Consumer Complaint: This complaint is to formally advise that GM Financial has violated several of my consumer rights. Specifically, GM financial has failed to validate a debt at my request, which is a violation to the FDCPA 15 USC 1692g - Validation of debts. I requested this information on XXXX XXXX, 2022 ( XXXX XXXX # XXXX ) when I sent a validation request to GM Financial. GM Financial responded with a letter asking me to call them, even though I stated I would like to communicate only by mail. Also, according to the FCRA, GM Financial has committed a violation to 15 USC 1681a ( 2 ) Exclusions ( i ) which clearly states " report containing information solely as to transactions or experiences between the consumer and the person making the report '' and I've never given this " person '' my authorization to share any transactions or experiences. That is only one violation according to the FCRA that is being committed, there are several. Another is 15 USC 1681 under ( a ) Accuracy and fairness of credit reporting. Not only is this account being reported without my permission, it also has incorrect information. For one, it says it's in collections but has a balance. Another inaccuracy is, every month GM Financial reports a new charge off and late payment on a closed account, all while GM Financial continued to report a disputed debt to the Credit Reporting Agencies. These violations are damaging my reputation and have prevented me from three very good deals on investment vehicles. Not only has GM Financial committed FDCPA and FCRA violations, but they are just violating all my consumer rights. According to 15 USC 6802 - Obligations with respect to disclosures of personal information in paragraph ( b ) a financial institution may not disclose nonpublic personal information to non affiliated third party unless ; ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I was not given any of these options to opt out nor were any of my options explained clearly to me. Not only has GM Financial ignored my prior requests for validation of debt but GM Financial continues to report this debt to the credit reporting agencies causing damage to my character. Should GM Financial again ignore my rights and continue to bring harm and damage to my character I reserve the right to sue your company for violations of my consumer rights as specified under both the FDCPA and the FCRA. Consumer Complaint: Hello my due date was changed this account was never late after multiple disputes GM refuses to fix this mistake in addition there was a winter storm we lost power and internet for 2 weeks. As you can tell I have XXXX late payments and nothing derogatory on my credit report aside from this GM mistake they refuse to remove the lease was even paid off 6 months in advance kindly assist me with making GM do the ethical correct thing in regards to this issue .I appreciate your help I sent all the supporting documents to the 3 credit agencies only one removed it. Consumer Complaint: A letter was sent XX/XX/2022 to GM Financial informing them they are furnishing inaccurate an incorrect information to the consumer reporting agencies and that the reporting of the inaccurate information has caused severe damage to my character, my reputation, my general mode of living and my ability to obtain credit for personal and house purposes, and the reporting of this inaccurate information have damaged my livelihood. The IRS clearly defines a charge off as Gross or Ordinary income. Income does not get reported on the consumer report which in fact makes the reporting of the information to my account inaccurate! By Definition The IRS Clearly says a Cancelled debt or Charge off is Income. The reporting this account as a debt is inaccurate.

Consumer Complaint: Hello, my name is XXXX, and I'm writing to ask for your assistance in contacting this company. I attempted to get in touch with them to inquire about the circumstances behind the creation of a new account in my name. It is unfortunate that this issue is now harming my credit record since it is a really severe subject. I feel terrible about it. I do not give anybody permission to use my name, date of birth, or any other information about me since doing so violates both data privacy and the law. They have to determine who really started the account in my name and then provide those details to that individual rather than transferring them to me. Could you perhaps assist me in finding a solution to this?

Consumer Complaint: When I had not received the new tags for my XXXX in XXXX, I made an appointment with the Secretary of state to find out why. The soonest appointment was XXXX XXXX. They said that because my husband and died I needed to get the title in my name or the paperwork that gave me the right to get tags for the vehicle. I called GM Financial and asked them what I needed to do to make this happen. They informed me to fax them a note stating what I was attaching ( see Transaction verification report ), his last will and testimony making me his sole beneficiary ( see Last will and testament of XXXX XXXX XXXX ), his death certificate ( see attached ), the certificate of insurance ( see attached ) and I would get the paperwork in 3 weeks. When I did not receive the paperwork in 3 weeks, I called to find out why. They informed me that the death certificate was not readable. I asked why no one had contacted me about this during the 3 week period and no answer was provided. They told me to refax the death certificate and it would be processed within 48 hours. I then refaxed the death certificate and also e-mailed it as a pdf. I contacted them 48 hours after sending the death certificate and they said that it was readable. When once again I did not receive the documents, I called to find out why and they said that if was because the loan was not paid off. I reminded them on one of the earlier calls I was told that they could not change the name on the title if I paid it off. I asked for the balance and it was {$240.00}. Since the monthly payment was over {$360.00} I told them to just take the money for the autopay account. They said there was a fee and I said fine. They told me I would have the title within 3 weeks. I waited the 3 weeks and still no title. I called yesterday to find out why and they said that it was because the transaction had been rejected twice. I knew that it couldnt have been rejected since my account always has thousands of dollars in it. I asked to speak to a manager and they said that none was available and they would just tell me the same thing. They said the issue was not on their end and my bank had probably rejected it because it was not in the {$360.00} amount. I went to my local bank and spoke with the bank manager. He said they did not have a record of any transactions being denied. We called GM Financial and they said that they couldnt explain it. Then the bank manager asked how I could pay. They said by debit card. When I gave them my debit card number they said it was invalid even though when the bank manager pulled it up on his screen it was fine. Once more no explanation. Then the manager asked if I could use my credit card and of course they do not accept credit cards. They had advised me on the prior call that my bank could wire the money to them and when we told them that we needed the routing number to wire it to them they said they do not know the routing number. Finally, they said I could do a bill pay would be processed in 24-48 hours and then I would get the title in 15-17 business days. I wired it yesterday and now it will be early XXXX before I receive the title and can get the tags that I have not been able to get for the car since XXXX. Any resolution will be greatly appreciated.
