Consumer Complaint: GM Financial ( GM ) XXXX. XXXX XXXX XXXX, TX XXXX RE : Account # XXXX The Fair Debt Collection Practices Act is intended to secure my right to privacy and my privacy has been breached. The abusive practices, deceptive and unfair debt collection practices by GM will not continue to violate my consumer 's rights. In pursuant to 1692 using symbol in the contents of an envelop that would signal that this is a debt collection practices. Every debt collect, original or third party all put their logos like GM in the content of the envelope is an infringement upon my consumer 's right to privacy as well as misleading representations in pursuant 15 USC 1692e and these violations needs to be address appropriately. This Affidavit of Truth has been submitted in regard to the violations committed by GM. Federal violations against a federally protected consumer. Enclosed are exhibits proving some of GM wrongdoing. In pursuant of 15 USC 1692K I submitted a remedy for each violation of the FDCPS is {$1000.00}. Affidavit of Truth, Invoice and Exhibits have been sent via certified mail with return receipt. All pertinent documents are enclosed. GM please be advised you also sent me another consumer 's account payment history. GM what should I do with the contents. Should I forward it to the consumer Ms. XXXX XXXX.

I have also attached an ID Theft Report from the FTC. I am requesting that the CFPB inquire into this matter.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: GM Financial has been by far the most u ethical company to rebuild car credit with ... i invested {$3500.00} into my new car and have diligently work to make on time payments ... all while experiencing to date a total of 3 recalls a new battery and a buy back option for the vehicle that has cause safety issues. I recently requested the lates reported in the year XXXX to be removed. XX/XX/XXXX as a courtesy and again in XX/XX/XXXX as a deferment was granted and the representative informed me a late would not occur if returned before XXXX. The rep misinformed me as the month CONSISTENT of 31 one days. A slight mishap in which a courtesy waived is something to consider. After several request I was told to dispute in which I did and rhe late markers were removed ... XXXX and XX/XX/XXXX late markers occurred as I was affected by covid19..i worked out accommodations and received new jobs that were postponed and never started due to COVID..i kept in co tact and made agreed partial payments until current and within the time allotted. Under Cares Act I followed the procedures to have late marker removed and requested the diaster codes for these months and payment history to be corrected as indicated in the cares act declaration. Having to provide all this information to GM and the credit bureaus several disputes return with no correction and reverse of the XXXX lates payments now showing again. What company does not considered uncontrolled circumstances as well as courtesy grants. Considering the challenges with the vehicle recalls such an inconvenience. Furthermore I purchased oXXXX XXXX XXXX reports and my car stopped while out of town I had XXXX XXXX run the report to tell me my car was in good shape while sitting on the highway ... even after all this ... GMC has offered to buy back the vehicle so I may seek a new I e and I cant with all the late markers ... the fact that the disputes were resolved and reverse to remove the late reporting and CARES ACT does not give the creditors an option. To decide if they want to remove the late ... its law what is the reson for unethical decision making as a 1st time customer ... .the XXXX reviews reveals this is apparently common with this financial institution. I am requesting GM financial be held accountable to the law of the Fair credit reporting and CARES ACT and remove the late reporting for XXXX as previously disputed and resolved. I was not notified of the reason for reversal and what is unclear about the Cares Act declaration attached that calls for the late payment history to be reversed and coded as diaster? I invested my money I to the car deal and my auto loan was to rebuild my credit should you question my intent. Please have someone of authority and understanding of the law review and correct my payment history ... i am now simply asking the CFPB TO BE INVOLVED and demand you to follow the law vs a curiosity late removal. I followed the proper steps of dispute and Cares Act ... please see attached Lastly ... each bureau for GM has reporting different months lates each bureau is inconsistency in reporting. Some have XXXX XXXX XXXX and XXXX this has caused me several downfalls and should be corrected as they have made a mistake results are life changing for me as a customer.

XXXX XXXX VEHICLE ACCOUNT DETAILS XXXX Account number XXXX Vehicle ID number XXXX XXXX, XXXX Account opened This vehicle was XXXX XX/XX/XXXX I'm writing because I was forced to turn-in my vehicle in XX/XX/XXXX because of unemployment due to medical issues that forced me to collect on XXXX. I attempted to refinance the vehicle which had a remaining balance of {$38000.00} with other creditors and with GMFinancial so that I could possibly make payments once my XXXX was approved. They denied the request. The vehicle was originally priced at {$52000.00} in XX/XX/XXXX when I purchased it and the payments were {$990.00}. I voluntarily turned the vehicle back in for repossession because I was ill, stressed, and unable to continue the payments. I requested a hardship discharge of the balance once the vehicle was sold with a balance of {$15000.00} still due. When I logged into the account, I read the statement : We are aware of your Charge-Off. We are not collecting any payments but you can make a payment if you choose. Therefore, I assumed that they approved the hardship discharge of the balance. However, they have now began reporting the account 35 negative delinquencies from XX/XX/XXXX - XXXX XX/XX/XXXX. How is it possible for them to report negative payments when they stated they were no longer collecting payments? They said I may make payments if I choose. I spoke with them last week and explained that I can't afford to pay the bill off. I'm on permanent XXXX and they said I was not required to make payments.

