XXXX XXXXXXXX XXXX XXXX Upon return of my vehicle, a customer service rep at GM Financial informed me to wait until adjustments were made on my final bill, as the dealership that accepted my return did not make note of the correct condition of the vehicle. While waiting for these adjustments to be made, GM reported my payment as late. After speaking to customer service, the rep on the phone told me that GM would contact the credit reporting agencies to modify my payment history to show that my payment was not late. On XXXX XXXX I sent GM FINANCIAL a VLIDATION OF DEBT letter. On XX/XX/2021 I received a letter stating that I signed a credit contract with them, which the copy of the contract was attached which shows I did a consumer credit transaction with XXXX XXXX XXXX not GM FINANCIAL .also attached was a copy of the account payment history showing that they been collecting your debt.which shows me that your company assigned GM FINANCIAL MY contract to collect your debt without my consent which is Identity theft and that is FRAUD. Pursuant to the FEDERAL TRUTH IN LENDING a contract can not be credit or cash, because credit covers all Obligations.also the finance charge is the sun total of all charges which includes insurance. Pursuant to 18 USC 8 the term obligation or other security of the United States includes all bonds and certificates of indebtedness.

A finance charge is the sum of all charges in a consumer credit transaction, and it does not include cash. GM Financial in fact took a {$1500.00} cash payment as shown in Exhibit C. GM Financial willfully and knowingly failed to provide/disclose information required under 15 U.S. Code 1601. GM Financial is now civilly and criminally liable.

Consumer Complaint: GM Financial was given a copy of the attached Police report, my drivers license etc. along with a request to investigate and remove the inquiries that were created by them on all 3 bureaus from some one attempting to purchase a car in my name. I have a fraud alert on my bureau and thankfully no car was purchased. However, this company shopped my info all over the place resulting in a dramatic drop in my XXXX score from too many inquires. I have asked them to remove them. They send me the generic response back they were shopping credit for me. No they weren't I have told them I was never at XXXX XXXX XXXX, never applied for credit etc. So, they are not willing to accept this and remove these inquires. I had 84 inquiries between the 3 bureaus in a 2 day period. XXXX!!!!!

( I have the letter attached ) I did not open this account and I did not receive any goods or services from this company. My identity was stolen back in XXXX and this account is a result of identity theft. I sent a Identity theft report, and also a written statement informing all credit reporting agencies that this account was not mines and was a result of identity theft. I also provided appropriate proof of my identity. Pursuant to 15 USC 1681 ( c ) ( a ) a consumer reporting agency SHALL promptly notify the furnisher of information that it was a result of identity theft and shall block the information not later than 4 business days after date of receipt. I have attached proof showing that XXXX received all of the appropriate documents but they are still is reporting this information on my consumer report.

Consumer Complaint: I contacted XXXX XXXX to make the XXXX XXXX XXXX aware of the fraudulent issues with his sales representatives. On XX/XX/XXXX, I applied to GM for vehicle approval. I received a pre-Qual decision ( See attached ). I then received a call from XXXX, then XXXX, then XXXX ( XXXX XXXX ). I provided XXXX with the Stock number ID : XXXX the vehicle I sought ( See attachment ), I informed XXXX that I was looking to replace my current XXXX XXXX Envision that was purchased in XXXX due to the dealership Fraud, transmission issues, waiting on parts for light, and other issues presenting with the vehicle. Shortly afterward, XXXX sent me several text messages regarding the vehicle 's trade-in and pay-off ( See attachment ). Then XXXX called and stated that he was from GM and that I had a fraud alert on my credit file. I became frustrated with XXXX, and the calls were coming back to back while I was at work. I never applied for other funding sources besides GM. Therefore I should not have received various credit inquiries stating otherwise from XXXX, XXXX, XXXX, and GM. I never authorized anyone to pull my credit other than GM ; therefore, please provide me a signed application that I completed electronically, with the IP address. If NOT, THEN I PRAY THAT THE INFORMATION OBTAINED BE REMOVED IMMEDIATELY AND CREDIT INQUIRIES REMOVED WITHIN 24 HOURS before I FILE ANOTHER COMPLAINT about the DEALERSHIP FRAUD with the FTC and CFPB. Furthermore, the vehicle price online and the quoted price were completely different in numbers, another part of dealership auto fraud.
