Subissue: Account status incorrect

Consumer Complaint: Called GM Financial three times asking when they were going to send in an update to the credit bureaus reporting that my car loan was paid off. Every time I kept getting the excuse that it would show up next month as paid off. I paid off my car load XX/XX/2018 and have received the title. My third call to GM today, XX/XX/XXXX, the customer service rep admitted that the new system they instituted was causing compliance problems and they could not get it through electronically. My credit score is negatively impacted because of this delay as it still shows an outstanding car loan balance reported on ALL THREE credit bureaus!

Issue: Problems at the end of the loan or lease

Subissue: Problem with paying off the loan

Consumer Complaint: I made a payment for {$260.00} on XX/XX/2017 to my GM Financial Auto Loan. At the time of this payment. My prinicpal and interest payoff ( excluding late fees ) was {$250.00}. According to GM Financial 's payment hierarchy, the payment ahould have been applied to principal and interest first, then any overage gets applied to late fees. GM Financial put thjs payment 100 % to late fees which is causing me to show past due for a principal balance that I should not owe. Under the fair credit reporting act, late fees are not a reportable debt. GM financial promised to rectify this issue inXX/XX/XXXXby reallocating the XX/XX/XXXXpayment to principal and interest and updating my credit report. This has yet to be done and is preventing from getting approved from credit. This is a missapproriation of funds, and GM financial needs to take care of it.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: GM Financial was paid in full in XX/XX/2018. I have called, disputed it with the credit reporting agencies, ( XX/XX/2018 ) that the loan is paid in full but still shows open on my credit report. When I called GM ( XX/XX/XXXX & XXXX ) they states that they didn't do updates bcuz they were switching over to a new system which is unacceptable to me. It has affected my credit. When the credit reporting agency contacted them they told them it will be corrected but it's been months and it's still not reported correctly. I called XXXX again ( XX/XX/XXXX ) today & they are still giving the same story. I was also told in XXXX, I will get a Paid If Full letter, it was not generated so I requested it again today. I'm trying to get a mortgage & having 2 open car loans when I only have one is a issue. It's showing my debt higher than what it actually is. Please help. Consumers should not be penalized for XXXX XXXX issues

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I have an automatic recurring payment set up with the company. Since the beginning of 2018 when they changed their system the additional money I pay each month does not go toward paying down the balance on the loan. Instead they apply it towards the next months payment. Each month I call to have them apply the excess payment to the balance of the loan and not towards the next months payment.

Issue: Getting a loan or lease

Subissue: Problem with a trade-in

Consumer Complaint: I purchased a vehicle from XXXX XXXX in XXXX, PA. I purchased the vehicle in XXXX. As of XX/XX/XXXX, my lender ( GM Financial ) has not received the title on this vehicle and I have not been able to register or drive it. We have received the registration. However, the XXXX XXXX have not held up it end of the bargain of as far as getting the check engine problem fixed and he provided a receipt of we owe. After we filed a complaint with consumer complaint he went into action. On XX/XX/XXXX he called and agreed to take a look at why check engine light was on for 3 months. He told me to take it to XXXX XXXX XXXX. I took the vehicle on XX/XX/XXXX at XXXXXXXX XXXX. I left my vehicle and my witness came to pick me up. I kept in contact with XXXX the owner of XXXX XXXX he assured me he was going to fix the check engine and check on the issue. I communicated with XXXX daily, when it was time to pick up my car XXXX also said I have a massive leak in the front of the engine. On the XX/XX/XXXX I picked up my vehicle with an attachment of a nightmare, because XXXX tried to charge me {$55.00} for maintenance. When I refused, he said was not releasing my vehicle. My witness and I had to call the police to get my vehicle back, as well as call XXXX. When I contacted XXXX, he communicated with XXXX to release the car and he will pay for everything. He also stated he will investigate and take care of why the check engine like is staying on. After this ordeal it has been very difficult to get in contact with XXXX. He has been giving me the run around. And nothing has been resolved. I contacted him today and he stated he would fix the problem. I believe it is too late. As of XX/XX/XXXX I had to tow my car to his dealership, because I was informed that my car died. I have a warranty that is not helpful and a dealership who sold me a vehicle that stop working after 3 1/2 to 4 month. And I know is a law against that, I am not sure where to start. Hopefully your agency can lead the way. I want to continue be proactive in my complaint filing. I have now found the dealership and I drove the car to the location with a promise he would provide a loaner. I drove an hour to his location and no vehicle was provided. I am paying for a vehicle I can not drive. Because it was faulty and dangerous. I almost died, because my vehicle stopped in the middle of the road. And with my belief system in XXXX who sold me the car to drive. And he assured me it was going to be okay. It left me stranded for 3 hours. My loan is with GM Financial Acct. # XXXX. I want to get out from under this untenable situation but do not want to end up with a repossession on my credit file.

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: This inquiry was unauthorized. I have contacted all three credit bureaus as well as the company in question about removing these unauthorized transactions from my credit report. Whenever I am calling, I am told to just wait the 2 years for the inquiries to fall off and there's nothing that can be done to remove them. I have asked for company to provide documentation that shows where I authorized these inquiries, and the companies have refused to provide documentation, as well as refused to remove the inquiries.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: In XX/XX/XXXX my car was financed thru GM Financial and my last payment should have been in XX/XX/XXXX. However, I disputed the amount GM Financial tried to collect from me and refused to pay after they threatened to repossess my car and damage my credit rating. I immediately discontinued all further contact and made no further payments. This account was then closed/charged off in XX/XX/XXXX by GM Financial at which point I began getting collection calls from their representatives and collection agencies. When I asked the collection agency for a Debt Validation report because the amount GM reported as owed was in error, I never again heard anything from either the Collection Agency or GM Financial. EVER. Not one single word. In XX/XX/XXXX, I decided to purchase a new vehicle and my dealership advised the best course of action would be to turn in my vehicle to them ( they would have it picked up by GM Financial 's agent of choice ). This was done and in XX/XX/XXXX, I contacted GM Financial to discuss a settlement so that I could pay a fair price for the remaining debt and move on with my life. We agreed upon an amount and I paid it over the telephone. ( Copies attached ). I also have a letter from GM Financial in which they explicitly state that the settlement terms included the agreement that neither party would attempt to file any further charges, lawsuits, etc. against each other. However, after GM Financial received their monies, they backdated and made changes to my credit report and continued to do so. I should not have " CHARGE OFFS '' and BAD DEBT notations on my report ... month after month ... beyond the date my account was closed. This is a violation of my rights and is an example of a company using their power to harass me thru the illegal reporting of incorrect data to the CRA 's. Fortunately, XXXX does not allow this practice and has corrected the account based on my previously filed grievances.
