Consumer Complaint: I am a victim of identity theft and I have submitted a notarized affidavit which serves as a legal document of my identity theft. I am also a victim of the XXXX breach and opted out of the settlement because I have suffered extreme losses due to the breach and the identity theft. I need the fraud accounts that are in my letter that is attached removed permanently from my file as I have also contacted the creditors as well. This is extreme in violation of my fair credit reporting act rights and I will seek legal recourse. I have also attached the printout of me being affected by the XXXX breach as well.

Is it true AmeriCredit asking for a cash down payment? Consumer Complaint: On or about XX/XX/XXXX, I sent a payment to GM Financial via priority mail using the coupon or remittance slip that came attached to the " statement '' for the amount of {$520.00}. On XX/XX/XXXX I sent a payment to GM Financial via certified mail # XXXX, it was received by GM Financial on XX/XX/XXXX. The payment was in the form of a coupon or remittance slip that came attached to the " statement '' for the amount of {$1000.00}. On XX/XX/XXXX I sent an Affidavit of Truth to GM Financial XXXX, XXXX XXXX XXXX at XXXX XXXX XXXX, XXXX, TX XXXX via certified mail # XXXX and it was received on XX/XX/XXXX. I attached a copy of the payment coupon I mailed that same day in the amount of {$1000.00}. The correspondence explained that I understood the laws and my rights and requested that GM Financial honor my lawful tender of payment. On XX/XX/XXXX I sent a Billing Error Dispute to GM Financial via certified mail # XXXX and it was received on XX/XX/XXXX. I still have not received the proper reply required by XXXX CFR XXXX. On XX/XX/XXXX I sent a payment to GM Financial via certified mail # XXXX, it was received on XX/XX/XXXX. The payment was in the form of a coupon or remittance slip that came attached to the " statement '' for the amount of {$25000.00}. On XX/XX/XXXX I sent a second Affidavit of Truth, Notice XXXX XXXX to GM Financial XXXX, XXXX XXXX XXXX at XXXX XXXX XXXX Suite XXXX, XXXX XXXX, TX XXXX via certified mail # XXXX and was received on XX/XX/XXXX. This correspondence quoted several laws alluding to my rights, the violations that GM Financial was making and the remedy I was requesting. On XX/XX/XXXX, GM Financial sent someone to repossess my vehicle even though I had submitted payments on time and technically have overpaid on the account. GM Financial has violated several laws throughout this process. They have continued to submit negative and derogatory information to my consumer report even though they received the billing error dispute and still have not responded to it. I have tried communicating via phone with GM Financial but I am talked down to, treated as I have no clue what I am talking about and threatened that if I want my car back I have to submit the type of payment that they dictate to me rather than the coupon/remittance slip which is still on obligation of the United States the same as federal reserve note or " dollars ''.

