Consumer Complaint: I co-leased a vehicle on XXXX/XXXX/2015 with my husband who 's in the military ( 2015 GMC Acadia VIN # XXXX ). The dealership gave us false information about being able to ship a vehicle if given military XXXX. After 15 days of leasing the vehicle we received military XXXX and was able to return the vehicle and received a full refund from XXXX XXXX XXXX in the amount of {$1500.00}. We opened a case with GM financial ( Case # XXXX ) and was able to get the full refund due to the negligence, misleading information and law that Service Members Civil Relief Act outlines in Section 305. I called GMC Financial @ XXXX and was referred to the City of XXXX XXXX to get this resolved. I then called the City of XXXX XXXX Treasury office @ XXXX and was told they did not report anything to GM Financial as they do n't have me owing anything to them. I then called GM Financial back and ca n't get a hold of anyone. I 've left multiple messages for the GM Financial recovery department @ XXXX and have not received a call back. I now have XXXX reports on my credit report stating I 'm late on payments which has decreased my credit score. I am getting the runaround from GM Financial and no resolution has been given. I 'm currently XXXX and contacting GM Financial requires me to stay up late, as their hours of operation are during sleeping hours here. I need GM Financial to do their due diligence to ensure my credit report is cleared of any negative reports stating I 'm late on payments and comply with the Service Member Civil Relief Act which also covers dependents.

Consumer Complaint: GM Financial has failed to correct erroneous information submitted to XXXX, XXXX and XXXX CRAs. The accounts on my credit reports are not reflecting the correct or consistent " purge from '' dates. They have been illegally re-aging this debt. Additionally, they are illegally inflating the amount owed even according to their own internal records.

Issue: Managing the loan or lease

Subissue:

Consumer Complaint: GM Financial did not put the correct information on the credit report. The credit bureaus are reporting that I did not pay what was told in full through explanation not the amount total. Even though, the amount total was XXXX balance, the explanation was damaging. GM Financial stated, " I did not pay in full and I was 120 days with the four payments. '' This was not true. When I found out that I owed this payment out of 2 years, I agreed to pay XXXX which was a settlement plus 80 payments which was all the payments owed. Somehow, this remaining balance came from change deferred payment which I was not aware of. The statement GM Financial reported to the bureaus brought my credit score down XXXX-XXXX points. Like the payment stood for nothing. I paid XXXX dollars and I request for fairness. I paid what was requested of me. They agreed to XXXX leaving XXXX % balance. Even though, I struggle to pay most of the balance at XXXX a month, I was not late with one payment. They left with the explanation that hurt my credit. I want respect for what I paid and I want my credit for my payment. I made it extremely clear I was paying this type of balance because of my credit. I paid what they requested on time for 6 months. I do n't deserve negative comments to ruin my credit. I went through threats and strangers calling my phone about a balance I did not know I owed. When it came to collecting the balance, I gave no negative comments or refused to settle, I just paid. Please, be fair to what I paid and how I paid. I was not 120 days late during these payments. Please, correct this statement and be fair to the agreement. I paid what was requested on time I was not 120 days late. A company should not have the right to have so much power to ruin your credit. So, I am requesting for fairness toward what I paid on time. Thank you.

Issue: Managing the loan or lease

Subissue:

Consumer Complaint: I have been paying on a loan, on my XXXX CHEVROLET CORVETTE, which I have made a point of not being late, in order to build up my good credit record. I have been expecting my last payment to be final XX/XX/XXXX & expecting to be able to collect the title & was very excited that it will soon be over with & would be paid for however noticed the statement even gives a 4 payment to go & it also states that there has n't had any past due amounts or late fees charges on any of my statements. Yet my payments on the loan is {$510.00} ( {$460.00} principle + {$45.00} interest ) which would be {$2000.00} but they claim I owe {$3100.00} for my current balance? Which is {$1100.00} still left they are claiming I owe?? So I tried resolving this with customer service & was informed I was n't late on my payments ( which I specifically made sure I was NEVER late to making my payment in order to build a good credit history ) but was being charged an interest fee they charge daily that I am required to pay for even with making all my necessary scheduled payments & NEVER was it ever listed on my statements that they were charging me ANY of these fees or that I even owed it. They claim I was informed of these such charges & even mentioned how it was on my contract & if I did NOT pay this added amount within 30 days after loan matures that they have the right to REPO MY VEHICLE!?! Yet directed me to another department to make arrangements for this additional amount they are trying charge me. I feel very disappointed about this whole ordeal & wanted it to be rectified & have it resolved!!! I CA N'T BELIEVE they can get away with this & would appreciate any advice resolving these charges or fees & would like to inform anyone else who maybe considering using their services to BEWARE OF HOW THEY CONDUCT BUSINESS WITH THEIR LOYAL CUSTOMERS!!

