I purchased a vehicle XX/XX/XXXX, GM financial reported my account as included in bankruptcy ( which does n't apply to this vehicle XXXX years after a discharge ), continued taking payments up until I purchased a new vehicle XX/XX/XXXX, but states I stopped making payments XX/XX/XXXX. This incorrect information is being reported on my credit report. I have disputed this with all XXXX credit bureaus as well as GM financial who said the information is correct.

GM Financial has not validated this debt or any corrected the many inaccuracies that they are currently reporting. In fact, I do not nor ever have entered into a financial agreement with GM Financial. They have not provide their " chain of assignment '' either. I am attaching a detailed letter that GM Financial needs to address promptly.

Consumer Complaint: As power of attorney for XXXX XXXX XXXX I made car payments from his bank page think it was going to XXXX XXXX. I did n't realize that it was in fact still linked to GM Financial. He had a loan with then XX/XX/XXXX and the car was paid for. I sent XXXX They returned XXXX payment for XXXX. However following payments in the amount XXXX and XXXX were made upon receiving letter from wells that said he was behind XXXX so I paid what I had on hand knowing that I had just sent XXXX. It was never received and I have been trying since XX/XX/XXXX to get the money back from GM. Apparently they had and old address on file. I call in XX/XX/XXXX to find out what was going on after his bank said they could n't retrieve them money I would have to call GM. I was told they would update the account and issue the check. On XX/XX/XXXX I called again as I had not received checks as per first call it would be XXXX. I was told then they would put in request again and someone would call the following Mon. XX/XX/XXXX. I called again today XX/XX/XXXX cause there were still no checks in the mail. I was told they were waiting on another department to return email and they could n't give me a time frame someone would get back to me. When I asked to speak to supervisor I was transferred to XXXX XXXX 's voice mail with no estimated time of call back. At this point they have till Wed end of business to give me time line or I 'm going to court and charging interest and penalties in accordance with Arizona law they can pay court fees and whatever else the court deems fit.

Then after a two years of never missing a payment I received an email from the dealership stating since I made all my payments on time they would try to get my payments lowered. When I contacted the finance company to discuss this matter they stated they were unwilling to get the payments lowered for me and to contact someone else to get it refinanced. Now the payoff is so high based on the interest rate that I ca n't afford to trade it or sell it without taking a major loss.

Consumer Complaint: I currently have an auto lone with the company GM Financial, and even though I am slightly behind, I make my payments and even after making a payment, I will receive in excess of 6 or more phone calls a day sometimes more from them. I receive calls as early as XXXX on some occasions, on Sundays, later at night sometimes. It 's relentless harassment and I 'm less than a month behind! They really crossed the line when I found out they have been calling my ex girlfriends fathers ' home line with which I never listed him or his phone number as a reference so how they got it, and why they are calling it leaving me messages there is beyond me. This relentless consumer harassment is uncalled for and needs to end. They call from many numbers, but the most common are XXXX, and XXXX.

Consumer Complaint: On XXXX XXXX, XXXX, My truck XXXX XXXX XXXX XXXX XXXX was wrongfully repossessed by GM Financial. I was in a Chapter XXXX bankruptcy and I entered into an agreement with GM Financial which stated on page XXXX ( please see attachment ) of the court order if I am past due XXXX payments, GM Financial is to send me a correspondence giving me 14 days to cure the default or the vehicle would be repossessed. I received a call from GM Financial on Saturday XXXX XXXX, XXXX but since I was at a church event, I could not answer the call nor did the person leave a voicemail. I never received notification from GM Financial stating the payment was past due. I received notification the day the truck was repossessed from the court stating there was a motion to repossess to truck. The truck was already gone by the time I received this letter. Since this incident, I filed a lawsuit against GM Financial. During the last court date on XXXX XXXX, XXXX, the judge dismissed the case stating it was out of his jurisdiction because the court order was from Bankruptcy court and I would need to handle matters there. GM Financial 's attorney, XXXX? ( Her last name was not visible on the court order ) immediately started lying to the judge before he dismissed the case. She was also irate and confrontational because I decided to file a lawsuit in XXXX, almost 6 months after the repossession. She lied about the truck being sold by GM Financial after my bankruptcy was dismissed. The truth is I never received I never received notification from GM Financial about a past due payment prior to the repossession as agreed in the approved court order, the truck was sold on XXXX/XXXX/XXXX, and my bankruptcy was dismissed on XXXX XXXX, XXXX. I was n't clear if she was trying to say there was a statute of limitations in regards to a case such as this but GM Financial was wrong and took advantage of my situation. On the day the truck was repossessed I called GM Financial and spoke with several representatives who confirmed no letter was sent advising of the past due payment. Also, I planned to pay on that day because I was paid on that day but decided to leave GM Financial and not do business with them anymore.

I was only ever given Statements that showed I was actually over paying my lease and therefore, had a negative amount due. I even confirmed this with them on a number of occasions. I was actually told I did not owe anything! I have full documentations showing all statements, for the past three months, that show I had no payment due.
