Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: On XX/XX/2022 I contacted company to make an over the payment. I made payment but company representative never submitted it. Company ( GM Financial ) later reported missing payment on my Credit report. I called company to fix inquire about problem and was told by representative that it was not my mistake and transferred to customer service. XXXX XXXX at customer service ) told me he was going to help me, that he needed to talk to his supervisor and that he would call me back. When I asked him for written proof that payment was made on time, he refused to provide it. Missing payment is still on my XXXX credit report and my credit score dropped 133 its because of this neglectful incorrect repor. I've never had any late payments with GM Financial or any of it's affiliates.

XXXX XXXX sent the entire loss amount to GM Financial because they would not release the title without receiving more than {$12000.00} in additional funds that is mine. It is now XX/XX/2022 and I still have NOT received my check BECAUSE GM Financial is playing the " float '' game and keeping my funds for their backend income capture on interest income. This is an illegal practice and should never be condoned by you!!!! Please investigate! Please assist me with getting resolution and protecting US Consumers from this abuse going forward!!!!

Consumer Complaint: I have been contacted by XXXX repeatedly, every week for four years. I had a vehicle that I leased through XXXX for four years. I completed the lease in full and returned it successfully with no monies needing to be paid as the car was in good condition. XXXX has called me every week, several times a week, EVERY week since about six months after the lease was concluded. About two years ago, told that that I did not owe the monies and that if they wanted to communicate with me, to do it through the mail. They sent one letter, then resumed their calls. At this point, they have called me a estimated minimum of 400 times, literally 400 times over a four year period. Ive told them that I dont owe the debt but they keep calling. Please let me know what I can do to stop this. I can not believe a former creditor is allowed to harass me to this extent, particularly when I have completely fulfilled the lease obligation. I have reached the poinXXXX where seeing their number come up is making me sick. I can obtain phone records to substantiate the frequency of their calls if needed. Consumer Complaint: Had an auto loan that was paid off, I turned it in to purchase another car in XXXX and the dealership said the vehicle was repossessed and obviously not because it was with me to use as a down payment for a new vehicle. It stated profit and loss write off and a balance still on. I have called GM financial to fix that. They continue to not repair. I have notified XXXX XXXX and nothing is being done. As I stated, XXXX XXXX bought my car and I used that as a down payment for my XXXX XXXXXXXX. It needs to show that it was NOT a write off or profit and loss. Consumer Complaint: I have filed a CFPB complaint about this financial institution multiple times. GM Financial stated they sent me a written notice of sale before selling the vehicle. GM Financial stated that my mail box was undeliverable ; however, consumer has received every correspondence by GM Financial concerning this alleged debt EXCEPT what I am requesting which is the notice. In addition GM Financial sold this debt and their debt collectors send correspondences to the address on file of this alleged debt. GM Financial is to provide to consumer a copy of the notice that was sent to address on record. I am demanding GM Financial to provide the Certified Return Mail Receipt in this complaint. I have record to indicate that CRMR to me in which is invalid. After further review of contract of this alleged debt, the consumer credit contract failed to contain the HOLDER IN DUE COURSE in at least ten point, bold face which made the contract unclear and inconspicuously. On XXXX, I made an uninformed decision when I entered a consumer credit transaction with your financial institution. I made an uninformed decision when I entered into an agreement without knowing the meaningful disclosure of the credit terms. According to Blacks Law Dictionary ( 8th ed. 2004 ), an agreement is a mutual understanding between two or more persons about their relative rights and duties regarding past or future performances ; a manifestation of mutual assent by two or more persons. As a result, I had no say or decision in the terms of the agreement. I was giving a generic computerized agreement that is given to all consumers, who enters a credit transaction, without clear and conspicuously terms of the agreement. The only evidence of debt is by agreement but because of an uninformed decision this debt becomes null and void. The consumer did not receive a printed adequate notice. The adequate notice was to give me the pertinent facts clearly and conspicuously, so that I had noticed it and understood its meaning. Your financial institution had the choice of printing the notice or had given to me on each periodic statement, or by other means to assure I was in receipt thereof the notice. Your financial institution failed to provide pertinent notices. As a result of fraud and deception of this onsided agreement, your institution will update my account as paid in full and remove any derogatory remarks. Your financial institution will be held criminally liable according 15 USC 1611 for willful and knowing violating me as a consumer. Your financial institution will send me a cashier check for {$5000.00} or imprisoned not more than one year, or both the choice is yours.

Consumer Complaint: I am a mature and responsible woman who suffered significant hardship when entering into a predatory and exploitive loan with GMAC Financial through a trusted XXXX dealership in NJ. Not only do I hold a supervisory and long-term position with the state of NJ, I am in recovery from a significant and serious XXXX XXXX and a XXXX XXXX XXXX. At the time of entering into this car loan in XXXX of XXXX, I presented at the XXXX XXXX dealership visibly upset and confused due to a traumatic experience with XXXX XXXX in XXXX, NJ days earlier. Due to these reasons, despite being a life-time, loyal customer of XXXX, I fell prey to being " scammed, '' and financially exploited by GMAC Finncial and XXXX by entering into a falsely-termed and predatory car loan. This encounter was precipitated by my unknowing purchase of a XXXX XXXX XXXX a few days earlier where I purchased a XXXX XXXX XXXX at a cost of XXXX XXXX XXXX Due to my regret over the purchase the following morning, I contacted the XXXX dealership in XXXX, NJ to request an alternative purchase of a XXXXXXXX XXXX I was informed by the dealer that the loan was " non-negotiable, '' and that they had no existing inventory of an alternative vehicle. This incident was formalized in a complain to the NJ Attorney General, who reported that the matter had been investigated thoroughly and that they found no wrongdoing on the part of the XXXX dealership. In true desparation, I turned to XXXX XXXX in XXXX, NJ, where I was a loyal customer in the hopes of a " good deal '' on a XXXX with the trade-in of the XXXX XXXX XXXX. It is then that I regrettably entered into a car loan for a XXXX left-over XXXX XXXX XXXX through financing at close to an 11 % interest rate for a XXXX loan to pay for the only vehicle offeted. Since that time, I am locked in to a @ $ XXXX car loan for which I currently owe $ XXXX on -- double what the value of the vehicle currently is. I entered into this loan because I was financially and emotionally vulnerable and cognitively compromised. I also took the spoken word of the finance manager that I could return for a more affordable purchase after making payments to XXXX for several consecutive months. I honored my commitment and when returning to him, he denied making this promise ( my husband was present and also heard that the purchase and loan were negotiable ). Despite numerous efforts to bring the circumsatnces to GM Financial, I continue to be obligated to a car payment of $ XXXX, and still owe {$25000.00} on the loan. This loan has had horrific impact on my financial health and has caused severe and long-lasting negative impact on my credit history and XXXX XXXX XXXX I am hereby requesting that both GMAC Financial and XXXX be fairly and objectively investigated so that a fair and manageable reconciliation of these unfair circumstances be reached. I am literally outrgaed by persons in my situation being financially and morally exploited by large corporations exploiting persons through predatory lending practices. It is now to the point that I am literally medically indigent and unable to pay my mortgage and for other basic necessities due to the crippling effects of these large and wealthy enterprises. Any assistance with this compelling situation would be deeply appreciated!!
