Consumer Complaint: The car was paid off in XXXX I was told the lien release was sent to me I never received it. The call was totaled and before the insurance company will send me the check for the loss they need the lien release I called GM financial on XXXX the XXXX and asked if they would fax it to the insurance company I was told they would but it could take 3 to 5 business days. My wife called Monday and spoke to a someone and asked if they could expedite the situation the contact was extremely rude and told her they had 3 to 5 business days. I called on the XXXX and was told they had 3 to 5 business days. As of the XXXX the insurance company still has not received the lien release.

Consumer Complaint: Reminder that UCC codes, USC, the HJR 192 are legislature put into action for use by the consumer. The problem is that most people don't know because corporations don't want them to know. When people like us find out about and how to use these codes, the corporations fight back even though they are not following legislative codes. XX/XX/XXXX, my wife and I sent payment in full to discharge the debt for our XXXX XXXX XXXX XXXX. Payment was sent, certified/return receipt to GM Financial CEO ( as we did not know where it was to go to ) XXXX XXXX in the format of a remittance coupon. We listed each of the corresponding UCC codes and definitions that pertain to this payment ( UCC 3-104, UCC 8-102 , UCC 9-105 ( 1 ), 18 USC 8, UCC 3-603, UCC 1-308 ( a ), UCC 3-419 and House Joint Resolution ( HJR ) 192 ). The payoff amount sent on the remittance coupon was {$35000.00}. We received a letter back from GM Financial Central Fraud dated XX/XX/XXXX. In short, the letter told us that the documentation we submitted is not recognized as legal tender by the United States government, the Federal Reserve and the Internal Revenue Service, therefore, it is not an acceptable method of payment for our account. GM Financial Central Fraud then told us that our documents are often used as a payoff scheme by fraudsters, that we must continue to make payments as per our contract ( which is with XXXX XXXX XXXX, not GM Financial ) and gave us a website to go to for acceptable forms of payment. XX/XX/XXXX my wife and I sent the Department of Treasury, a request to audit GM Financial on our behalf by way of a W-4 Sandwich. My wife and I each sent the Treasury a W-4 , a form 1040 and a 1040V to pay the Treasury for their work. There has been no response to date. XX/XX/XXXX my wife and I sent full payment in the amount of {$33000.00} in the form of a remittance coupon, again with all codes ( UCC and USC ) and HJR 192 and a 1040V to pay the Treasury agent for their work. There has been no response to date. On XX/XX/XXXX my wife and I sent detailed accounting of our payment history for a W-4 Sandwich audit to the Internal Revenue Service . We included a W-4 , a form 1040 and a form 1040V so the IRS agent can get paid for their work. There has been no response to date. XX/XX/XXXX my wife and I sent copies of the remittance coupon dated XX/XX/XXXX with all pertaining codes ( UCC & USC ) and HJR 192, along with our fee schedule to GM Financial/Payment Processing imploring them to discharge the debt of our account as per the negotiable instrument sent to GM Financial/Payment Processing . No response to date. XX/XX/XXXX my wife and I sent a form 3949A and a 1040V for their efforts and a copy of the paperwork, including the remittance coupon submitted XX/XX/XXXX. No response to date. XX/XX/XXXX at XXXX, GM Financial contracted with XXXX XXXX XXXX and sent them to our abode to repossess our XXXX XXXX XXXX XXXX We are in a state that is a civil self help repossession state ( all repossessions have to be voluntary ). The police and sheriff deputies worked to get us to allow the repossession driver to leave our private property with our vehicle. My wife and I were adamant that our truck was not to be taken off of our private property. Under duress we aquiesced to the request of the police and sheriff deputies. Under the Colors of Law statute, this becomes a wrongful repossession. Done in good faith, understanding both spiritual and legal liabilities of, " Thou shalt not bear false witness against thy neighbor. ''

Consumer Complaint: I got a truck at XXXX XXXX in XX/XX/2022. I stated I am the beneficiary of this purchase and signed with my beneficiary signature, see attached documents. GM Financial approved the purchase. Upon receiving the contract in the mail, I went and added my terms and had it recorded in the courts so it is a legal contract. GM Financial has received the contract and refused/ignored it. I called multiple times. After being transferred to the XXXX person on XXXX call, I gave the man the Certificate of Record number along with the number under the barcode at the top of the page. I asked them to review it and call back, which they never did. I called back approximately a week later and spoke to another woman. She said she knew nothing about this stuff, but she was able to pull up the contract in my file and read it. I tried getting a phone number to the legal team or CFO but was refused.

Consumer Complaint: My Name is XXXX XXXX XXXX XXXX On XX/XX/XXXX, I purchased a car from XXXX XXXX, identified as vehicle number XXXX, financed through Americredit Financial Services Inc. loan number : XXXX. The loan was for 6 years which would have completed cycle in XX/XX/XXXX ; however, during the year of XXXX, XXXX XXXX XXXX Florida, which is where I resided, went through two hurricanes as a consequence three payment were allowed to be placed at the end of the loan term. In XX/XX/XXXX I left the USA and moved to XXXX, leaving my then Husband in his care our home and car which had the 3 payments to complete. In XXXX AmeriCredit Financial Services Inc. issued me a 1099-C Cancellation of Debt which was mailed to my home in XXXX XXXX XXXXXXXX Florida . I was required to file taxes with the amount showing on the 1099-C of {$990.00} as income. This represented the 3 payments that were put to the end of the loan were never paid by my then husband which resulted in the issuance of the 1099-C for the three missed payment. On XX/XX/XXXX, I went to DMV and tried to get the title for the car, as it has been sitting for years and I wanted to start using it. To my dismay, the lien is still showing and upon my call to now General Motors Finance, they will not release the title until I pay an amount of {$1100.00}, which they claim is what is owed on the vehicle. I explained to the customer service representative and to the supervisor XXXX XXXX, at ( XXXX ) XXXX, that I received this 1099-C and if they wanted the funds they were going to have to rescind the 1099-C issued, and that would required that both of us do a 1040 Amendment to the taxes for the amount I reported as income and the taxes they reported as payment. The main issue is that the 1099-C was issued in XXXX and I did my XXXX taxes with this amount as income. I can not at this point correct my taxes from 11 years ago. I have tried daily, weekly to speak to a manager or someone that can help to no avail. Meanwhile, I am unable to resolve this issue. I have also asked for the payment history to be mailed to me to show me where the difference is coming from. My payments were of XXXX XXXX monthly... So I do not know how they state that apart from the {$990.00} they claimed were issued to me as a 1099-C that I owe an additional {$1100.00}, this would mean that I was 6 months past due, which is not accurate. I need help resolving the title issue and determining if I do owe, that they provide payment history to show how the amount is arrived ... and if the {$990.00} is part of it ... they can not double collect on it.. one through a 1099-C and the second with me sending them the payment they are asking to release title. I plan to send copy of this complaint to the Federal Trade Commissioners Office, State Attorney and to the IRS. I can be reached at ( XXXX ) XXXX.
