Issue: Managing the loan or lease
Subissue: Problem with fees charged
Consumer Complaint: I leased a XXXX XXXX from GM Financial made all payments on time and return truck on maturity date, Due to pandemic I had to purchase vehicle from out of state and dealership i purchased from drove new vehicle to my place of employment and drove my lease return back on XX/XX/XXXX. Approx. 2 months after lease I began to receive harassing phone calls from GM Financial stating i owned money for damage to vehicle that was not on vehicle when dealership picked up and inspected. When returned vehicle there was now damage anywhere and I had just installed 4 brand new tires and had vehicle detailed to ensure there would not be a problem. I asked them repeatedly to send me copy of report as I had pictures to show vehicle condition when dropped off. I also asked them why it took months for them to inspect and sell vehicle and what was price of sale of vehicle at auction as I am certain it was over residual value. GM never send bill but continued to rob call me at my employers number even though asked not to be contacted on that number on at least 5 occasions. Now I just received an alert on my credit that GM has submitted account to collections without sending me documents requested as I was disputing charges as they were fraudulently or may have occurred in the two months it took them to inspect vehicle in dealers possession. Their was also mileage charges that were approx. XXXX miles higher than when dealership took my lease back so evidentially either dealership or GM drove the vehicle somewhere.

Issue: Struggling to pay your loan
Subissue: Lender trying to repossess or disable the vehicle
Consumer Complaint: Hello, I made my payment on my car on XX/XX/XXXX at 60 days past due at XXXX. They wrongfully repossessed my car XX/XX/XXXX at XXXX. Normally if a customer pays and its out for repo, the repo is placed on hold, and if they had a payment cut off time, Id imagine it would be close to towards the end of their business day not close to lunch hours. I did not receive any letter in the mail regarding status of account. They have all of my contact information.I am 30 days past due as of today.

Consumer Complaint: After my lease contract with General Motors I returned the car on time and fulfilled my payment. I was reported about a late payment that I was not aware of nor was I informed. I actually leased another from the same lender ( General Motors ) soon after my first lease was over. I called General motors about this and was told they will fix this unfortunately it is still showing a 120 day delinquent on my credit report.

Subissue: Confusing or misleading advertising or marketing
Consumer Complaint: Yesterday XX/XX/22 I walked into XXXX car dealership ( XXXX, Nc ) for a consumer credit transaction. After choosing the vehicle for me and my family I extended my credit to said dealer and they ran my SSN ( creditcard ) First they approved me contingent upon a down payment. 15 usc 1605 states there should not be any cash involved. After I mentioned that, said company then tried bringing down to a cheaper car. I said I need to speak to the person whom ran my credit so that I may explain that I AM THE CONSUMER AND ORIGINAL CREDITOR PROTECTED BY FEDERAL LAW! They wouldnt allow me to speak with them. They said they only speak with dealer which is deceptive and misleading considering it is an account that I the original person and consumer originated when I extended my credit. I tried calling the number on the inquiry of my consumer report but number was out of service and also the name was different than the general manager gave me. This is deceptive and misleading. So now ( Ally financial ) denied me the loan for my families vehicle but has opened an installment loan or bank account ( per my consumer report ) and has acces to my open ended credit account with out my consent which according to the FCRA is IDENTITY THEFT. I am not seeking anything unusual I just want my consumer credit transaction 100 % financed with zero fed notes or XXXX down for my families vehicle. I tried submitting complaint to company 4 times and it didnt go through. IAM AWARE THAT I AM THE ORIGINAL PERSON, AM THE CONSUMER AND ORIGINAL CREDITOR AND I AM PROTECTED BY FEDERAL LAW. I will continue to pursue legal action if need be

Issue: Getting a loan or lease
Subissue: Fraudulent loan
Consumer Complaint: I was originally requested by my former partner, XXXX XXXX, to be a co-sign for a loan on a used XXXX XXXXXXXX XXXX XXXXXXXX XXXX from XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, GA XXXX. I never went to the dealership, the deal was made between XXXX XXXX and the salesman, XXXX XXXX ( still employed there ). XXXX XXXX knew the truck was for XXXX XXXX and I was, in no way, going to be in possession or driving the vehicle. Mid-way through their dealings, I received a phone call, requesting my ID information for credit check and told it would be " better '' if the truck were in my name, solely. I advised I was requested to be a cosign on the loan, and that was my intention. A few hours later, XXXX XXXX and XXXX XXXX returned to my home ( in a different county ) with purchase paperwork, asking for my signature on all documents. XXXX XXXX was already in possession of the vehicle. The sale was complete as vehicle sale to me, solely. The financing was completed through GM Financial, and represented as a purchase by me and that the vehicle would be in my possession. XXXX XXXX had been making the payments on the truck up until about 30 days ago He has since refused to continue making payments. He is also blocking my attempts to recover the vehicle. However, as I have researched avenues to address this matter, it has been brought to my attention that this was a " straw purchase ''. The sale was fraudulently made by the dealership, knowing I was not to be the owner or driver of the vehicle. It was further misrepresented to GM Financial, who did not do their due diligence, either. Last, but not least, the sale was completed off-site from the dealership, at my residence, which was in a different county than the dealership was located.
