Consumer Complaint: This company has infringed on my right to privacy, I have never given this company any right to have my personal information. This company is trying to collect on an alleged debt. This company reported unverified inaccurate information to the consumer reporting agencies, which has greatly harmed my ability to offer or extend my credit to other financial institutions. This is against federal laws. This account is not mine and was opened using my personal identification without my consent. When any furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher may not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ). Ive also never given this company permission to contact me which according to the FCRA is also against federal laws. I have asked numerous times for this company to stop furnishing false information to the CRAs and also for them to stop contacting me. My next step will be to file suit. This is my last time asking to please remove this account, its not mine.

Consumer Complaint: On the XXXX of XXXX, my wife and I decided to purchase our lease from GM Financial. We went through our bank to make the purchase. A check was mailed to GM Financial with paperwork requesting for the title and XXXX XXXX XXXX to be assigned to our bank. However that is not the way things went. Unfortunately things did not go as planned on the part of GM Financial. The mailed everything to the wrong address, not to the bank nor to us! We have leased 3 vehicle going through this establishment, and I'm not sure a 4th will happen after this! We were given 60 days until our 1st payment would be due, which is now coming up fast. I have requested for some type of compensation considering the improper handling of everything, and I was told they will do NOTHING. They have now requested for a duplicated title, to which they informed me will take about 45 days. Then they can over night it to us, but hey should be sending everything to the bank that requested for the original paperwork. When we were not able to find another vehicle for less then XXXX over MSRP, so we thought to extend the lease. They did not give us any credit towards the residual for any of the 3 payments we made totaling ( {$1000.00} ). When I asked why we are not receiving any credit towards the vehicle, they said that was not the way it works!? I have the paperwork that was sent to GM Financial which does not request anything to be sent to us only to the bank. It is because of this, we are very confused why it would be sent anywhere else. We were at the understanding that we were dealing with a business that does these kind of things daily ... .what could go wrong, right. Now we will be responsible to make a payment on a vehicle we can not use, which is not fair business. It seems like the only thing they did right with in this transaction was cashing the check that was mailed to them. Now that they have there money and much more, they do NOT care to except blame or do anything to make things better. I requested for the information to reach the CEO of GM Financial to which they refused to give to me directly when asked! I was told that I could look it up for myself using XXXX, or that I could try to find it on their website. I feel like this could have been handled much better especially with a customer that has done multiple leases, maybe the money means more to them then the customers. They have been paid in full plus more, we should either have our necessary paperwork or think about covering the cost of a rental until everything is corrected, after all they made the mistake that caused all the issue we are dealing with.

Consumer Complaint: I mailed in IRS forms XXXX, XXXX, and XXXX to GM Financial to discharge the debt of my 2018 XXXX XXXX on XX/XX/XXXX. I never recieved a title and called them to find out why. An agent said on XX/XX/XXXX that they had not recieved the forms so I emailed them. On XX/XX/XXXX I checked to see if the forms were recieved and an agent said yes they had them and my title would be in the mail that day. I should recieve the title in 10 to 15 business days. I called again on XX/XX/XXXX and an agent said that I still owed and she was not familiar with the forms. I asked if she could fiward the forms to their legal department and she said she walked them over there personally. After this call I continued to recieve calls for payment and I asked another agent if their legal department had a response for the forms sent in. The agent said that there was no legal department. And then another agent said that there was. So since I got the run around I said I would cease payments until I heard from the legal department about the documents sent in to discharge the debt. I also informed the agent that I would pay if my car ended up on the repossession list to avoid repossession and I was told that I was not on the list. Well, my car was repossessed on XX/XX/XXXX. On XX/XX/XXXX I called off work and found out everything that needed to be done to retrieve my car. I informed them of not being able to miss more than two days from work due to being on probation. And that I would need a third party to pick it up because I work way north and the car is way south. They told me what I needed to do to get the third party approved and they said I had to sign another letter stating I did not have legal representation to get my car released. I did these things and once they were done they said I could be the only person to pick up the car and I was forced to write another letter saying that I am obligated to pay this debt according to the contract and will pay it. I had to sign and date it or else the car would not be released. I feel like I just got extorted to pay a debt that was legally discharged before I signed and dated a paper that makes me responsible for a debt already discharged. I could not pay to release my car until this was done. So I did it and paid Friday XX/XX/XXXX. I scheduled an appointment to pick up the car Monday XX/XX/XXXX at XXXX and it was cancelled due to the release papers not being sent to them in a timely fashion. Today Monday XX/XX/XXXX I was informed by loss prevention that the release papers were just sent in this morning. Now I am forced to pick up my car tomorrow at XXXX and jeopardizing my job because I have to take off again to go get it. Even though I sent in everything they asked for to have a third party do it.

