Consumer Complaint: Hello, I am writing regarding an old item that is reporting on my credit report. It is with GM Financial, in todays environment the auto industry is sparse in selection along with inflation stock shortages it is almost impossible to get a reasonable price or loan. Having items on my report that are working against me is creating unhealthy stress. I understand that information may be reporting correctly, but quite honestly this is a jail sentence. I am in credit jail! XXXX has made matters much worse and I am handcuffed when I could be reasonably providing for my XXXX kids. I am requesting that at the discretion of GM Financial that they choose to no longer report to the XXXX credit reporting agencies and remove any existing information from my report. It is with great appreciation that I ask this. This account is so old and I understand the law but I also understand that GM DOES have the option to opt out of continuing to report.

Consumer Complaint: I filed a previous complaint regarding GM Financial regarding GAP insurance that I was told that I had to purchase in order to drive off the sales lot of XXXX XXXX of XXXX and I'm a XXXX veteran with low income and felt taken advantage of. I requested the Gap fees to be applied to the principal and GM decided to send it to the payment instead. When I spoke with the Assistant Manager, I was told that it would be and since I set the payments up on bill payer, I believed GM Financial at their word. Now I'm finding out they didn't honor my request. I truly feel completely taken advantage of by this company and they knew that I am XXXX, just as XXXX XXXX.

Consumer Complaint: I have a loan with GM FINANCIAL. I have always made my payments on time yet the item has been repossessed. Another thing, this was an illegal repossession followed by illegally reporting on my credit report ; this should have been investigated and corrected immediately. I tried contacting XXXX, XXXX, and XXXX Credit Bureaus requesting a complete payment history with this account for me to review the exact date on which the late payments and repossession were posted. Unfortunately, there was no successful resolution provided nor feedback heard from the concerned Bureaus. There was definitely an error on their part. There was definitely an error on their part. The bureaus are condoning illegal behavior and willfully in violation of FCRA. PLEASE REMOVE IT FROM MY REPORT IMMEDIATELY.

Consumer Complaint: GM Financial is not letting me exercise my federally protected rights. I sent GM a Right to RESCIND letter that they received XX/XX/XXXX, XXXX XXXX signed for it. They have 20 days to respond and send my refund back pursuant to 15 USC 1635 ( b ) and 12 CFR 226.15. They have yet to respond. I called multiple times last week XXXX or XXXX and XXXX the rep told me to give a manager time to look over the document and call back XXXX instead I waited and called XXXX. And they keep sending me to different departments and telling me a supervisor will call me back but haven't called back. I called today XX/XX/22 spoke with XXXX id # XXXX and also XXXX id # XXXX they told me a lead notated the account saying he not dealing with legal matters when this is a letter from me the consumer stating I want to rescind my contract which I have those rights within 3 years because my contract from GM violates XXXX with the no cooling off period and, I have a right to rescind and they failed to disclose that. Once they transferred me to the recovery department I asked for an supervisor again the guy who name I don't have put me on hold for about 10 mins came and said supervisors are not available. The CFPB also has a table of content with the consumers right to rescind stating that a consumer can exercise there rights to rescind as long as you notify the creditor and is in the 3 year period and I have done both. The letter states clearly I'm exercising my rights to rescind.

GM FINANCIAL illegally repossessed vehicle GM FINANCIAL inaccurately furnished to the credit Bureau a deficiency balance of {$19000.00}. GM FINANCIAL reported this on or around XX/XX/XXXX GM FINANCIAL States my last alleged payment was on XX/XX/XXXX GM FINANCIAL inaccurately and erroneously reported this account as Charge-off, then closed the account. Even if my last alleged payment was made in XX/XX/XXXX this now would exceed the statue of limitations ( for legal purposes ) GM FINANCIAL financial is now attempting to change this last alleged payment date and attempting to extend the statue of limitations & violate the Fair Credit Reporting Act. GM FINANCIAL is continually reporting inaccurate statement of balance due and/owed. XXXX ( CRA - CREDIT REPORTING AGENCY ) is now enabling this inaccurate reporting by failing to correct it and allowing inaccurate erroneous information to be displayed and reported on my Credit Report 1681s2. Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if- ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. ( C ) No address requirement A person who clearly and conspicuously specifies to the consumer an address for notices referred to in subparagraph ( B ) shall not be subject to subparagraph ( A ) ; however, nothing in subparagraph ( B ) shall require a person to specify such an address. ( D ) Definition For purposes of subparagraph ( A ), the term " reasonable cause to believe that the information is inaccurate '' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of the information. Duty to Provide CRAs with Accurate Information Prohibition on Reporting Inaccurate Information. Section 623 ( a ) of the FCRA generally prohibits a person from furnishing inaccurate information to a CRA. The standards for the prohibition differ, depending on whether the person specifies an address for receipt of notices from consumers concerning inaccurate information. If the person specifies such an address, it may not furnish information relating to a consumer to any CRA, if ( a ) the consumer notified the person, at the specified address, that the information is inaccurate, and ( b ) the information is, in fact, inaccurate. Duty to Provide Dates of Delinquency. When an account is placed for collection, is charged to profit or loss, or a similar action is taken, and that delinquency is furnished to a CRA, the furnisher must notify the CRA of the date of delinquency on the account no later than 90 days after furnishing the information. This date is the month and year the account first becomes delinquent, not when the creditor places the account for collections, charges the account to profit or loss, or takes a similar action. Duty to Implement Reasonable Policies and Procedures Regulation V requires furnishers to establish and implement reasonable written policies and procedures regarding the accuracy and integrity of the consumer information furnished to CRAs. Accuracy means that the information the furnisher provides to a CRA correctly : Identifies the appropriate consumer ; Reflects the accounts terms and liability ; and Reflects the consumers performance with respect to the account.34 Integrity means the information the furnisher provides to a CRA : Is substantiated by the furnishers records at the time it is furnished ; Is in a form designed to minimize the likelihood that the information may be incorrectly reflected in a consumer report ; Includes the information in the furnishers possession regarding the credit limit, if applicable ; and Includes any other information in the furnishers possession that the Bureau has determined the absence of which would likely be materially misleading in evaluating a consumers creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living. Consumer Complaint: On XX/XX/XXXX we went to the local XXXX dealership and looked at a new vehicle. On XX/XX/XXXX the dealer started the process for us to get financing. They go through GM Financial. On XX/XX/XXXX we purchased the vehicle and signed all of the loan documents for financing through GM Financial. On XX/XX/XXXX I refinanced my vehicle loan with another financial institution and GM Financial received my payoff as of XX/XX/XXXX. On XX/XX/XXXX my husband and I each received a denial letter for our application of credit from GM Financial. The letter was dated XX/XX/XXXX. The denial was in regards to the application from the local dealership and the credit score information was from XX/XX/XXXX. On XX/XX/XXXX my husband contacted GM Financial and after some back and forth was told that the letter was a mistake but then was cut off. On XX/XX/XXXX I attempted to contact GM Financial inquiring for the specific reasons for the denial. I waited on hold for 10 minutes and then eventually attempted the text option to inquire for my statement of reasons for the denial. After a half hour I was told I would be sent a Statement of Specific Reasons letter. My issue is we received a denial letter more than 30 days after a credit decision was to have been made and we weren't really denied, we got the loan.
