even remedy the situation. My parents are about to become homeless as I am the only surviving child that earns any income. Please help me fight this. This is a prime example of predatory lending. As someone who works in banking today, I can tell you with confidence this is not allowed today as predatory lending laws now prevent this but doesnt work retroactively even thou the loan started in XXXX. While my family struggle to potentially fall into severe financial crisis, banks are allowed to continue to practice remedies afforded to them. How this is not a financial crime?

Consumer Complaint: I signed paperwork from XXXX XXXX at m & t bank about changing my portfolio to lower my interest rate on XX/XX/2020. I signed everything that I was supposed to as I read about lower interest rates and was told a refinance wouldn't make sense as I didn't have anything to put with it but a change of portfolio would be better. The paperwork I signed had the effective date of XX/XX/2020 I have contacted the bank multiple times about being overcharged they stole money from me, as I have automatic payments for my mortgage coming out bi-weekly. They then sent me another set of paper work contradicting the previous paper work I signed having a higher interest rate and payment amount with effective date of XX/XX/2020 I contacted the bank and have been getting the run around. I have never missed a payment or been late in the XXXX I've had a mortgage I'm actually 4yrs ahead on my XXXX mortgage. XXXX XXXX threw her hands in the air when I called and complained about still being overcharged saying not her problem it's the mortgage department 's problem. In the meantime I've been overcharged twice and will probably be overcharged again on XX/XX/2020 I have spent hours on the phone with them, emailing them, and even going to the bank wasting my time, gas, money. Now they are saying if they are wrong there going to apply the extra money they stole from me and apply it to the principal of that loan like it's their money to decide how to spend it? I never gave them permission to take more then the actual payment and because they decided to steal from me it cost me some interest aswell on that account. I have all the paperwork and proof of this, I even took the contradicting paperwork to the branch and I spoke with XXXX who said she doesn't understand why they would do that and would look into what XXXX XXXX is doing. I'm still being overcharged which is illegal per cfpb and, fdcpa which I informed them I have to know these laws for my job aswell as others. I have been made to feel like I'm making this up and it never happened when I have the proof. I've been made to feel like I'm lying, and it's ok for the bank to steal from me. I put my money in the bank to keep it safe and the company that's supposed to protect my money is stealing. They only have wanted to argue with me when I call and speak with the mortgage department, the only people that have been helpful is XXXX and XXXX at the m & t branch in arcade who have said this isn't right and they have to get it up to higher people to fix this. However when the higher up people have contacted me via phone they say they haven't done anything wrong and are doing nothing to fix the problem.
