GM FINIACIAL HAS BEEN FURNISHING, SPREADING FOR PROFIT NEGATIVE FALSE '' LATE PAYMENTS ' CHARGED OFF STATUS INFORMATION ON MY CONSUMER REPORT IT WAS A UNILATERAL CONTRACT AND THEY COERCED, EXTORTED ME INTO MAKING PAYMENTS WHICH IS '' UNJUST ENRICHMENT '' AFTER THEY ILLEGALLY CHARGED OFF THE ACCOUNT AND STOLE THE CAR FROM ME IN A REPOSSION. THEY HAVE TARNISHED MY NAME AND MADE ME LOOK UNCREDIT WORTHY BY FURNISHING THIS INFORMATION I HAVE NOT BEEN ABLE TO EXTEND CREDIT IN COMMERCE WHICH IS MY RIGHT DUE TO THIS. There are FEDERAL LAWS that the furnishing of this account on my consumer reports are breaking. This account should of been deleted years ago since the first delinquency occurred in XXXX XXXX. And due to FEDERAL LAWS ON STATUE LIMITATIONS- 7 YEARS AND HALF are only as long as negative information can report on a consumer report. This account should of been deleted and off my report back in XX/XX/XXXX no later than XXXX XXXXBut not only did GM FINIACIAL break FEDERAL LAW once they charged off this account then furnished it on my consumer reports Reporting charge offs are illegal on consumer reports because the IRS PUBLICATION STATES CANCELLED DEBT ARE CONSIDERED GROSS INCOME AND 1099C ISSUED AND CLAIMED WHEN TAX FILING INCOME SHOULD NOT BE ON A CONSUMERS REPORT. Under 15 USC 1681 ( c ) Running of reporting period ( 1 ) In general The 7-year period referred to in paragraphs ( 4 ) and ( 6 ) of subsection ( a ) shall begin, with respect to any delinquent account that is placed for collection ( internally or by referral to a third party, whichever is earlier ), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action. And the GM FINIACIAL ACCOUNT NEVER GOT TO THE 180 DAY DELIQUENT PERIOD TO COMMENCE CHARGE TO PROFIT AND LOSS. They FALSELY SPED UP the date to furnish which is Illegal and Violation Worthy. And under The GRAMM-LEECH-BLILEY ACT which GM FINIACIAL MUST ALSO ADHERE TO 15 USC 6809 ( 3 ) ( A ) I HAVE A RIGHT TO PRIVACY. I NEVER AUTHORIZED GAVE MY LAWFUL LEGAL WRITTEN CONSENT FOR GM FINIACIAL TO FURNISH, SPREAD FOR PROFIT TO UNAUTHORIZED THIRD PARTIES WHICH THEY DID FOR 9 YEARS. I'm calling on the CFPB TO ENFORCE MY CONSUMER RIGHTS, MY CONSUMER PRIVACY, AGAINST GM FINIANCIAL they have been in NONCOMPLIANCE of FEDERAL CONSUMER LAWS for years now with this account.

Consumer Complaint: I have 2 late payments that should not have been on my account and I called to ask them to help me remove the lates from my credit report as it was hurting my score and the guy that answered transferred me to someone else and I got transferred several times and no one could help. The last person told me they never had anyone ask to remove lates on credit and they could not help me. GM Financial violate my rights under the FCRA. 15usc Section 602- states I, XXXX XXXX XXXX XXXX have the right to privacy. 15 usc Section 604 A Section 2 : States a consumer reporting agency can not furnish an account without my written consent or instructions. 15 usc 1681a ( 2 ) ( a ) ( l ) - a consumer report does not include any report containing information solely as to Transaction or expenses between the consumer and the person making the report. I want the creditor to update the late payment for XX/XX/2022 and XX/XX/2022 ( 30 day ) to paid on time based on the violations. I was not late and should not have these blemishes on my credit. Consumer Complaint: The following violations of the US CODE TITLE 15 COMMERCE AND TRADE have been committed by GM FINANCIAL in the contract with : 15 USC 1605.Finance charge defined except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. 15 USC 1603 Credit Transactions, other than those in which a security interest is or will be acquired in real property, or in personal property used or expected to be used as the principal dwelling of the consumer and other than private education loans are exempted transactions. 15 USC 1602 ( L ) Defines the term Credit Card as any card, plate, coupon book, or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. 15 USC 1631. Disclosure requirements ( b ) If a transaction involves one creditor as defined in section 1602 ( f ) of this title, or one lessor as defined in section 1667 ( 3 ) of this title, such creditor or lessor shall make the disclosures. If a transaction involves more than one creditor or lessor, only one creditor or lessor shall be required to make the disclosures. USC 1662. Advertising of down payments and installments ( 1 ) ( 2 ). As a result I am enforcing USC 1635. Right to rescind ( a ) ( b ) ( c ) ( e ) ( f ) ( g ). GM FINANCIAL DID NOT DISCLOSE MY RIGHT TO RECENED. GM FINANCIAL USED MY CREDIT AND FORCED ME TO MAKE A DOWN PAYMENT. I informed Gm Financial of these violations through a Notice of rescission as well as a CEASE AND DESIST letter that was signed and notarized and 15 USC 1692 was quoted but I am continued to be harassed without addressing these violations. Not to mention the contract they have has no bases as my signature was forged compared to the original contract that I have in my possession inwhich my vehicle is assigned to XXXX XXXX XXXX XXXX.

Consumer Complaint: While checking my credit report, I notice an account from GM FINANCIAL, that I believe is not being reported correctly on my credit report. On XX/XX/2022, I sent them a certified letter informing them that they were reporting inaccurate information on my credit report and requested that they provide me with the information that they used to verify the accuracy of my account, ( see Attached ). After not hearing from them for more than 45 days, I sent another certified letter on XX/XX/2022, ( see attached ), again requesting that they provide me with the information they were using to prove the accuracy of my account. I also sent certified letters to the credit bureaus, along with my incident report, ( which are attached ), asking them to verify or remove the negative report on my credit report that GM FINANCIAL is reporting. So far, I have not gotten a response from them either. As you can see, I have been dealing with this situation for several months with no success, so I am writing to you to help me with this matter.

Consumer Complaint: This is hurting my credit score which is very important to me. I know you will understand me in this situation this is becoming a frustration to me. I don't know what's happening to my credit report and I don't how you guys come up to this conclusion and report it on my credit report. This is very stressful for me because I always pay on time. Under 15 USC 1666b this billing error must be corrected because I always pay on time this is clearly a discrepancy on this account which clearly violates the 15 USC 1666 ( b ). Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated in the law. GM FINANCIAL XX/XX/2013
