Issue: Managing the loan or lease

Subissue: Problem with fees charged

Consumer Complaint: Lease ended XX/XX/XXXX. All monthly lease charges have been paid. GM Financial sent a past due notice of {$1700.00} on XX/XX/XXXX without any invoice, details, or support of the charges. I talked with a Customer Service Rep and asked for the info. I sent a note on XX/XX/XXXX asking for the invoice. No invoice was received. GM sent another past due on XX/XX/XXXX again without any description of what this charge was for. On XX/XX/XXXX I sent a note asking for this info. GM did not respond or send the info I requested. Now they have reported my account as delinquent to the credit bureaus impacting my credit.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I took delivery of my new vehicle on XX/XX/XXXX. The vehicle was financed by GMC Financial. The first payment wasn't due until XX/XX/XXXX. I made payments on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The required payment is {$300.00}. I paid {$310.00} on XX/XX/XXXX and {$320.00} on XX/XX/XXXX. GMC did not apply the overpayments towards principal. I called customer service to find out why. I was told any time I make an overpayment I would have to call them. The average wait time is approximately 20 minutes. I found this process unacceptable. I contacted GM 's executive response team. I spoke with " XXXX ''. He basically told me the same thing as their customer service representatives. He seemed frustrated when I told him this was not acceptable. He gave me his direct # XXXX. When I found out neither overpayment was applied to principal I called his #. There was no answer so I left him a message. He never responded. On XX/XX/XXXX I sent a certified letter to Ms. XXXX XXXX, CEO GM. On XX/XX/XXXX I got an email from XXXX of the Executive Response Unit. She said she just tried calling me. This was not true. I called and spoke to her. She stated GM Financial does not have an executive team that can address my concerns. It should be easy for them to add an option to their payment website to alert them to when I make an excess payment. They don't care because making as much in interest is their " Only '' goal.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I submitted several disputes with each credit bureau. I have been a victim of identity theft and as a result my personal information was used and compromised. Several accounts showing on my credit report are listed as a result of identity theft. I have contacted XX/XX/XXXXand they are refusing to remove these fraudulent account as well as XXXX and I am not able to gain access to XX/XX/XXXX so that I can dispute these fraudulent accounts with them as well. I have submitted a verified police report as well as an FTC affidavit as verification of being a victim of identity theft. When contacting XX/XX/XXXX I was told by a representative of the Specialized Fraud Department, that once a dispute is submitted and the company says that the account is yours they will not remove it. This has caused me a major hardship, because my information was stolen and I have been victimized.

Consumer Complaint: Creditor was advised of personal difficulties regarding reduced employment and lack of financial ability to satisfy debt due to COVID-19. Creditor indicated account deferral was available and - notwithstanding said deferral - subsequently reported account delinquent to the credit reporting agencies ruining an otherwise perfect credit history. Creditor should investigate and correct account history consistent with protections available for those negatively impacted by COVID-19.

