The amount of the installment contract was {$440.00} a month - {$460.00} with the optional GAP Coverage. I have since cancelled the GAP Insurance - but GM Financial continues to bill me the {$460.00}. If the {$19.00} a month is n't going toward the insurance - where is it going?

Upon trying to login on a Friday night I was redirected to a site that showed the " hours '' for their online service and when it was available. This is NOT 24/7 access as claimed.

Consumer Complaint: On XX/XX/2016 GM Financial was sent via certified mail a formal notice of dispute regarding the allege debt owed. On XX/XX/2016 a second written notice was sent demanding they cease and desist all collection activities pending validation and verification of allege debt owe. Both notices were received by GM Financial but they continue to harass i by sending emails and mails demanding payment without strict proof of its existence.This falls under laws of fraud and swindles. This company is in violation of federal laws and committing criminal acts against i. Furthermore the company refuses to validate the debt owed but has published with the credit bureaus deceptive, misleading, false, and negative remarks. Clearly this company does not believe in complying nor abiding by any federal laws- FDCPA and FCRA.

Consumer Complaint: First I like to explain that my choices above do n't match my situation that I am faced with. Although I do n't owe anything on this debt and it can not be collected. I did n't have the right choice so I put the dot in the Debt was paid spot. Now, I had a car that was repossessed in Texas. I had the car through GM Financial who was my lender in XXXX/XXXX/XXXX. After the repossession XXXX did n't follow Texas Repossession Law. I asked GM Financial to validate that this is a collectable debt under my rights as a consumer. I am going to provide all the information that I asked XXXX XXXX XXXX Incorporated to return all the information that I need. Based on Texas Repossession Rights : Vehicle Information ; Year : Make Model Vehicle Vin Number : When the last payment was made month & year? When was the vehicle picked up month & year? What address was the vehicle picked up at? Who was the original lender? What address you send any letters to concerning the buy the car back? What address you send any letters to concerning the date of the vehicle sale? What capacity the car was sold in auction, private, bank sale and Date & Month? After or Before the sale did you provide in full detail the financial itemized report on damages, deficiency judgment, mechanical work itemization, and amount of sale letter How much was the car worth before the sale? How much was the car sold for at the sale? Provide all certified letters that were mailed out to the consumer by Texas Repossession Law. That notified the consumer what transaction was taking place on the vehicle. Under Texas Repossession Law the Consumer must have all this information and if the lender has not contacted the consumer on the sale of the car then the consumer is not liable for the remaining balance. I am asking for GM Financial to be removed off my credit report because I asked them to provide to me this information within 30 days and they failed to d so in the allotted time frame. I would like an investigation done on my rights as a consumer under Texas Repossession Law. I am providing the letter I sent to Gm Financial that they failed to return the information within thirty days ( 30 ) which is by law. For that reason the debt should be removed from my credit report because they disregarded the Law. In fact, I was not given notice when the car was to be sold. They mention it would be sold ten days ( 10 ) after the repossession in which that was a wrong date. The car was repossessed on XXXX XXXX XXXX and sold at a private auction I knew nothing about on XXXX XXXX, XXXX which is about twenty five days later. That is a violation of Texas Repossession Rights.

Consumer Complaint: Please be advised that this complaint # XXXX against GM Financial has not been resolved. I am alleging that GM Financial engaged in deceptive trade practices along with XXXX XXXX who paid GM Financial via my bill pay account. Let 's try to communicate the facts that need to be answered once again. XX/XX/XXXX, GM Financial received a car payment that XXXX XXXX alleged had the incorrect mailing address but correct GM Financial Account number. Following the XX/XX/XXXX payment, the XX/XX/XXXX and XX/XX/XXXX payments with allegedly the same incorrect mailing address and same correct account number were not received by GM Financial. I asked GM Financial to produce all internal records to prove that they did receive the XX/XX/XXXX payment with the wrong address but correct account number and to prove that they did n't receive the XX/XX/XXXX and XX/XX/XXXX payments with the correct account numbers from XXXX XXXX. I explained that XXXX Bank refuse to provide me with all three mailed, returned, and cancelled checks and therefore, I was requesting the XX/XX/XXXX cancel check from GM Financial and the XX/XX/XXXX and XX/XX/XXXX returned mailed checks from GM Financial and the XX/XX/XXXX and XX/XX/XXXX cancelled checks received by GM Financial in order to prove that they had nothing to due with the deceptive trade practices and fraud of XXXX XXXX. GM Financial refused to provide me with this material information to exonerated themselves of engaging in deceptive trade practices and fraud. GM Financial refusal to provide me with the internal documents for my car payments was based on deception and fraud. These incidents of fraud occurred before I return the vehicle in and the fraud was the reason that I return the vehicle in. Let me repeat myself, the deceptive trade practices and fraud occurred before I returned the vehicle and it was the reason that I returned the vehicle. Until GM Financial provides me with the internal car payment records specified in this complaint ; then, they knowingly and intentionally engaged in deceptive trade practices along with XXXX XXXX who also refused to provide me with the internal records and stated that the cancel checks were destroyed which is a violation of federal document retention laws.