Consumer Complaint: I turned in the leased vehicle in late XX/XX/XXXX. Through the lease term, all payments were made timely by auto draft. In late XX/XX/XXXX GM Financial sent me the final billing which included damages noted in the inspection ( inaccurate ), a disposition fee ( per the contract ) and sales tax on the disposition fee. I called to dispute the damages, which was really tire wear. The rep adjusted the charge off because I had paid a damage waiver premium. I also advised her that it California, sales tax is not applicable on a lease disposition fee, referring her to the proper section of the California Revenue and Taxation Code. She referred me to GM Financial Legal, advising me to write my complaint and fax it to them. I did so on XX/XX/XXXX. I remitted the lease disposition fee, without tax, and received no further word From GM Financial. I believed the matter settled. Recently I attempted to refinance my home and discovered that GM financial reported me late, 3 times, each in excess of 30 days. A rather serious blemish on my otherwise perfect credit history. On XX/XX/XXXX I called GM Financial in an attempt to clear the matter. The rep was insulting and unhelpful and referred me to the Fax communication only Legal Department. I remitted another fax asking to correct their error. I disputed with the credit reporting agencies as well, but seemingly GM Financial refuses to rectify the matter or respond to communication.

Consumer Complaint: I am trying to get an issue resolved with GM Financial and have disputed it through XXXX and GM but am having difficulty. I had bought my car at lease end on XX/XX/2020 and paid off the up to date payoff balance and the dealership sent the disposition fee. On XX/XX/XXXX, GM financial received and paid an excise tax on the car but when they sent me the bill in XXXX, it was labeled as a disposition fee, which I knew was paid. I called GM and was told the disposition fee was never paid. I contacted the dealership and they sent out a copy of the canceled check. I was not notified by GM again, and in XXXX I noticed a XXXX point drop on my credit file due to a past due payment to GM Financial. I called XXXX and was told that it was the disposition fee, ( not an excise fee ) that was late. I explained that the dealership paid it and would contact them again, I was told once proof of payment was made they would correct my credit file. I contacted the dealership, XXXX XXXX again and they sent the cancelled check again on XX/XX/XXXX, this time cc'ing me on it. On XX/XX/XXXX I checked and nothing was done by GM, so I called and this time was told it wasn't a disposition fee, but an excise tax and they would correct my credit file as it was late. I asked how can I be late on something I had no idea of and even the documentation provided by GM was incorrect. I paid the balance of XXXX rather than have it continue to be late though I have my doubts on the validity of the charge as I received another excise tax bill. I really want GM to let the credit bureau know that I wasn't late, I wasn't given correct or timely information and I had an exceptional credit score until this happened and delingencies follow for 7 years..

Consumer Complaint: Please do not close this complaint. GM Financial is trying to get from me more than the vehicle buy out lease amount. The buyout lease amount was under $ XXXX. The dealership purchased the lease turn-in vehicle in the amount of {$10000.00}. GM financial is trying to get an additional amount over $ XXXX ( which they added to my credit report. While I understand that the mileage was over the amount allocated, GM Financial should not be allowed to receive more than the lease buyout amount. They were not amenable with dealing with me directly for purchasing the vehicle outright. I don't believe that a financial institution should be allowed to add undue financial duress on a client. GM Financial should request from me the amount of the difference between the lease buyout and the amount purchased from the dealership. Approximately a little over $ XXXX. I have not received any communication from GM Financial regarding rectifying this matter. Had I simply had this vehicle repossessed I would have been charged the difference between what the vehicle was sold for and what the lease termination amount would have been.

Consumer Complaint: They have this account charged off - they show it in collection and there is no collection as they can not collect on this debt. It is from a criminal matter and sent them the District Attorney letter and the restitution order - which is useless as the criminal is XXXX and won't be able to satisfy the restitution to me and other victims. The problem is two fold ... they need to update the status so that the balance is not picked up as current which has been the case with other creditors, and they refuse to send me a 1099-C so the balance can be brought to XXXX which is of course, as you know is my legal right. They need to show it closed they need to send me a 1099-C so that I can rent an apartment. There are XXXX in charge off 's and most of the creditors even if they don't really want to will have to send me a 1099-C and bring the balance down to XXXX which will help me not end up homeless. They are doing this for spite.

Consumer Complaint: Good Day, I am XXXX XXXX XXXX and the reason I am writing to you is complain on XXXX for their not of response and reporting. I have done everything and followed every step on removing false accounts that are reporting and still have not heard anything. It has passed the 30 days multiple times and at this point, and nothing has not been resolved. They keep reporting accounts that do not belong to me. I have mailed several certified letters, that are dated, that have everything listed in detail, that have everything required and they still done anything to remove them. I am very frustrated at the point and need to get these accounts removed as soon as possible. I will be listing some dates below that I have sent out to them : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ALL THESE LETTERS HAVE BEEN SENT VIA CERTIFIED MAIL AND HAVE A STAMP WHEN THEY RECEIVED THE LETTERS.
