Consumer Complaint: I bought a XXXX Chev Malibu with about XXXX miles on it from XXXX XXXX XX/XX/XXXX that was sold to me deceptively. The salesman XXXX lied to me about what was wrong with it a When I asked about a concern during the test drive, he lied about the number of owners the had stating that the car had just been traded in a couple of hours before I came in to buy the car by an elderly couple, hence the low mileage and failed to tell me that they, XXXX XXXX had made a repair to the transmission in XX/XX/XXXX.3-4 mos.later the car stopped working totally and needed new transmission. After abt 2mos of back and forth with gm and the dealers owner giving me the run around and just not wanting to help even though they were deceptive, I had to pay XXXX and was reimbursed XXXX.I should not have had to pay anything.i was without a car for almost 2mos.After practically begging the dealership I was given a loaner 1 day before my car was repaired.Im a single parent and having to pay to get around for almost two months and having to come up with that much money was like having to come up with a XXXX.Gm decided to make arrangements after almost XXXX mos. They initially refused to due to the loan being too new. They financed a car that was sold to me deceptively and put me through so much to finally give me arrangements. This issue caused me to fall even further behind on other bills including my mortgage in which I had to get modified around the same time frame of XX/XX/XXXX.I have a mortgage that I have fell behind on now again and it 's going into default again.gm reposessed the car on Mother 's Day because it was 3 mos behind in which I thought that it was 2mos behind.im a single parent and I am employed.I have household bills, mortgage, tuition, my daughters graduation, a daughter in college and it 's has been impossible to do everything because I have not been able to catch up due to their car needing a new transmission and all of the other financial strains that caused me.Its not fair and I would like to know if there 's anything that can be done because I was deceived and it has caused everything in my life to go downhill financially including my health.I will take any advice that can be given.thank you

Consumer Complaint: I never had an account with General Motors. I sent a direct dispute asking them to provide me with documentation that I had an account with them, but they failed to provide me with any paperwork. They just sent a one-page letter stating that my account is reporting correctly to the XXXX, XXXX, XXXX agencies. I know it 's not reporting correctly because I never had an account with them.

Issue: Problems when you are unable to pay

Subissue:

Consumer Complaint: I took this car loan out XX/XX/XXXX. When the loan was taken out I advised that they can not call my place of employment under any circumstances. I put it on the application and all documents for me and my wife. I had to make a welcome call to GM and give them consent to call my cell, por and my wife 's cell. At which time I advised do not call either POE. Every month when I talked to them you have to verify your phone # and give consent to call. At which time myself or my wife would advise no calls to POE. The agent would always say it is marked. I had no issues until I became sick and fell behind. I kept in constant contact with GM advising of my issues and scheduled payments. I was sitting at my desk one day at work and an agent comes to get me and said the customer is asking to speak to you and will not give any information. I advised please transfer to my desk and I will talk to them. It was not a customer it was GM. They called into XXXX ( my employer ) through a customer line and asked for me until they were transferred to me. When they first called they heard the monitoring disclosure and each time an agent talked to them ( XXXX ) they heard this as well plus heard this from me. They knew they called a customer line and was being recorded. This is my issue. They knowingly with intent called the customer # to cause harm, embarrass, and put my job in jeopardy by calling. The call is recorded and over XXXX people are now privy to my personal information because GM broke the law by knowingly calling in on a customer line and pretending to be a XXXX customer to get to me. Issue XXXX on XXXX XXXX late night my vehicle was taken from my driveway. I thought it was stolen. No G M illegal repossessed my vehicle. I was late, yes I admit that I was 45 days late with a payment scheduled through GM XX/XX/XXXX. I was in constant contact with them and they were aware of the payment plan. They took the vehicle with no notice and a payment pending in their system which would have brought it less than 30 days delinquent. I want XXXX XXXX things to happen. 1 GM gives me all funds paid on the vehicle, takes it back and marks it as paid in full. 2 GM provides me with a paid in full letter and we go our separate ways. GM breached my confidentiality by calling in on a customer line where over XXXX people now have access to that call and personal information. If these XXXX options do not fit for them I am open to hear what they have to say. If need be I will sue for breaching my confidentiality willfully with the intent to cause harm.

Issue: Managing the loan or lease

Subissue:

Consumer Complaint: I leased a new vehicle which was financed through GM Financial. My first payment was due XXXX/XXXX/XXXX. I attempted to set up electronic transfer from my bank to GM, but GM financial was not set up to accept this payment method. So I had my bank issue a paper check with guaranteed payment to GM by XXXX/XXXX/XXXX. Payment was being sent from XXXX XXXX to XXXX XXXX. On XXXX/XXXX/XXXX, and again on XXXX/XXXX/XXXX I checked with GM to XXXX my payment had still not posted. I was going to stop payment but GM told me if my payment would present they would have to charge me a return fee. They suggested I make another payment direct with them. So to avoid any late fees or dings on my credit or the possibility my payment was lost on XXXX/XXXX/XXXX I made another payment. On the XXXX/XXXX/XXXX statement it appears both payments posted. However the statement does n't reflect any posting dates for either transactions! I checked with my bank and the original payment sent on XXXX/XXXX/XXXX cleared my bank on XXXX/XXXX/XXXX. This was 18 days after it was sent to GM. The fact that it takes over 10 days for GM to process a payment is unacceptable. In addition a statement that reflects no posting dates is also unacceptable. Having been XXXX for 43 years I know there are guidelines regarding these issues. I wrote to GM via a survey they sent me on XXXX/XXXX/XXXX outlining these concerns. I did receive a prompt return message to contact them at XXXX. I tried call this number several times. It rings once then there is dead air. Can you please look into the above issues. Thank you

Consumer Complaint: GM Financial is assessing a monthly {$86.00} fee for not making my payment within 11 days of its due date. However, it is not 30 days late. When I contacted XXXX, they insisted that in lieu of reporting my less than 30 days late account to the credit agency, they were going to assess a late fee.

