Consumer Complaint: It has come to my attention that GM Financial has denied myself and my husband credit. I, the NATURAL PERSON, creditor, and Applicant, am aware of the letter that was suppose to be sent to us which is an adverse action pursuant to 15 USC 1691 ( c ) ( d ) within 30 days after receipt of a completed application for credit, a creditor shall notify the applicant of its action on the application. We have never received any letters from GM Financial with an actual adverse action, we have only been told through the telephone and the dealership of their denial. Pursuant to 15 USC 1691 ( a ) ( 3 ) It shall be unlawful for any creditor to discriminate against any aspect of a credit transaction, because the applicant has in good faith exercised any right under this chapter. As the Original creditor, we initiated a consumer credit transaction, using my credit card ( SSN ) pursuant to 15 USC 1602 ( L ) the term " credit card '' means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit making GM Financial an assignee pursuant to 15 USC 1691 ( e ). However, we DID NOT receive any benefit from that transaction, but it had a negative impact on our consumer report, proving the transaction did in fact go through. Lastly, Congress states " No Credit card shall be issued except in response to a request or application thereof '' pursuant to 15 USC 1642. I have given several attempts to resolve this issue with GM Financial and they stated that the file had been sent back to the dealership for them to resubmit, however, nothing has been done.

Consumer Complaint: I received a copy of my credit report today and discovered an alleged hard inquiry, I do not recall authorizing any inquiries and I would like to see the application of credit. Under the Fair Credit Reporting Act, no one may access my credit without my permission for the purpose of extending credit. U.S. Code, 15 U.S.C. {XXXX} et seq. Section 604 states that all users must have a permissible purpose under the Fair Credit Reporting Act to obtain a consumer report. Understand that I contest the reporting of the above noted inquiries and challenge for the demonstration of the confirm= physically verifiable proof of a validly acquired lawful permissible purpose, concerning an exactly identified consumer who is/was factually identified as being me and only me. Please provide proof of permissible purpose by furnishing to n5 & 39 documentation of credit application with proof of signature showing that I indeed applied for credit with this company, else wise delete the alleged inquiries immediately.

Consumer Complaint: This account was an unauthorized account, I have sent letters to the company stating that the account was not mine. I demanded proof of my signature for the alleged agreement and the company did not respond to me. I sent 5 letter since 2018 to the compant. There are laws stating that the company can not demand money of payment from me when account is unathorized. Consumer Complaint: I enrolled in autopay with GM Financial for our leased vehicle loan. I was " kicked out '' of autopay 3 times without my consent. Each time I realized I was " kicked out '', I reenrolled immediately. My account was marked late 3 times and late fees assessed. It has affected my credit score significantly. I have a new GM Financial lease now and it is proving to do the same thing. I think they either have a faulty system OR they are purposefully trying to collect late fees.

Consumer Complaint: I found out midway through the loan that it was interest only. After paying 4 years in and still not having any amounts reduce the financed amount. I was told and encouraged to go through the company 's rewrite service which would reduce monthly amount. I was told I needed to pay up 25 payments in order to qualify. Which I did in XXXX. I was supposed to have entered the rewrite process but it did not happen. At the time I was told bc I wasn't current. So I paid the bill current in a lump sum amount and again for the 2nd time in XXXX, the rewrite did not happen. The reason, bc the request was never put in and another bill had become due. At this juncture, I began falling behind again. My most recent request, XX/XX/XXXX, I was able to save up and pay another lump sum ( {$1700.00} ). Was told the process would take 14 days. When I went in to pay my XXXX bill, the rewrite again did not happen. This time stating I failed to call back and request. Each time I make the lump sum, I have confirmed the request for rewrite. Which is the reason I have paid the lump sum. I called back to confirm my payment but again, the company has failed to process and charged fees, to which will cause me to fall behind again. It is starting to appear fraudulent. The many requests for extra money, piling on of fees, and failures to process requests as discussed. They have managed to gauge over {$30000.00} for a car with barely {$19000.00}. And we still owe {$13000.00}. They are a complete fraud!!!!!

Consumer Complaint: I turned in an auto lease in late XXXX. In XXXX I was contacted by phone by GM Financial stating I owed approximately {$420.00} as part of the disposition fee. I was surprised because at no time in over a year after I turned it in, did I receive any correspondence informing me that the account was still open and that I owed this fee. However I was offered an arrangement to pay half to close the account. I did, payment was sent and received. I have the letter from GM Financial and cancelled check for {$210.00}, the agreed upon amount to pay. Having thought the account was closed. I was surprised to receive calls again at work several months later stating that I still owed money. After explaining the agreed upon settlement previously paid, I usually received acknowledgement from the caller that the settlement info was found in my file and they apologized usually saying they would add that to my notes. I had not received any calls for a while until sometime during the week of XXXX XX/XX/XXXX, I received another call at work. After the same discussion, the caller said they would talk to their supervisor and get back to me. I was never contacted again before I began getting several notices through my credit monitoring services I had derogatory remarks and charge offs added to my credit report from GM Financia for {$210.00}, the amount they said they would waive in XXXX. I want to stress that at no time did I receive any written correspondence or bills, with the exception of the letter stating the agreement to pay half the amount in XXXX. I have always had excellent credit but these remarks and claims of unpaid debt- which are unsubstantiated- have significantly and negatively affected my credit score. When contacted, GM Financial said my account was in the process of being closed and to be patient. However, I feel like their way for closing my account was to charge off the other half they said they would waive, which is dropping my credit rating from 'excellent ' to 'good '.

Consumer Complaint: I leased a XXXX XXXX XXXX XXXX for 3 years with financing through GM Financial ( account # XXXX ). The lease was fully pre-paid by me in the amount of {$20000.00}. Before the end of the lease GM issued a recall on the vehicle due to battery fires, and the fix for the defect ( vehicle battery replacement ) was not available at the time my lease term was about to end ( XX/XX/XXXX ). So, instead of buying the car out at the end of the lease, as initially planned, I returned it 2+ months early ( in XXXX of XXXX ), not using the final two months of the lease payments to the tune of {$1100.00}. I requested in XXXX of XXXX that GM financial wave the {$420.00} lease termination fee ( see attached document ) since the vehicle was unsafe, but to this day they did not respond to my letter, instead willfully and maliciously reporting me to several credit rating agencies as a delinquent lessee.
