Consumer Complaint: I let my boyfriend make a payment from my acct for his vehicle and due to his bankruptcy following month he cancellwd his payment arraignment with GM financial and turned the car over to GM. GM didnt cancel the payment and day they took car they withdrew pmnt from my acct which only money that comes into acct is my federal XXXX pmnt and daughters money. I tried speaking with them they refused to return and my bank tried to refuse payment when it occurred but couldnt. Ive tried to discuss with them but they tell me i have no relation to acct and hang up on me yet they withdrew funds from my acct that has only my XXXX dsposit. Very rude unable to discuss with them. Told me bring my BF to court then?!

Consumer Complaint: I started my financial relationship with GM Financial when they were still XXXX, in 2008. I had my share of issues with the integrity of the company, but what I am most frustrated with is they are holding my title hostage. I have been paid in full for YEARS, and yet they are still unwilling to release my title. I have spent hours on the phone with their reps and I get nowhere. It is disgusting how they have made me believe on numerous occasions that my title would be on its way to me, only to find out it was never mailed out. I feel like my hands are tied which is grossly unfair - if I were to be late with my monthly payments I would incur late fees until they would eventually repossess my car. Why are n't I, the consumer, protected in the same way? I will never do business with the terrible company again.

According to loan agreement I was suppose to be given a chance for arbitration however was never given a chance. Loan was only 37 days pass due before they repossessed it despite the fact that their policy is to repossessed after 60 days past due. But I didnt see it for over a month because I never check my mail because I do everything electronically as I am unwell. XX/XX/XXXX I receive a text from my brother in another State alerting me that I received mail at HIS house. I never lived in his house. I got nervous and assumed identify theft so I checked my credit report and saw that GM Financial CHARGED OFF my car. I tried to dispute it with XXXXXX/XX/XXXX but it is also reported as paid in full. During the call I emailed them PROOF that I had a lease extension and they illegally contacted my family. XX/XX/XXXX I receive a call from them at telling me they are repossessing the car TODAY. They claimed they never got the lease extension so I offered to resend it to them yet again. I resend it to them by email and they call me and said that it is now null and void because I filled it out wrong. I asked her for a refund ( of my monthly payment for XXXX ) and for a release ( saying they would release the charge off ) if I could return the car the car today and she said the charge off will remain on my credit unless I pay $ XXXX for the car right away. ... ... ... ... ... ... ... ... ... ... ... .. 6. Defendant : XXXX XXXX File # : XXXX Case # : XXXX XXXX XXXX, XXXX This is a response letter in reference to a summons letter I received on XXXX. This summons claims I owe the plaintiff XXXX. This also serves as a dispute letter to GM Financial and submission of complaint with the Consumer Financial Protection Bureau. GM Financial failed to follow legal procedures in repossessing the used XXXX XXXX XXXX. GM Financial practiced Unlawful Repossession procedures : 1. I was not in default on the car loan. GMs account payment history does not reflect payments made on XXXX/XXXX/XXXX for {$520.00}, XXXX/XXXX/XXXX for XXXX, and XXXX/XXXX/XXXX for {$260.00}. I have included proof of those payments reflected from my bank statement. 2. GM Financial failed to send proper notification/written notice/phone contact for pending repossession activities. 3. Breach of Peace : GM Financial hired a towing company to repossess the vehicle. The towing company forcefully broke a lock on my front gate to get to the vehicle and entered my property. The towing company smashed the trunk of the vehicle with the tow hitch. The towing company threatened XXXX and force in taking the car-told me to get out of the way or they would hit me. One of the men had a large wrench in his hand and was menacing me with it. The other was in the towing truck. The towing company representatives appeared intoxicated at the time, so out of fear for mine and my familys safety, confrontation was not engaged. The representatives did not allow me or my spouse to remove items from the vehicle before taking it forcefully. 4. The towing company damaged the XXXX XXXX extensively during towing. They smashed the trunk of the vehicle and the left rear end of the vehicle. ( XXXX claim # XXXX ) 5. While towing the vehicle, the towing company further damaged my truck that was parked near the towed vehicle. ( XXXX claim # XXXX ) 6. I called GM Financial to ask what I could do to re-cooperate the vehicle. The amount they requested was more than $ XXXX total amount that was owed on the vehicle. I was also told that I would be responsible to cover the extensive damages that the towing company did to the vehicle. They told me I would have to seek other financing means. I felt at the time, that the vehicle would not appraise correctly due to the extensive damages that was caused to the vehicle by the towing company. They failed to acknowledge payments made on XXXX and XXXX. 7. GM Financial failed to return personal property that was left in the vehicle. ( XXXX presents and personal property were in the trunk of the vehicle ). 8. The vehicle was sold extensively damaged. The vehicle was in pristine condition prior to the towing company damaging it. The vehicle appraised and sold for much less than it should have due to the damage inflicted by the towing company. GM and their repossession agents tactics are vile and unlawful. I refuse to pay for a balance on a vehicle I no longer possess ; a vehicle that was extensively damaged by their agents-therefore appraised and sold at a lower price. GM and their agents heinous acts are unlawful-I never received documentation or notification that the car was being placed for repossession. GM failed to acknowledge the vehicle was not in default. The companys agents broke and entered my property, then were threatening to mine and my familys safety. These actions were emotionally damaging to myself and my family-they repossessed the vehicle on XXXX XXXX, XXXX with the XXXX holiday just days away. I was not able to re-cooperate or replace XXXX gifts that were in the trunk of the vehicle. All this unnecessary grief and anguish over a vehicle that was not even in default. My credit has been damaged for 2 years without reprieve due to incorrect information provided to the credit bureaus by GM and affiliates. If anything, I feel I am owed and have been severely wronged by GM and its affiliates. I demand these charges be dropped immediately. I demand that GM and its affiliates submit corrected information to the 3 credit bureaus-as the vehicle was never in default. Otherwise, I will pursue my right to countersuit for statutory damages to my credit, multiple property damage, breaking and entering, emotional and financial distress. Consumer Complaint: I purchased an automobile in XXXX XXXX 2014 and was financed through XXXX XXXX where negative equity was rolled into the asking price of the new vehicle. As a result this inflated the cost of the vehicle to {$24000.00} with monthly payments of {$540.00}. Did not realize at the time of signing the impact the interest rates would have on the loan, especially in the event payment is late. I have experienced some hardship and had to either defer or pay late. In defering payments, I was charged up to half of the monthly payment just to defer payments. When looking at my last statement, after making 24 payments I still owe over {$20000.00} on a XXXX XXXX XXXX that currently values at {$9000.00}. the 24 payments paid ( + {$13000.00} ) does not include other fees paid. To add insult to injury, my last payment of {$540.00} shows that {$540.00} of it went to interest. This is killing me, and because of the negative equity in the now value of the car, I am unable to get out of this car/loan without an astronomical expense.