Issue: Problems when you are unable to pay

Subissue:

Consumer Complaint: I have a vehicle loan with GM Financial for my XXXX KIA Soul. XX/XX/XXXX I had to file a XXXX XXXX bankruptcy in an attempt to save my home from foreclosure. My loan with GM Financial has never been late or was never in default. I had to put the loan in with the XXXX XXXX restructuring plan per the bankruptcy trustee 's orders in spite of it being in good standing. I made every single plan payment in my chapter XXXX case but I had to have my case dismissed in XXXX XXXX and surrender my home due to my mortgage holder constantly contesting my proposed payment plan thus making my home unaffordable. During the time the car loan was under the protection of the bankruptcy trustee GM Financial reported payments as late to the credit bureau which is illegal. The Chapter XXXX case was dismissed without prejudice in XXXX XXXX. Once the case was dismissed I immediately resumed without delay paying my auto loan outside of the bankruptcy plan. I have been out of the Chapter XXXX plan since XX/XX/XXXX and I have made every single car payment on time but GM Financial is not reporting my payments on time to the credit bureau. This is also illegal per a XX/XX/XXXX Bankruptcy ruling out of the Bankruptcy court in Wisconsin. I verified this by pulling my XXXX and XXXX reports. GM Financial has failed to update the credit bureaus to reflect the status that the loan is being paid on time and is no longer part of the chapter XXXX wage earner plan. GM financial is still reporting the loan to the credit bureau as part of the chapter XXXX bankruptcy plan and I am not getting positive marks on my credit bureau reports for making 6 on time payments. During this time period after the bankruptcy case was dismissed GM Financial has continued to collect the interest of 14 % every single month I have sent in my payments but GM Financial has not honored their responsibility as a lender to report my positive payment history to the credit bureaus. Whether or not this was an oversight on the part of GM Financial it is still illegal and has caused damages to me. My financial situation has slowly been improving since receiving a fresh start under the bankruptcy code as well as finding more affordable housing. I would like to refinance out of the high interest rate car loan in order to get my car paid off faster but I am unable to do so because they are not reporting my payment history. I feel they are doing this on purpose to trap me in a high interest rate loan for their own monetary gain and nothing more. I would like my payment history reported to the credit bureau correctly, the interest refunded on my loan from from XX/XX/XXXX until XX/XX/XXXX due to their mistake, or the chance of obtaining a possible loan modification with a reduced interest rate due to outstanding payment history for 20 consecutive months.

Issue: Managing the loan or lease

Subissue:

Consumer Complaint: I am a XXXX veteran who has never been in trouble with the law, always did the right thing, always paid my bills on time so why am I being treated this badly with no recourse by GM Financial? A year ago, I leased a GM Encore for my wife whom is a XXXX. After the first year we decided to get a XXXX XXXX van ; because we needed to use her XXXX ; and the little car was not helping with that ; so we traded the leased vehicle in. XXXX XXXX of XXXX bent over backwards to make this happen. On XX/XX/XXXX they purchased my XXXX XXXX outright and sold me the XXXX XXXX. The Encore was payed off that day. My payoff was good until XX/XX/XXXX. On XX/XX/XXXX my car payment was taken out of my bank account anyway. I had Auto draft. I immediately contacted GM Financial and was told that they did receive the payoff, but they did not know whom to title the car to and that they needed a mileage statement to complete the transaction. I passed this onto XXXX XXXX. On XX/XX/XXXX I again contacted GM and was told that on XX/XX/XXXX they authorized my refund of my car payment and that it will be in the mail the next business day. On the XXXX of XXXX I called again, this time I was told that they had 30 days to get me my money. On the XXXX of XXXX I called them again and after going through all the verification that I am whom I say I am ( this included my phone #, address, etc, I was told that they did mail it out but to XXXX XXXX XXXX not XXXX XXXX XXXX, which is where I have lived since my XXXX from the military XX/XX/XXXX. The owners of XXXX XXXX XXXX stated that they did not receive any mail for me. So I asked XXXX ( GM Representative ) if the check had been cashed and he stated that it had not been cashed. He then stated and I quote " We will OVERNIGHT you a new check, void the old check, and you should have your money in 3 to 5 days ''. Needless to say it is XX/XX/XXXX and I still have not received anything. I have not received a pay raise in 8 years and am struggling trying to make ends meet. My wife and I are raising our Granddaughter as our own plus my own adult daughter has moved back home. I just need some help. Had I been late one day with my car payment, I would have had to pay a late charge, but God knows how much interest they have made using my money and the countless other people they are doing this to. Is there no justice left?