Consumer Complaint: This complaint is against AMERICREDIT Until viewing my credit file, I had never heard of this company. I have been disputing an inquiry this company placed on my credit file, without my permission. My initial dispute started in XXXX of XXXX. All three credit bureaus come back with first a stall tactic and then a fake validation letter. According to the credit bureaus, they have confirmed with this company that the inquiry belongs to me and that you are not removing it. I Demand that you do IMMEDIATELY! I have lost all my patience and this is the final attempt before I file legal action against this company. I have been the victim of ID theft. I was in a XXXX XXXX early last year and someone made an attempt to apply for unemployment in my name. I have short term XXXX from my job so knew this wasnt me. A few months later they made several attempts to obtain credit cards and car loans in my name. There are 4 inquiries from Americredit on my report. No one in their right mind would put that many credit inquiries, apply to the same company, in such a short amount of time. I have not applied for any auto loans or credit cards and do not wish to. It's obvious this is fraud. Since this agency is reporting that the inquiry is valid then I demand to see the proof. Also, prove that it is actually me that made the inquiry 1.I demand the original credit application signed by me, showing my wet ink signature? You dont because it doesnt exist. 2.Did you even make an attempt to investigate this matter to prove it was actually me? Again, no you did not as I was never contacted by this company in regards to this so-called fake investigation. 3. I demand a full ledger of every step of your investigative process, for each dispute submitted by me. To continually ignore my request for validation shows malicious and willful noncompliance, which is against Federal Law. You have violated many federal laws in The Privacy Act of 1974. One agency is not allowed to share information with another agency without a consumers consent. 15 UCS 1681 Section 604 A Section 2 - clearly states any furnisher of consumer reporting is to have written consent from the consumer before reporting and item. Americredit did not have my consent. I have reported this fraud to the proper authorities. I am demanding you remove all inquiries made by this company to all three credit bureaus immediately. Federal law states that fraudulent items are to be removed within 4 days. You have run out of time. If these inquiries are not removed and proof of this action has not been sent to me I WILL TAKE LEGAL ACTION AGAINST YOU. Violation of the Fair Credit Reporting Act is {$1000.00} per violation. Since you have decided to ignore or perform proper due diligence when I demanded an investigation, you are responsible. You are the furnisher of this information, so the burden of proof and all liability is on you. At this time, I am demanding {$2000.00}, for the violations and the immediate removal of all inquiries from this company. The following inquires were placed fraudulently on my report on XXXX. Consumer Complaint: I called XX/XX/XXXX GM Financial to make sure the payments and overages were being applied correctly to my account. The young man said they were and not to worry. GM Financials online dashboard was not working on two different browsers. I asked for the break down of principle and interest then pay off. He assured me the payment overages were being applied properly and split between XXXX XXXX XXXX. I checked my online account the next day and it showed a past due balance, when I was paid ahead. I called GM Financial asking where that came from and was originally told not to worry. It was a glitch in " XXXX '' their inhouse system. That on their end she could see that my account was current. A few days later it still showed past due, I called GM Financial asking what was going on and was then told an employee had made an unauthorized payment reversal for XXXX, XXXX That my account now had late fee 's and was past. I asked why and after being transferred to three different agents nobody could tell me who or why it was done. I was told " He was not authorized to do that, were working to fix it. I asked several times if this would hit my credit and informed them I was going to be making a purchase in XX/XX/XXXX that I put a non refundable deposit down. The agent told me it " absolutely would not be reported because I was not late, and they notated it on the account ''. I was told they didn't know why the agent reversed it, but it was fixed, not to worry. My future purchase would be safe. I paid off the remaining balance of the loan on time XX/XX/XXXX. In XX/XX/XXXX I was setting up financing on my previously named future purchase. We checked my credit and it shows GM Financial reported me 30+ days late XX/XX/XXXX. I called GM Financial and was told to hold on, and they hung up on me after opening my account ... Twice. The next day a GM Financial rep told me that she could see that someone had tried to check the payment leger and reversed the payment and tried to reapply it. She said he wasnt allowed to do that, and reapplied the payment he reversed on his own doing wrong. Sending my account into a fraudulent past due status. On the recoding i have she states " Its their " GM Financial 's '' fault and it should have been caught and fixed the previous times that I called. However there wasn't much they could do since it had hit my credit ( XXXX points ) Someone from GM Financial would call me to explain how to fix it but it would take 45 days and I would lose my cash deposit on my future purchase because they made unauthorized changes to my previous payment. Not much other than " Yes its our fault but not much we can do now '' phone call was recorded on my end.

Consumer Complaint: The purpose of this letter is to address an issue that I am currently experiencing in regard to late payment reporting. I attempted to resolve this matter with customer service to no avail. On XX/XX/XXXX, I received notification from my credit monitoring services that I had a late payment reported by GM Financial. Late Reporting Issue On or after XX/XX/XXXX, I requested a XXXX payment deferment granted by a customer service rep at GM Financial XXXX Upon receiving my statement, I noticed that the agreed payment deferral had not been applied to the account, so I made a payment immediately, and it was made before the statement closing date. Thereafter, I reached out to GM financial regarding the deferment, and I was told that I had received the wrong information and that the payment deferment had never been applied. Since then, I have paid my car note every month before the XXXX late period. I made a payment on XX/XX/XXXX, in the amount of {$1600.00} by auto debit from XXXX XXXX. My GM Financial statement due date is the XXXX of each month, and this payment was made before the due date. I have attached proof that I was not XXXXXXXX XXXX late, and I am requesting an immediate update to all XXXX bureaus.

Consumer Complaint: GM Financial are intentionally and irresponsibly reporting wrong information to my consumer report. Which is a clear violation of the law. The law states that I am entitled to an accurate report, in which GM Financial is in violation of 15 USC 1681e ( b ). I reached out to GM Financial on or around XX/XX/XXXX, to ask why they were reporting late payments after my insurance company and I, had made them aware that the vehicle was declared a total loss on or around XX/XX/XXXX. I express to them that they were intentionally trying to harm my name with the consumer reporting agencies and requested that the late payments be removed. GM Financial removed the late payments and payment history from my consumer report and charged the account off on or around XX/XX/XXXX. Also, GM Financial received a {$44.00}, XXXX payment on XX/XX/XXXX from my insurance company. However, on XX/XX/XXXX GM Financial charged my account off as bad debt in the amount of {$61000.00} as reported to the consumer reporting agencies. Vehicle was declared a total lost on or around XX/XX/XXXX. I am demanding that GM Financial update the Account Status, Payment History, Past due amount and Balance of this account as follows : Account Status : Paying as agreed.
