Consumer Complaint: bought the car XX/XX/XXXX from XXXX XXXX XXXX XXXX first payment was to be XX/XX/XXXX. GM Financial reported to credit bureaus first payment was late and due XXXX. then they continued to call XXXX times a week and every month XX/XX/XXXX was when i requested a payment history and found that i had multiple payments made that had not been posted. I contacted GM Financial and provided them with XXXX payments that had not been applied to my account. they requested i send copies of conformation of payments made in an email. I scanned in all documents and sent the email to the address they provided. XX/XX/XXXX i received mail from GM Financial stating they are starting the process of reposing of the car. it was at that time i called to find out about the missing payments and what we need to do. they said i would have to refinance the car and they sent me paperwork at that time via email and told me to sign paperwork and said i would not have to worry about them calling me every day and my payment would not have to be made at that time for the rest of the month. i have been calling to find out why payments are missing but never get this issue resolved. i have submitted documentation multiple times and I am never contacted after providing everything requested. I had made arrangements with the auto dealership that after 1 year I could bring in the car and trade it in for a more suitable one but only after my credit was established. i was unable to fallow threw with the arrangements due to GM Financial reporting that I am behind on payments. This had been an inconvenience for our family. we have had to rent vehicles to continue with the responsibilities and obligations. I reviewed my credit report and found why I was not able to trade in the car for a more suitable vehicle for my family as scheduled at the time of purchase. as of today, i have not heard from GM Financial regarding any proof of payments I emailed in at their request. as of this year, my credit reports now reflect that i was never behind on payments and reflect all payments were made. THAT DOES NOT HELP ME NOW BECAUSE OF THE FALSE REPORTS ON MY CREDIT REPORT THEY CAUSED OUR FAMILY THE DENIAL OF A MORGAGE AND CAUSED LOSS OF INCOME BECAUSE I DO NOT HAVE THE MEANS OF HAULING A COOKER THAT IS USED TO RAISE MONEY FOR NON-PROFIT ORGANAZATIONS WITHIN THE COMMUNITY. Consumer Complaint: Be advised this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g stating your claim is disputed and validation is requested. This is NOT a request for " verification '' or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request your offices provide me with competent evidence that I have any legal obligation to pay you. At this time, I will also inform you that if your offices have reported invalidated information to any of the 3 major credit bureaus ( XXXX, XXXX or XXXX ) this action may constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you and your client for the following : Violation of the Fair Credit Reporting Act, Violation of the Fair Debt Collection Practices Act, and Defamation of Character. It is not permissible to fail to validate these reporting accounts as unverified information without providing any proof within the time frame specified by law

Consumer Complaint: Letter dated XX/XX/2023 from GM Financial Services that they are accelerating the loan in a vehicle I was behind on payments but cured the amount, the late charge of only {$90.00} was applied to the payment I made, and no letter was sent to me or an email that I there was a late fee assigned to the payment, instead they send a threatening letter demanding payment of {$90.00} or the note would be accelerated on XX/XX/XXXX, or in other words, they would repossess the truck, which I have alot of monies tied into. This is the same company who calls every day after the due date of the payment, sometimes twice a day including weekends. XXXX XXXX Veteran self employed as consulting engineer who has close to XXXX XXXX owed to me from two deadbeat clients, not GM Financials problem, but I told them payment was coming and it was made, this letter is a show of threat and of a big company bringing their might upon a consumer without proper notice or consideration one would expect, {$100.00} gets my truck repossessed, thats XXXX folks, are they within their rights, sure they are, does it illustrate how cold and uncaring they are or that they could have sent an email reminder rather than this letter which is beyond harmful and its on my credit bureau I'm sure,, {$90.00} XXXX dollars,,, unreal, I get the letter 4 days before the drop dead date, that's bad business practices, I plan on getting my bank to take the note over, I cant deal with this kind of XXXX as a XXXX Vet who is fighting VA for {$900000.00} of back XXXX pay, you see I know what it's like not to get paid, and these jokers pull this XXXX over {$90.00}?? They could have brought this to my attention by email, phone call or other means than this intimidating letter,,, I get the letter on the XXXX a XXXX, letter is dated the XXXX, repossession is for the XXXX,,,, its like they are setting me up to ail almost,,, ,Shame on them, Shame!! I am seriously considering suing them

Consumer Complaint: I had a car with GM finacial. I have never been late on payments. The car was in the shop for months. I never got a notice of when it was expected to be out of the shop. The shop contacted me to pick up the vehicle. I was out of town for work and could not make it back in the same week. They contacted gm finacial and gm finacial voluntary repossessed my vehicle without my consent or any notice at all. Then sold my car at auction and charged me for the remainder of the loan. Not giving me any payment options and automatically charging it off. Compleatly ruining my credit. The representative was rude and disrespectful.

Consumer Complaint: I have never been late with their company just this once. I contacted GMC financial on this matter. I sent over documentations regarding my father who was on his deathbed and he did not have insurance, and I had to literally pay all of his medical bills out of pocket. I asked if GMC could extend the date and I will pay them when my next paycheck comes. I sent over a letter from the doctor and the nurse, including his bills which is a violating from HHIPA. GMC had no remorse to the letters or my family tragedy and I feel like that was unfair because Ive never been late. This was a life or death situation either pay them and my dad dies. If GMC could just remove the late fee and stop assassinating my character to other companies that pulls my credit report. GMC are making other companies believe that I dont pay my bills on time and thats not true.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' 15 USC 1681 section604 a section 2 " any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' The financial institution and the Consumer reporting agencies do not have my consent to furnish my information and they do not have my written consent.15 USC 6802 ( b ) ( c ) I do not consent and revoke any and all verbal, non-verbal, written, implied, all assumptions to disclose nonpublic personal information to a nonaffiliated third-party " 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at anytime. '' I am opting out of your reporting services.

Consumer Complaint: Gm financial has been reporting late payments on my credit. I didnt give them authorization to release my personal information This has impacted me tremendously and my ability to progress in life. I know that As per FCRA the late payments are in violation of the Fair Credit Reporting Act ( FCRA ), specifically 15 US Code 168la ( ) ( a ) ). According to the FCRA, late payments should not be reported as negative information. However, upon reviewing my credit report, I discovered multiple inaccurately reported late payments. This incorrect reporting adversely affects my creditworthiness and hinders my ability to obtain favorable credit terms. I feel as though In accordance with the Fair Credit Reporting act GM FINANCIA L act XXXX XXXXXXXX has violated my Rights. 15 U.S.C 1681 section 602 A states i have the rights to privacy 15 u.s.c 1681 Section 604 A section 2 : it also states a consumer reporting agency can not not furnish an account without my written instructions. 15 U.S.C. 166b A Creditor May not treat a payment on a credit card account under an open end consumer plan as late for ANY REASON 15 U.S.C. 1681 section ( a ) Accuracy and fairness of credit reporting The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. U.S. Code 1666b - Timing of payments. A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. These laws are governed to protect the rights of the consumer.Im sending this letter out demanding that you either remove all late payments from reporting with all CRA or remove the account from all CRA from reporting inaccurate information. As per the FCRA, I expect a response within 30 days, acknowledging the receipt of and informing me of the actions taken to address this issue. Additionally, I request an accurate copy of my credit report once the corrections have been made.
