Consumer Complaint: I XXXX XXXX, natural person and consumer, have an open dispute with GM Financial regarding an unlawful contract based on obvious TILA violations regarding the Finance charge. My account with GM Financial had an account balance of {$0.00} as of XX/XX/2023. On XX/XX/2023 GM Financial illegally tracked my vehicle, breaking my right to privacy, and Stole my Vehicle that I use for personal, family, and household needs. This theft was in retaliation to me enforcing my rights under the Truth In Lending Act. I have a current arbitration case with American Arbitration Association case # XXXX. GM Financial is in breach of contract by not adhering to the Arbitration clause in the contract. They are causing great injury to me and my family. It is my belief that GM Financials Attorney XXXX XXXX has advised them to take unlawful action against a consumer under the color of law. A violation of 18 USC 242. GM Financial is guilty of tax fraud by reducing their tax liability through the inaccurate calculation and reporting of the Finance Charge associated with the contract in question. The Finance Charge on the contract attached is NOT the sum total of all charges payable as defined 15 USC 1605. They have also received tax credit for a profit loss write off and then unlawfully seized property that was not rightfully theirs.

Consumer Complaint: I have been paying for my car with GM financial for over 3 years I have just paid off my {$38000.00} student loan and have been tracking my credit on credit sesame very carefully. I took my last deferment for XXXX and XX/XX/2023 with GM financial and starting XX/XX/XXXX I was to go back to my normal {$280.00} payment with GM financial. I have screenshots of the conversation I had with the representative in XXXX saying that I only needed to pay {$110.00} something and I would be deferred for XXXX and XXXX and to start making payments again XX/XX/XXXX. This means that if I were to pay the {$110.00} in XXXX I would have no late fees for XXXX and XXXX and starting XX/XX/XXXX I will go back to the normal payment. I have photos of the conversation with GM financial I have photos of the payment that was made that I promised and I have photos of my dashboard from GM financial as that is how I make my payments. I have been watching my credit very carefully because I just paid off my student loans with credit sesame and according to them I am 2 months behind on my car payment and I am in Jeopardy of losing my car by repossession. I continue to get on GM financial and all of my statements say that I have over {$100.00} in late fees and I owe over {$400.00} right now which is totally incorrect. I was supposed to make my regular {$280.00} payment XX/XX/XXXX and I have proof on the GM financial statement and for my bank account that shows I made a payment on XX/XX/XXXX of XXXX. My GM financial dashboard as of today says that I am behind 2 months still and I owe over {$400.00}. I have tried numerous times even calling as I don't like to do because that leaves me no proof of anything to try to get this situation dealt with I need to make my XXXX payment but it still says I'm 2 months past due and nobody from GM financial will help me I have constant creditors calling my cell phone so I rarely answer my phone if it's a number that I don't know I also had someone call yesterday and threaten repossession. If you could contact me by email first and then I will call you back that would be appreciated as I don't answer my phone call because so many creditors are calling me right now I'm very nervous my car is going to get taken from me and I just want what is owed to me and that is my dashboard saying what I really owe no late fees and it taken off my credit report I just want to make my payment. Okay hold
