Issue: Problems at the end of the loan or lease

Subissue: Excess mileage, damage, or wear fees, or other problem after the lease is finished

Consumer Complaint: After turning the vehicle in at the end of my lease, vehicle was XXXX miles under allotted miles, vehicle was in great shape. Received letter from GM financial on itemized breakdown of the remaining amounts due on my account. No charges on excessive wear, past dues, lates fees etc. but I was charged on one fee and that was, a Disposition Fee. I was not informed at the time of signing about this fee, this fee was buried in with all the other lines and numbers, a total of approximately 100 different entries and was not reflected in the final numbers at the bottom of a 2 foot lease. Also, when looking for the definition of, Disposition fee, I found it under the return of the vehicle about two thirds into the XXXX worded back side of the lease, one small line stating, " the item 4A disposition fee unless this fee is waived under item 23 ( t ). ( 4A being the disposition fee buried on the front of the lease as I stated earlier in my letter but fee not being shown in the final numbers. ) Now going down to 23 ( t ) it states, Disposition Fee Waiver : The item 4A Disposition Fee will be waived if you purchase or lease a NEW General Motors vehicle when this lease ends. NOW think about this, I am being charged {$390.00} dollars for Disposition fee, .XXXX XXXX for past due payments, and {$23.00} for tax, Totaling {$410.00} dollars due. because I didn't buy another vehicle from GM. This is legal extortion!!!!! How can a government allow a company to charge someone a large expensive fee because they either could not afford to purchase a new vehicle again or was not happy with the vehicle ( GM ) they purchased. When I told GM financial in a phone call that this fee was not presented to me at the time of signing and I did not initial the disposition fee line stating that I was aware of this fee, that this was legal extortion and I would not pay the XXXX. They, GM financial then stated that this would go on my Credit Report for non-payment. Now, I own a restaurant, why should I not be allowed to charge a customer of mine a disposition fee of XXXX bucks because I found out that they went to a competitor of mine and purchased a sandwich from them. I believe this action by the BIG companies should not be allowed and the government needs to step in and stop this practice. I have filed a complaint with the Attorney Generals office, my local State Representative, XXXX XXXX, my US Senator XXXX XXXX and now here. Thank you for your time, XXXX XXXX, XXXX, MI. XXXX XXXX

Issue: Struggling to pay your loan

Subissue: Denied request to lower payments

Consumer Complaint: I call GM about helping me out with my Lease payment, since I lost 66 % of my income and they said that the only persons they are helping are those customers that have finance their car and not the people who have a Lease them. I think that's unfair since both have to make car payments. I feel GM talks lot and dose very little to help all customers.

Issue: Problems at the end of the loan or lease

Subissue: Termination fees or other problem when ending the lease early

Consumer Complaint: I leased a XXXX XXXX XXXX in the fall of XXXX from XXXX XXXX ( XX/XX/XXXX ). XXXX XXXX was the sales representative. I would be in the United States for a limited time, probably three years. During that period, my wife would fulfill her XXXX requirements to obtain XXXX XXXX. After this, we would return to XXXX where we live. At about the same time, XXXX XXXX was sold to a hedge fund and its name changed. My wife received her XXXX on XX/XX/XXXX. And we began preparations to return to XXXX. On XX/XX/XXXX, I telephoned Mr. XXXX to advise him that we would be leaving and get information about the protocols regarding the lease. I subsequently met with him on Friday, XX/XX/XXXX. He advised me that there would be no problem with the lease since GM had an early return program that allowed for vehicle turn-ins up to three months before the end of the lease. Since I was returning to XXXX, he knew I would not be leasing another automobile. Furthermore, I remember he also made a comment in passing that XXXX would mark the last monthly payment. I found that odd. And I also found it incorrect. XXXX was the last installment, paid to GM Finance ( {$480.00} ). All installments were automatic-payments through my bank, XXXX. After the XXXX payment, there were no further payments dispensed to GM. I presumed that the lease was over, just as Mr. XXXX had described. Afterall, some entity in the payment-chain had notified my bank, or no expected further payments to be made. Who did it? GM Financial? XXXX? XXXX XXXX XXXX? The hedge fund? Who? The car was turned in on Monday, XX/XX/XXXX. It was in very good condition with low mileage ( XXXX miles ). The next day we flew to XXXX. And life continueduntil A received a call on XX/XX/XXXX regarding lease termination documents. I never received any except a document dealing with mileage and the turn-in condition. That was given to me upon turning in the car. Another call on Friday, XX/XX/XXXX, told me that I had to pay the three months of installments, despite what Mr. XXXX had earlier told me. I then sent an e-mail to XXXX, recounting his earlier conversations with me, as described at the top of this letter. These were my last sentences to Mr. XXXX : I am concerned, amazed and embarrassed that, for some reason, I was mis-advised. And expensively so. I am sure that my recollection of our past conversation is accurate. Please explain. I still await Mr. XXXX acknowledgement. So maybe someone in senior management could ask him? With the ending of the monthly payments in XXXX, I assumed that GM Financial was satisfied with the deal as explained to me by Mr. XXXX.

Issue: Unable to get your credit report or credit score

Subissue: Other problem getting your report or credit score

Consumer Complaint: I filed a complaint against my auto financing creditor, GM Financial in XXXXof 2018. Gm falsely claimed I was not making payment on my car lease even though my monthly mailed statement said I was always current and never behind. This action heavily impacted my credit score dramatically so I filed a report with the CFPB. After the investigation was complete GM was made accountable for their wrong doing and said in XXXX or XXXX of 2018 that they would correct their allegations and let the credit bureau be aware of the error, and could take 45-90 days for the corrections to be made on my credit report. It has been a year and a half now and my score has not changed nor has that error been removed. I reached out to GM Financial on a couple occasions and they say I am, and never, had an account with them. At this point the car dealership had told me to file another complaint to get this error rectified. Thank you.

GM Financial never sent the closing statement for final payment. I called in twice in the following 5 months and was told the closing statement had not been generated. I asked for explanation and I was told they had sent out closing statement in mail and called my cell phone. However, I have never received the closing statement in mail and gotten any voicemail from GM financial. I never pick up phone # s that's recognized. however, I've never received voicemails left by GM Financial. Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: In XX/XX/2017, I began a 3 year lease and set up an automatic payment with GM Financial with my checking account. For the 3 year period, I made payments as planned. The last few payments I made were not accepted by GM Financial. They claimed that a tax change to the lease changed the payment amount so they could not accept payment. When they began calling from unknown numbers, I was traveling and did not pay attention to this until a few weeks later. GM Financial refused to accept payment and reported to the credit bureaus that I was missing payments. This should not affect my credit score and I asked GM Financial to rectify the error. Even though the remaining lease amount was paid in full before the end of the lease, they refuse to even make an attempt to change my record. I've disputed the issue with the credit bureaus and most I've heard back is that GM Financial told them that the erroneously reported late payments are correct. I never missed the lease payments and was making them on time. GM Financial is at fault ( if anybody ) for refusing to accept my payment, but they took it a step further by putting a negative mark on my credit report. I should not have bad credit for missing phone calls. Attached is a statement from the beginning of the lease showing an auto payment deduction from my checking account.

He said he was going to be sending in the correction to the bureaus immediately. Yet this is still reporting 6 months later and is really hurting me.
