Consumer Complaint: On XX/XX/2022, I sent a notice to rescind letter to GM Financial for their alleged debt. I applied for a new XXXX from XXXX XXXX to be used for personal, family, and household purposes. Once the consumer credit transaction was complete, I received statements from GM Financial. Both the dealership and GM Financial had a fiduciary responsibility to provide me with my vehicle but they instead used deceptive practices to extort money from me pursuant to 18 USC 892. After some research and investigation, I discovered that GM Financial used my consumer credit information, obtained from another party as I did not provide the information to them, to create asset accounts in which they benefited in the form of monetary advances from my consumer credit pursuant to 17 CFR 229.1101 ( c ) ( 1 ). In my notice, I requested documentary evidence pursuant to 15 USC 44 along with reasonable compensation for their criminal behavior, but they never responded. I attached the proof of mailing, notice to rescind, and affidavit sent to them on XX/XX/2022, for your review.

I requested documentary evidence to ensure I am obligated to pay this alleged debt. Pursuant to 15 U.S.C. 1692c ( c ) ( 2 ), I invoked specified remedy and demanded the following : A copy of the contracting binding both parties consumer and GM Financial in a letter by certified mail so that there is an independent witness to it having be delivered Verification of GM Financial claim against consumer that will be a signed invoiced Validation of the alleged debt and that will be the actual accounting as it relates to o Book of account ( GAAP ) related to consumer credit transaction and the account which will include the ledger of both sides. o Financial and corporate records that would substantiate this allege claim of {$13000.00}. o Any other lawful or verifiable proof of claim money for loan originated from GM Financial XXXX bank account or stock Any XXXX filing and or statement including any addendums Consumer received a formal notification that GM Financial was in contact of their reference to account XXXX. From the requested information above, GM Financial stated this account may have been fraudulently established as a result of identity theft. I was seeking to validate debt. Pursuant to USC 1692g I asked the office to provide proper document as requested. GM Financial was advised to cease and desist all collection and communication activity unless you notify me this debt has been zeroed out and reported paid as agreed to all credit reporting agencies and the company is no longer collecting on the alleged debt

Consumer Complaint: At the end of my lease I purchased my vehicle by sending in proper documentation and a bank check. When I received title and bill of sale for vehicle the mileage had an extra 0 at the end taking my my from aprox 42,000 miles to 420,000 miles. This created an issue in titling the vehicle in my name because I am not able to correct the title according to Massachusetts RMV. Because the mileage is written on the bill of sale and title an affidavit for correction must be supplied from ACAR leasing along with an updated bill of sale. I called ACAR leasing ( aka GM Financial ) to request this on XX/XX/2022. To follow up I also mailed a request with copies of the documents they sent me plus I added the lease buy out forms again double checking mileage was correct and even included a affidavit for correction filled out but needed their signature. Over a month later I am yet to receive any documents from them so I can register my vehicle. When speaking with their customer service they insist they've mailed it on XX/XX/XXXX which would have arrived already. This is the second vehicle I've purchased at the end of a lease in which it takes them over 2 months each time to get the proper documentation.

Consumer Complaint: On XX/XX/XXXX a final payment in the amount of {$29000.00} was made and applied to my GM Financial account to payoff the loan for my XXXX XXXX XXXX XXXX. To date GM financial has failed to update my credit report showing the loan as paid in full and the account closed despite multiple phone calls and messages requesting they update the reporting. Each time I am told they will update the reporting and it will take 30 days. I wait the 30 days and the reporting does not change. The account still shows the balance, and there has been no updates to the entry since XX/XX/XXXX. The GM financial website shows that the account is closed and paid in full. The customer service team has also confirmed it is paid in full and closed. This has caused my debt to income ratio to be inaccurately skewed which cost me to have a higher interest rate on my new mortgage and has also impacted my ability to finance a vehicle as the banks think this account is still open and active.

Consumer Complaint: Purusuant 7 CFR 1782.3 A Charge-off is a write off of a debt and termination of servicing activity without release of liability. A charge-off is a decision by the Agency to remove debt from Agency receivables , however, future payments may be received. According to federal law there is no such thing as an open charge off. GM Financial states that I have an open charge off hence why they reported a charge off to my consumer report. This is in fact, false misleading information and is affecting my credit worthiness. Also, according to the IRS Publication 4681 a charge off is income which the credit reporting agencies shouldn't be reporting income to my consumer reports. I have yet to receive a 1099c for the charge off and GM Financial keeps giving the run around with deceptive and misleading information.

I contacted the lender previous and asked about options to keep the account in good standings and they wouldn't offer me ANY help.. I went to the dealership and advised that this would be a Consumer Credit Transaction per 15 U.S.C. 1679 ( a ) Which states " ANY transaction in which credit is offered or extended to and individual for personal, family, or household purposes '' I Let the rep know I did not mind extending my credit to secure and instrument via text we set up an appointment for XX/XX/XXXX at XXXX They ran my credit and I was denied. I informed the finance manager that according to 15 U.S.C 1681 ( B ) a consumer can not be denied and extension of their own credit. I called the banks that I was told denied me which was XXXX XXXXl, GM Financial and XXXX XXXX. I was told XXXX XXXXXXXX is an XXXX and federal Law does not apply to XXXX. And the other two banks sent me in a runaround, hung-up on and was rude. From my understanding when you put in an application that's what pays for the car because it is a Process, which technically is considered a cash proceed. I advised that multiple people that my federal rights was being violated and everyone ignored me and didn't even bother to look up the code. From my understanding Per 15 U S.C. 1611 criminal liability for willful and knowing violation because this information is public information it is not my fault they do not know this. Also advised that per 15 U.S.C 1679 ( a ) when " when used in connection with information on ANY consumer means all information on that consumer recorded and retained by a consumer reporting agency regardless of how the Information Is stored. I am seeking remedy for this unfortunate situation, Once again I am a consumer and I went to extend my credit which they offered me to extend by asked if I needed a vehicle and offered a test drive that I never got via text message. And they still denied me. Per 15 U S.C 1601 Congress finds that economic stability would be enhanced and the competition among the various financial institutions and other fines engage in the extension of consumer credit would be strengthened by the informed use of credit.
