Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: My XXXX XXXX was deemed a total loss after an accident on XXXX/XXXX/XXXX. My insurance carrier, XXXX, issued GM Financial a check to pay off the vehicle in the amount of {$22000.00}. A copy of this check was emailed to me and, to confirm, XXXX stated that this check was cleared/cashed by GM Financial on XXXX/XXXX/XXXX. When I log into my GM Financial account online, it still shows that I owe my XXXX lease payment ( due on XXXX/XXXX/XXXX ). When I called the number listed to speak to a staff member regarding this billing error, I was told that they do not have any record of this check. Even when I confirmed that they had cashed the check and are now double-billing for the car, they suggested that I contact XXXX ( who has n't done anything wrong ) to fix the problem. The staff I spoke to in three separate instances yesterday offered no help in how to go about fixing my account. I want GM Financial to correct their error to show that I owe {$0.00} and to also issue a letter stating that they will correct any adverse reports submitted to any credit reporting agencies because as of today, XXXX, they are stating that I am late on my XXXX XXXX lease payment.

Subissue: Billing problem

Consumer Complaint: We traded in our old car which was financed through GM Financial on XX/XX/XXXX. A new loan was originated with GM Financial the same day. On XX/XX/XXXX, we called GM as we had not received a billing statement for the new loan. The representative told us that we did not have a payment due as an overpayment on our old loan was credited to the new loan. This made our first payment due XX/XX/XXXX. Payments were made on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. We have been continuously harassed stating that we are past due and missing payments when we have paid according to the information received from the company. On XX/XX/XXXX and XX/XX/XXXX, we received threatening phone calls from your company advising that we had to pay or else. And that we have somehow racked up late fees totaling over {$200.00} and have been reported more than 30 days late. Please correct the account as we have not missed any payments. Also please coach your associates accordingly as it is not right to threaten a senior citizen who is just trying to do the right thing and making a payment every month.

Consumer Complaint: Two payments were taken out of my account when only one should have been. This put me in a bind. I called in in order to try and get a refund for the extra payment and I was told that it takes 3-5 business days in order for this to be processed and also the funds mailed paper check to my address. I advised the representative to check and see if there was a faster way for the funds to get returned to me and they were not willing to find out. I waited on hold for 40 minutes when I requested to speak to a supervisor. Then the representative returned and told me no supervisor was available and they would transfer me to their voicemail. I asked for the supervisors contact info so I can follow up as this is urgent and I was denied the request.I am reaching out as I need help. I am also going to file a complaint because the way the call was handled was not great customer service at all. Transaction were XX/XX/XXXX for $XXXX and $XXXX.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: My car payment is due on the XXXX of every month. It 's handled 100 % electronically. I do n't receive paper statements. On XXXX XXXX, XXXX, I went online to the GMFinancial website to make my payment. There was a message that the site was down for maintenance. The following Monday I attempted to call and got a recorded message that the customer service department was closed while systems were being updated. I attempted to go online and to call every day. Today, XXXX XXXX, the site went live again and GMFinancial is charging me {$220.00} in late fees ( on a {$380.00} payment ). The payment was n't made because all of their systems were unavailable. The onus for any lateness in on them - I made every effort to make my payment on time and their system would n't allow it. Additionally, I question why a late fee would be 60 % of the regular monthly payment. During the time I 've had this account every payment has been made on time and every payment has been for more than the minimum payment due. I do n't know if this is sloppy business or an intentional attempt to defraud me. I request your help in resolving this issue.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I received a call from " GM Financial '' XX/XX/XXXX, The call entailed a man requesting a payment from me for a closed, pre-paid truck lease and in receipt of payment he would not damage my credit. This prepaid lease was a 24 month lease that ended XX/XX/XXXX and I do have a receipt from dealer and gm financial of return of vehicle. He was willing to accept less if I paid 'NOW '' I then informed him that my contract was satisfied 6 months prior to his call and that no payment was due or owing. I just received informationXX/XX/XXXX, that my credit reports were updated to reflect missed payment? ( thats an impossibility ) This is my second compliant to the BBB about this company in less then a year now on two major issues. Desired Resolution : Correction to a credit report The Credit bureau reports that the last information added to gm financial was XX/XX/XXXX and sense that date someone added " missed payment 30-59 '' which just appeared on my report XX/XX/XXXX? How is that even possible?

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I 've received a notice on my credit report that I 'm 60 days past due on a GM Financial Account. I have never missed a payment ever, and I am not late. This is incorrect. I spoke to a customer service rep 3 weeks ago about this and was told that my account is 100 % paid in full, {$0.00} balance. I need this corrected. If this prevents me from obtaining credit due to their false reporting, I will hire an attorney and seek the maximum amount possible due to the false reporting & statements made by their customer service employees by GM Financial.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: In XXXX, I filed a complaint against GM Financial. I had settled a defaulted loan I had with the back in XXXX, but they had yet to update this account as resolved on my credit report yet. Today, I received a letter from GM Financial, essentially stating that they have not updated my account yet, because I disputed it. Also, as of today, they are still reporting the account as unresolved on my credit report. For reference, I am attaching a copy of GM Financial 's recent letter, and also a copy of my settlement and payment receipt from XXXX. First of all, GM Financial 's claim that they can not report accurate information about my account because I disputed it is completely bogus. As is my right under the Fair Credit Reporting Act, I have the right to dispute anything that is inaccurate on my credit report. GM Financial does not have to right to " punish me, '' simply because I wanted correct information reported. Also, they did n't even address the fact that they are still reporting incorrect information on my credit report, more than 3 month after-the-fact.

Issue: Problems at the end of the loan or lease

Subissue: Termination fees or other problem when ending the lease early

Consumer Complaint: I leased a new XXXX XXXX from General Motors Financial Company , Inc. ( " GM Financial '' ), and they are continuing to deduct lease payments from my bank account even though, due to an accident, my car was declared a total loss and the lease was terminated. I leased my XXXX XXXX from GM Financial in XXXX. On XXXX XXXX, XXXX, I was in an accident. We notified our auto insurance carrier and our XXXX dealership of the accident that day, and GM Financial early the following week. My insurance company inspected the car on XXXX XXXX, XXXX, and declared it a total loss the same day. That same day, XXXX XXXX, XXXX, my wife again spoke with GM Financial. GM Financial knew about the accident, had spoken with my auto insurance company, and already were in the process of working with their gap insurance company to cover any portion of the resulting loss that would not be covered by my insurance carrier. Also on XXXX XXXX, XXXX, during that same phone call, GM Financial told my wife that we were responsible for the lease payment for XXXX XXXX because our auto insurance company declared a total loss after that payment already had been scheduled with my bank ( which we said was fine ). We were told there would be no additional lease payments. On XXXX XXXX, XXXX, GM Financial - without authorization - deducted another lease payment from my bank account. I attempted to contact GM Financial by phone on XXXX XXXX, XXXX to resolve this issue. They have a recording saying that due to a system upgrade it is impossible to speak with a customer service representative until XXXX XXXX, XXXX. I was unable to speak with a person or access my account electronically. On XXXX XXXX, XXXX, I also sent GM Financial private XXXX messages - their suggested message for contacting them until XXXX XXXX, XXXX - including a description of the problem, my name, my address, the date of the unauthorized payment, the exact amount of the unauthorized payment, and the last four digits of my social security number. On Monday, XXXX XXXX, XXXX, I received a response telling me that " we are unable to review your account. '' GM Financial has yet to resolve the situation or even contact me to discuss.