Issue: Problems when you are unable to pay

Subissue:

Consumer Complaint: I had a vehicle reposted after setting up payment arrangements. There was no notice given of repossession. GM Financial also says they have no record of pending payments. They said according to Virginia Law no notice is needed but from what I found, a notice of 10 days is needed. The Virginia Consumer Protection Law and Title XXXX of the Code of Virginia outline the rights consumers have against lenders performing repossessions of their vehicles. The Virginia Code requires lenders to disclose their rights in their written loan contracts before they can legally repossess their vehicles. If they fail to disclose their rights to repossess, they can not proceed with repossession. Written Notice Effective XXXX XXXX, 2010, the Virginia Assembly passed legislation requiring lenders to send borrowers a default letter before attempting to repossess their vehicles. The lender must send a written notice by first-class mail at least 10 days before repossession. The notice must state the amount of principal and interest due and owing, and alert the borrower of default and provide him with notice of the lender 's ability to repossess the vehicle if the buyer does not pay the entire delinquency by a prescribed date.

Issue: Problems when you are unable to pay

Subissue:

Consumer Complaint: GM Complaint In XX/XX/XXXX my husband and I copurchased a XXXX Cruze, financed it through GM Financial. No problems making payments until my husband was in a serious auto accident that laid an extra burden of high medical bills. I started missing payments and made them up as soon as I could. In XX/XX/XXXX it got to b too much to handle I needed to file bankruptcy ( in my name only ). My husband is on the car loan as a coborrower and he was not filing bankruptcy. I continued to make my payments to keep the car. It was our only means of transportation. Prior to this I was making my payments through the GM website or my online bank account. Once the bankruptcy was filed I could no longer access my GM account on line to make sure payments were being credited or not. XX/XX/XXXX, the bankruptcy changed from a Chapter XXXX, to a Chapter XXXX. The trustee returned all funds. Since I had extra money I paid two payments ahead. At least I thought I had. In XXXX XXXX, they repossessed the car. No notice not even to my husband. They stated due to bankruptcy laws they did not have to notify me or him even though he was the coborrower. We got the car back by paying XXXX. XXXX, towing and storage fees, and title reinstatement fees. I requested payment history from them. When I compared their history with my bank statements there are XXXX payments that were not correctly credited to my account. My payments are due the XXXX of the month. My XX/XX/XXXX payment was made on XXXX XXXX, XXXX. Through the website. Friday morning, I went to go to work and my car was not in my driveway. They had repossessed the car again. They said XXXX payment was not made. I looked at my receipt, noticed they had my bank account number wrong. I contacted them, went through several agents, said they would get back to me in an hour. This is 56 hours later, no response, no car and afraid that they wo n't work this out with me. It should have never gone this far. Please contact me and GM as soon as possible. In the first place there was missed payments, that was after the bankruptcy was filed and the statements stopped coming. True they were not allowed to send them to me, but my husband was on the loan as a co-borrower and never once called him or sent him notices at any missed payments. When I realized I missed one I would make it up as can be seen by the attached spread sheet. The amounts taken under the GM column are from their records, the amount in my column is from my bank statements. As also can be seen by the spread sheet is that the total I paid into GM financial is {$15000.00}, taken from my bank statements. According to their records they credited me with {$14000.00}. When I take my payment of {$400.00} x 30 months of the loan that comes to {$12000.00}. How can this be so far off? Again why did n't they inform my co-borrower that A ) the car was under a bankruptcy order, B ) payments are not being made would you please make them, C ) a repossession order has been placed do you want to pay to stop it? No correspondence at all until they repossessed the car. Then they tell him he can buy it back for {$12000.00} +. Or have to pay the difference if it sells for less than is owed

