Consumer Complaint: I live in XXXX California and on XX/XX/2023, I mailed out my monthly payment for my XXXX XXXX to XXXX XXXX XXXX located in Arizona. I was sending the company my XXXX payment in the form of a Cashier 's Check, so there would be no delay in posting it. The cashier 's check was self-dated for XX/XX/2023 and it was issued by XXXX XXXX XXXX Once I received the check, I immediately dropped it off in the US mailbox outside of the bank, which has a pickup time of XXXX sharp. On XX/XX/2023, I decided to log into my XXXX XXXX account and view my credit reports to see what balances were being reported on my credit cards and immediately noticed my credit score on the credit bureaus had dropped XXXX points. I immediately scanned my entire consumer profile and noticed XXXX XXXX XXXX ( aka GM Financial ) had marked me 30 days late on my car note. In 25 years, my credit has been flawless, I've never missed a payment or defaulted on a loan. The following morning, I contacted GM Financial to find out what's going on and they said I was 34 days late on my car payment. I said that's impossible. I said I sent the payment out on the 15th and worst-case scenario it would have been there no later than Sept 19th. The rep replied, we show it arrived on the 23rd. I said there's no way possible it took 8 days for my car payment to go from XXXX XXXX to XXXX. I said I even sent you guys a cashier 's check, which acts the same as cash and the payment should have been credited immediately. He replied back they have no record of that. I said that's impossible. I said was my payment just sitting for days in your po box , instead of being credited to my account. He didn't respond back. All he said was we show we received it on XX/XX/2023. I said you guys just screwed my credit. I want the 30-day late payment removed from my credit report immediately. This is your guy 's screwup, not mine. I said my payment was there on time, but I'm willing to bet one of your employee 's neglected to go to your po box and retrieve my payment and other customers payments which were there on time. He didn't respond back. I said your company 's going to remove that 30-day late payment from my credit report or I'm going to take every possible legal action against you. The conversation ended with no resolution. That afternoon I sent GM Financial, XXXX, XXXX, and XXXX all letters including copies of my cashier 's checks, which show the XX/XX/2023, date on it. Because of GM Financials employees and their ability not to do their job properly their customers are the ones paying the price. After 25 years of clean credit, they destroyed it. I want that 30-day late payment removed from my credit reports immediately. Thank you.

Consumer Complaint: In accordance with the Fair Credit Reporting Act, the following list of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. I have requested XXXX, XXXX, and XXXX to reinvestigate these accounts : XXXX XXXX GMFNANCIAL XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX However, they stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ) they are suppose to modify accounts if it isn't reporting correctly. 15 U.S.C 1681 section 602 A. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions 15 U.S.C 1681c. ( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Also they aren't even in compliance with XXXX XXXX credit reporting. I have evidence to prove my case.

Consumer Complaint: XX/XX/XXXX i purchased a new car financed with gm fianncial and made all payments on time leading up to accident that occurred and totaled the vehicle with a drunk driver in XXXX of XXXX ( i was not at fault ). XXXX XXXX promptly sent them a check for roughly XXXX that was received by GM cleared on XX/XX/XXXX and received prior. I called the GM financial every single day after this check was received for the month of XXXX and half of the month of XXXX asking them to please apply the payment to my balance so that I could get a new vehicle. It was impossible for me to get a vehicle with my credit looking like I just took out a loan for a vehicle 10 months before that, and hadnt paid it off yet. The difference was paid XX/XX/XXXX and when I spoke with someone at GM financial, they let me know that my account was satisfied in full and then I would be receiving a payoff letter within a few weeks. I never saw my payments applied to the account until XX/XX/XXXX. After GM financial accrued interest on the principal balance as well as late fees for 3 to 4 months after the vehicle was paid in full and loan was satisfied. I didnt know any of this until XXXX when it all came up on my credit reporting saying, I had a charged off account and defaulted on my loan. They had three months of late payments and listed it as a charge off. This has severely damaged my ability to do anything in my life ever since that day. It has sabotaged my ability to move forward, or make any moves with my business, because I am constantly having to fight the charge off that was never actually a charge off. I did all the right things and worked so hard to keep my end of the deal straight on the contract. However, GM financial has severely damaged, my ability to move forward with my life. By the way they have miss handled my file and for the past three years continue to keep these in accurate remarks on my credit report. I have proof and have provided them with proof and they also have proof on their end that everything was paid in XX/XX/XXXX. It is now XX/XX/XXXX and Im still dealing with the repercussions of them and accurately reporting on my credit. I was able to get them to remove it from XXXX XXXX due to all the inaccuracies, but it remains on my XXXX and XXXX has a charged off account. Please help me remove this and correct predatory GM financial. It has been the hardest part of my life just trying to overcome what theyve done to my credit even having the account paid in full less than a year after taking the car loan out in the first place. That is the type of behavior they should be rewarded on credit not punished and lied about for years, so that I am in able to utilize the fruits of my labor and rather stay waiting to have my record cleared of things that I did not commit.

Consumer Complaint: I have had a GM Financial loan for many years. I have always paid by check. Over the last 2 years, GM was making it very clear they were trying to eliminate paying by check- they first mailed out my billing statement with only 4 days to spare before my due date. So for the last year I have gone paperless and printed out my statements 2 weeks in advance. I have mailed my check on time for 4+ years - never missed a payment or was late - all by check. This month, XX/XX/XXXX - my due date- they have not cashed my check. I mailed it 12 days ago and all the other bills I mailed out received and posted payment. I know they have received it, they've received my checks for 4+ years. So I called on XX/XX/XXXX and asked why they haven't cashed it. They claimed they never received it. I asked to speak to a manager, they wouldn't let me talk to anyone. Today, XX/XX/XXXX, I went on their online chat - spoke to XXXX. She would not address where my payment was, only referred to last month 's payment. I asked to speak to manager, she put me on a 792 minute wait time. They won't address anything, won't let you talk to management and are lying. This is my credit, this is my life they are messing around with. I want them to be held accountable for their negligence and damaging people 's credit.