Issue: Getting a loan or lease

Subissue: Fraudulent loan

Consumer Complaint: On XX/XX/XXXX, I took my daughter to purchase a care at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, IL XXXX. As a consumer, I was apprehensive as most because of the stigma that is associated with car dealers. However, I had already done a preapproval with a loan provider that I trusted. the loan provider advertised the car at XXXX XXXX for XXXX $ XXXX. Given that my father works for GM we are entitled to a employee discount, before going to the dealership we called them and informed them of the discount and inquired if the discount would be applied to the advertised price and we were told that it would. After being told that piece of information we went to the location and went through the standard price haggling. When we presented the advertised price, the salesperson proceeded to say that dealerships have to advertise the car with all of the possible discounts to be competitive with the area dealerships. I thought that was deceptive marketing. What is the likelihood that you will qualify for all of the compounded discounts..student, soldier, first responder, GM owner, etc ... Nonetheless, my daughter was eager to get a new car. So we continued the conversation about the price. It was then we were told that the GM discount can not be used in conjunction with the sales price. Again, we were given false information. Though, I should have walked out, we still moved forward. I was told that in order to get an additional $ XXXX off we had to use GM financing. As I previously mentioned. I had already been approved from another lender. So when I was told that we had to use GM financing, I hesitated, but agreed to under the terms that they would ONLY submit my loan authorization to 2 institutions. I stated this NO LESS than 4 times and the sales person agreed that they would ONLY send my loan to 2 lenders. When they returned they informed us that my credit rate was 7.5 %, then the finance person came with a different number. When we signed the paper work. I was told that the rate was lower, they were able to get my loan approved for 5.75 %. A few days later, I got a notification that my credit score went down by almost 30 points!!! When I reviewed the inquiries is saw that XXXX XXXX XXXX had submitted a credit approval to 5-7 different banks, none of which I had approved. They separately submitted my daughter to another creditor. After seeing this, I sent a message to XXXX XXXX XXXX on line and no one ever replied. This is devastating to me. I am in the process of preparing to purchase a new home in the next few months. I have worked extremely hard to get my credit to a place in which my interest rate for a new home is reasonable. The $ XXXX that I was supposed to save by using their financing is going to cost me THOUSANDS because of the impact to my credit. XXXX XXXX XXXX business practices are completely deceptive. From the advertised pricing to scam to the financing practices. These tactics are why people do not trust auto sales.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I leased a brand new XXXX XXXX from XXXX XXXX in XX/XX/XXXX. After ( 3 ) times in the repair center at XXXX, they determined that a new module needed to be installed. This required the engine to be taken apart. The vehicle only had 74 miles on it at the time. I refused to take that vehicle back, and demanded my XXXX down payment back or a new vehicle. XXXX gave me a new XXXX XXXX with only 5 miles on it. I have paid my new current XXXX up until XX/XX/XXXX. Yet, ( 2 ) weeks ago I received an alert that GM Financial had obtained my credit. They pulled a hard pull. This dropped my score ( 8 ) points. They had no authority or reason to pull a hard inquiry on my credit report. Not too much longer later in the day, I find out that there was a mix up with the paperwork between XXXX and GM Financial and GM Financial was demanding that a new credit report be pulled for the XXXX XXXX XXXX, even though I have had it for ( 4 ) months and GM Financial has ACCEPTED payments on said account up until XX/XX/XXXX. Then, Tuesday XX/XX/XXXX, I get a call from GM Financial stating that I am 90 days past due. I informed the CSR that I absolutely WAS NOT 90 days past due. And in fact I was PAID IN FULL AND AHEAD until XXXX. I also informed the CSR that I have PERFECT credit, and under no circumstances should I see ANY delinquency reported to my credit reports. I then had my wife call XXXX and XXXX at XXXX XXXX and inform them of the situation. Once again this is NOT a situation that is my doing. It is either the ineptness of GM Financial, or the ineptness of XXXX XXXX. Regardless, it is not my fault. Then today, XX/XX/XXXX, I get an alert from XXXX that GM Financial has reported me as 90 DAYS PAST DUE to the credit reporting agencies. That has taken my score from a XXXX to a XXXX. I AM NOT past due with GM Financial. I did not even have the first XXXX XXXX for more than ( 12 ) days and no more than 74 miles, before we discovered that GM sold us a lemon. As stated above, that vehicle was SWAPPED OUT for a new one, and NEW paperwork was submitted to GM Financial. I am in the MIDDLE of refinancing my house. A credit report will be pulled prior to the closing NEXT WEEK., And if my scores are reporting this INACCURATE, FRAUDULENT, NEGATIVE Tradeline by GM Financial , and I am UNABLE to refinance my house, then I will have ACTUAL damages UNDER THE FCRA, and will have standing per SCOTUS in Spokeo XXXX I called GM Financial tonight, XX/XX/XXXX and the CSR, while attempting to be helpful, informed me that it is the responsibility of the Credit Reporting Agencies to address the inaccurate information, and that I would have to wait for up to 45 days. That is completely inaccurate, and a PERSON has to verify the disputes through an XXXX, and send updates through XXXXr. Yet, IU got no where with the CSR. GM Financial, and/or XXXX XXXX need to fix their XXXX ups and need to fix it NOW. They have NO ISSUES taking my money! If I didn't pay my lease, they would take my car without any issues. But now, at no fault of my own, and at the fault of 3rd parties as listed, I AM PAYING THE PRICE.