Consumer Complaint: On XX/XX/2015, I went to XXXX in order to get a loan to re-finance my car loan with GM Financial. I was assisted by member representative, XXXX XXXX, who contacted GM Financial and obtained a loan pay off amount of {$13000.00} for my Loan # XXXX. GM Financial said that the payoff was valid up to XX/XX/2015. On XX/XX/2015, XXXX send a Treasurer 's Check in that amount to GM Financial and also requested that the title of the vehicle be mailed to them immediately ( see attached ). On XX/XX/2015, I received a statement from GM Financial showing a {$0.00} amount due ( see attached ). On or about XX/XX/2015, I received a payment reminder email from GM Financial. I reply back indicating that my account was paid off XX/XX/XXXX and I also asked whether I 'd received this email in error, but I received no response ( see attached ). XX/XX/2015, I received a phone call from XXXX asking whether GM Financial had mailed the car title directly to me. I contacted GM Financial and they told me they had not because they were waiting for the full payment on the car. I contacted XXXX again who confirmed that they had paid off the car ( see attached ). I visited a XXXX branch on XX/XX/XXXX and was assisted with the assistant branch manager, XXXX XXXX ( see attached ), who contacted GM Financial herself. It was only at this time that we learned that the original payoff XX/XX/2015 was in correct and that there was still a balance of {$330.00} due on the account. When this became known to me, I immediately made the payment to GM Financial ; and the company sent me a satisfied pay off letter on XX/XX/2015 ( see attached ). I was surprised to learn though that although I had paid off the account in full on XX/XX/2015, GM reported this as being 30 days late ( see attached ). As a result of this delinquent reporting, my credit score has dropped significantly and I have been unable to obtain credit from any financial institutions.

Consumer Complaint: Today ( XXXX XXXX 2016 ) I received a bill from GM Financial for the amount of {$7400.00} due by XXXX XXXX 2016. I terminated my vehicle lease on XXXX XXXX 2016 due to a military deployment and turned it in that same day. I received an odometer disclosure statement slip from XXXX XXXX ( Customer Relations Manager for XXXX ) upon turning in my keys. I faxed proof of my XXXX to GM Financial along with the odometer disclosure statement. On XXXX XXXX 2016 I received a letter from GM Financial stating that my account has been paid in full. I also have a screenshot that I took of my GM Financial account website which also shows there is a zero {$0.00} balance owed. I checked my credit report today ( XXXX XXXX 2016 ) and on my credit report for all XXXX credit bureaus it shows the account as paid off with a zero {$0.00} balance.

Consumer Complaint: A couple of days ago, I submitted XXXX complaints on collection companies ( XXXX XXXX XXXX # XXXX and Diversified Consultants # XXXX based on fraud ). Please note federal law dictates that failure to verify debt must be done within 5 days on notification not sixty. As of XX/XX/2016, both the fraudulent XXXX XXXX XXXX. Fraudulent debt and XXXX fraudulent debt are still on my credit report. Today, I am filing the third fraud case against XXXX XXXX and GM Financial. First of all, I am and have been a XXXX for thirty years. I pay my bills. This incident along with the XXXX others appear to be a form of surrogate retaliation for my XXXX. Due to jealousy from the purchase of a used Cayman Porsche, XXXX bank held my car payments for sixty days. As a result, GM Financial sent me a repossession letter and placed two late payments on my credit report. At first, I was somewhat shell shocked because I knew that I allowed XXXX bank via bill to pay GM Financial. I did n't detect the fraud till later and when I sought to prove the fraud as any good detective would, I was denied the XXXX and XXXX car payments cancel checks and mailing records by both XXXX and GM Financial. I returned the Cayman Porsche due to this fraud and the surrounding cover up by XXXX and GM Financial. I am requesting that the balance of debt be deleted from my credit report due to this fraud, deception, misrepresentation, and cover-up. As indicated in the correspondence by XXXX XXXX XXXX XXXX, she claimed that the XXXX XXXX, 2014 payment was accepted but it had the wrong address. And stated that I put in the wrong address, which I disputed. When I asked for the cancel checks for the XXXX and XXXX payments, she refused to provide them and stated that they were destroyed. I feel that she was lying based on the normal retention period of cancel checks being about six or seven years. I contacted GM Financial and spoke to XXXX executives in your company : XXXX XXXX, XXXX, who failed to provide me with the mailing documentation that your company received the XXXX payment with the alleged incorrect address. Nor would he provide me mailing documentation that he received the XXXX or XXXX payments. Prior to speaking to XXXX XXXX, I spoke to a XXXX XXXX ( XXXX ). I returned the vehicle because XXXX and GM Financial both failed to provide customer records to disprove their complicity in fraudulent acts to harm the customer. With only the XXXX made available, there is sufficient documentation on that check alone to question the veracity of XXXX XXXX and the integrity of her investigation. These discrepancies include : a ) XXXX, Tx. XXXX, b ) Correct GM Financial Acct # XXXX, c ) signed by XXXX Executive, XXXX XXXX, 4 ) routing number # XXXX, and 5 ) absence of proof of endorsement by GM Financial accounting staff. When the above check reflects these discrepancies, the normal thing to do would be to allow the customer to review the original XXXX, XXXX, and XXXX mailed payments by XXXX and to review the original received and endorsed checks by GM Financial. As stated, neither XXXX nor GM Financial granted me the opportunity to review records relevant to my account. Please remove the charge-off from my credit report immediately due to fraud.