Consumer Complaint: I filed a CFPB complaint on XX/XX/XXXX case number XXXX requesting documentary evidence of this alleged debt between GM Financial / General Motors Financial Company/ General Motors , XXXX AmeriCredit XXXX XXXX, XXXX XXXX XXXX etc. and XXXX XXXX. After further review of the documents sent to me by GM Financial, I discovered fraudulent activity. Please note of my findings : 1. A {$500.00} down payment was accepted by XXXXXXXX XXXX XXXX as no cash payment shall be included in a credit transaction per Truth in Lending. The {$500.00} dollars was added back to the Total Sale Price. 2. The contract stated in clause f we will sell the vehicle if you do not get it back. If you do not redeem, we will sell the vehicle. We will send you a written notice of sale before selling the vehicle. The consumer never received a written notice of sale from GM Financial. However, Consumer has documentation that no letter was delivered to XXXX XXXX XXXX. According to O.C.G.A. 10-1-36 when any motor vehicle has been repossessed after default in accordance with Part 6 of Article 9 of Title 11, the seller or holder shall not be entitled to recover a deficiency against the buyer unless within ten days after the repossession he or she forwards by registered or certified mail or statutory overnight delivery to the address of the buyer shown on the contract or later designated by the buyer a notice of the sellers or holders intention to pursue a deficiency claim against the buyer. 3. On the application from XXXXXXXX XXXX XXXXXXXX, consumer birthdate is wrong the application has XX/XX/XXXX however consumer birthdate is XX/XX/XXXX. The signature is not consumer signature. If you note on all pages the consumer does not sign name as such. 4. On the assignment to retail installment contract, there is not date of contract between seller ( XXXX XXXX XXXX XXXX XXXX ) and buyer ( XXXX XXXX, XXXX XXXX ). Nor is there a signature between Dealer-Seller and AmeriCredit has state on assignment. Only one signature.

I also, sent a notice to cease and desist all communication conveying of information regarding a debt directly or indirectly to any person through any medium. Re : Notice to Cease and Desist Account Number : XXXX Dear GM FINANCIAL, To Whom it May Concern ; This is in reference to the Consumer Report sent by your Company via email dated XX/XX/2022. While checking the above report, it came to my notice that your Company has furnished an account on my report. According to 15 USC 1692a ( 2 ), the term Communication means the conveying of information regarding a debt directly or indirectly to any person through any medium. As per the literal interpretation Any medium includes any oral, written, electronic, or other medium. Therefore, furnishing of the Consumer Report ( bearing information regarding the alleged debt ) by the Company will amount to Communication as per Fair Debt Collection Practices Act ( FDCPA ). Pursuant to my rights as per 15 USC 1692c ( c ) I am hereby providing you formal notice to cease any further communications regarding this account immediately. This includes but not limited to telephone calls, emails, social media, or any Consumer Reporting Agency. Any further contact by your Agent or Company, except a communication confirming your acknowledgment of this letter, is in violation of the Fair Debt Collection Practices Act ( FDCPA ).