Consumer Complaint: I have a current case in [ Case number : XXXX ] against XXXX XXXX and against General Motors [ Case number : XXXX ]. I was advised that I can make a complaint against all companies involved. There are a total of XXXX companies involved. I am going to duplicate my previous complaint words but change the companies for the remaining XXXX complaints : Blatant misrepresentation of vehicle, non-disclosure and affirmative misrepresentation due to salesman withholding info that would have affected the desirability and value of the vehicle. I previously submitted a complaint in regards to being sold aXXXX Chevrolet Malibu on XXXX/XXXX/XXXX by the dealer knowing that the transmission was bad and having to replace it 7mos after purchase. When it went out I was told that other issues were wrong as well that I would also need repaired.i was not told that one of the other needed repairs was dealing with the engine and that it also had to do with the transmission failure as well. The dealership also withheld that they also made a repair to the transmission 1and 1/2 yrs before I purchased it.i brought the car in on Mon. because the engine light came on and was told that the engine is in serious need of repair and that it will be over {$2000.00} to fix.During my own investigation of the vehicle I just found out that the car was previously a rental car. This is total Fraud.Having these issues has caused my home to start the foreclosure process, the car was repossessed in XXXX XXXX, in which I had to pay over {$1700.00} to get back because the finance co waited until the car was almost 3mos.ALL of my bills are behind due to dealing with the issues of this car.i have lost a lot financially.I am a single parent and they took advantage by fraudulently selling me this vehicle. In addition I was told that the car was traded in a couple of hours before I purchased it by in elderly couple and that 's why the 4 yr old car had only a little over XXXX miles.that was a lie.I was told by the dealership and by GM Financial when the transmission went out that I was the XXXX owner in 4 yrs. Purchased a XXXX worthless Malibu from XXXX XXXX last year with about XXXXmiles.I was lied to by the salesman who blatantly misrepresented the vehicle.Issues with the vehicle were not disclosed that would have affected the desireability and the value of the vehicle had it been disclosed. They even withheld repairs that THEY ( the dealership ) had performed on the vehicle.7 mos after the purchase the transmission went out.i was also told that there were other issues wrong with the vehicle when they diagnosed it in which they also did not do anything about.Lemon law did not apply.Chevrolet has not stood by their product that was fraudulently sold to me.7mos after replacing the transmission ( last week ) the engine light came on I paid the dealership {$100.00} to diagnosis the issue and was told that the engine needed serious work done to it ASAP.After reviewing the issues that I could not take care of during the transmission diagnosis, relates to the engine as well.however I was not told that. The transmission AND the engine was done when they sold the car to me.And while doing my own investigation I have just found out that the car was previously a rental car with Enterprise Car Rental in Mississippi. That 's total fraud!!!! And I am not done fighting this. This is the shortened version of all of the issues involving this car

Consumer Complaint: GM Financial and I made an agreement for me to pay {$3000.00} on a Versa XXXX and the car payment will be settled. I felt the agreement would have brought me to a XXXX balance. I believe it is unfair when you pay a consumer based on agreement that both sides should be equally paid not leave a balance still on your credit report. I took on hardship to make sure I paid {$500.00} on time a month for six months to clear my name with GM Financial and make good to my debt. All I know is I tried to do right. We developed a trust relationship base on our agreement. The Versa XXXX was a difficult experience for me. I was struggling so bad being a Hurricane XXXX victim in XX/XX/XXXX and not benefiting from the funds given because I am single plus receiving a low paying job, I needed a car to better myself. Sometime, you made a choice that is difficult to hold your part of agreement with an organization. Even though, I do not drive this car, I wanted peace with this debt so I did what was agreed. It was bitter sweet making my last payment for my Versa XXXX but I wanted complete closure on something that stress me and created hardship for me. I call GM Financial Recovery and I spoke to XXXX. She gathered my information and stated that she would see if XXXX was available. I agreed. I was troubled when she came back and told me that XXXX was not available. I understood her response and explain to her that I promised XXXX that this last payment would be in at XXXX and I wanted to confirm what was told to me. XXXX informed me my title would be mailed to me within five to seven days and my credit report would show a change in 45 days. XXXX repeated things differently. She stated that everything completed will take up to 45 days. So, I asked her could she email me a letter explaining the process and showing completion on the agreement made concerning the Versa XXXX. She said, " No! '' I know my rights therefore I request to speak to her boss, " XXXX. '' She stated, " He was not in and she will have him call me tomorrow. Her tone was disrespectful and strong as she answered all my questions. She was also irritable as she closed her conversation with me. I apologized to her for getting on her nerve. Since, I was not closing my deal with the representative I been reporting to for six months, I was uncomfortable. When I hung up the phone, I felt hurt, upset, and disappointed. I felt my hardship was worthless with this agreement and not appreciated. I understand process and how it takes time but I just wanted confirmation that the payment was received and the information told to me was in writing. I decided not to talk or have any verbal conversation with anyone in GM Financial but write to management and let them know how I feel in writing. I am requesting in writing to receive a confirmation payment letter on the process of payment I had made XXXX XXXX, XXXX and procedures that will be taken since the agreement was complete. I truly appreciate GM Financial for giving me the opportunity to settle this debt. Most of all, realize paying what you owe is extremely important as well as your credit report number. Thank you for reading and listening to this letter. I know that management is extremely busy but I would greatly appreciate if you could honor my request.

During that call, I was lied to and told that I would not be reported late and that once my payment cleared I would be set. GM Financial inaccurately reported me late for a month that I was told I would be current. I have since been on time with payments just as I was before. As part of my promotion in my job, I am required to keep my credit report immaculate. My job requires an XXXX. I will be getting reviewed again in the next couple of month and I am fearful of 30 day late report showing up on my review.