Consumer Complaint: On XXXX XXXX 2016, I received an online offer for GM Financial 's deferment program. I was approved for the program that would defer payments for XXXX 2016 and XXXX 2016, and apply them on the end of the loan. This would allow my account to remain in a positive status. I was advised that interest would continue to accrue, but the late fees would be waived. I accepted GM Financial ( GMF ) offer and agreed to pay a processing fee of {$270.00} by XXXX/XXXX/16. I paid the processing fee as agreed by the due date. I was approved for the deferment when my account was 28 days past due. However, GMF reported my account as 30 days past due status to XXXX. I contacted GMF on XXXX/XXXX/16 and spoke with " XXXX '' who advised me that this was impossible, as GMF has n't reported any updated account information to XXXX. Nevertheless, I disputed the late payment with Equifax on XXXX/XXXX/16 and XXXX/XXXX/16. The following is a timeline of GMF payment status changes to XXXX : XXXX GMF reported my account as " not more than two payments past due '' XXXX GMF reported my account as " Pays as agreed '' XXXX GMF reported my account as " not more than two payments past due '' XXXX GMF reported my account as " Pays as agreed '' XXXX GMF reported my account as " 30-59 days past due '' My account is being reported as 30-60 days late with XXXX and XXXX as well. I have disputed the error with them, but my account continues to fluctuate between a positive and negative status similar to XXXX. I have contacted GMF on the following dates regarding this issue : XXXX/XXXX/16 XXXX/XXXX/16 XXXX/XXXX/16 XXXX/XXXX/16 Each time, I have spoken with a different representative, each claiming my account is not being reported late. I received GMF " credit-reporting letter '' XXXX/XXXX/16. However, the account was still being reported as negative. Thus, I submitted a complaint to GMF complaint department five days later requesting the error be corrected and I be forwarded documentation regarding its resolution for my records. I have not received a response. The account remains incorrect. I am extremely frustrated with this process. I am unable to reach a resolution by calling, writing, or disputing. I am disappointed none of the GMF customer service representatives took the initiative to take ownership to correct the issue. I have not been 30-60 days past due as the deferment was approved prior to my account being 30 days past due. Any assistance would be greatly appreciated.

Consumer Complaint: I voluntarily surrendered a car that I bought in XXXX. GM Financial Closed the acct as derogatory- charge off .... " No payment history reported to creditor '', closed date of XXXX/XXXX/XXXX. They are still reporting monthly with a last payment date of XXXX/XXXX/XXXX, past due bal of {$16000.00} .... I filed a dispute with XXXX asking them to investigate as the statue of limitations for TX is 4 years, and if the acct has been listed as closed-charge off since XXXX/XXXX/XXXX there should not be any last payments nor missed payment reported. The dispute was completed on XXXX/XXXX/XXXX, and GM added new information to the acct. They have now changed the status to open-derogatory, deleted the closed date, date of last payment has now been changed to XXXX/XXXX/XXXX, past due amount still shows {$16000.00}. No matter what date you change the last payment date to, looks like they tried to change so it would now be before the charge off, it is still past the four year SOL law for TX. They are filing inaccurate data on my report and have refused to delete it. A creditor can not just change the data on ones report to try to make it " look right ''. A 's far as the new status goes, GM Financial is the original ceditor, and no where on the older reports does it indicate that the acct was closed due to being sold to a XXXX XXXX. By placing the status back to " open '' they are trying to REAGE my acct. This is ILLEGAL. I demand this be removed from my report and they be investigated, for illegal credit reporting and retaliation for a dispute being filed.
