I have asked them to correct this for months and they refuse to follow through. I want my credit report corrected asap to penalize them for UDAP, FACTA, FDCA, and XXXX abuse of myself.

GM has a very serious problem with communicating with a customer once a problem is identified. A month or so back I made a verbal complaint and I have a case # of XXXX. I have not had any luck at all with these methods. Please review this and let me know how we can resolve this. Thank you, GM FINANCIAL, XXXX. # XXXX I am contacting your because I want to resolve the problem with my account and have always been willing to do so. I paid off this account on XXXX XXXX 2020. I printed a confirmation at that time. The next day I received an email confirmation stating that no further action is required your words not mine, I printed that as well. On XXXX XXXX 2020 on received the Title to vehicle in question in the mail. It is a clear title in my name with no lien. On XXXX XXXX 2020 I received an email stating you had great difficulty contacting me which is not true- this is the first notice I had that there was any kind of problem and it did not state what the problem was. I called to see what the problem was and your agent told me that my check bounced. I will not put up with an accusation like this from anyone, especially when it is not true. My bank always calls me if there is a problem with any of my accounts because they do not want to make me mad. Since then I have called several times to try to get this resolved. Your people are not trained very well and are not willing to report this to someone who can help resolve this problem. I will be glad to pay you the {$6200.00} that you did not get the first time if you will produce 3 things. 1 A letter guaranteeing that GM Financial will not report any negative information about me and this account to any and all entities and persons and guaranteeing that GM Financial will remove any negative information that has been reported to any and all entities and persons about me and this account. 2 An explanation of how this happened why you waited so long to contact me. 3 Some kind of credit for my damages. I have not been able to use and enjoy my vehicle because you have informed me that my vehicle would be repossessed and I have had 2 repo companies contact me regarding this issue. I am always negotiable and am willing to live up to my part of this thing. It will take reasonable communication from GM Financial to do so. Thank you, XXXX

Consumer Complaint: In 2017, I went to XXXX XXXX XXXX on XXXX XXXX XXXX in XXXX, Florida, and I told the sales man that I was in need of a car. I had a trade in. I told him the I was on XXXX XXXX XXXX XXXX Insurance and I could not afford a new car. He told me that he had one for {$10000.00}. I agreed to the price, however, without my knowledge, the dealership added a {$10000.00} warranty maintenance agreement. I was struggling to pay the monthly payments ; also, when I discovered that the maintenance warranty was part of my payment, I returned the car because I did not know and was not informed of the maintenance agreement that was on the car. I notified GM of the issue but they reported it to the credit bureau. I has kept my credit score low and I have been under a heavy financial interest payment. It was the fraudulent activity by the company that caused the problem and it should not be on my credit report.

Consumer Complaint: I received an 'end of lease ' termination bill, as our lease had gone the full 36 months. I paid a payment towards the {$530.00} which I mailed back to GM financial in the paper statement that i received in XX/XX/2020. I never received any other bill or updated information regarding this bill ( no statement, call, email, text, etc ), regarding the balance. Unfortunately I was never informed ( per statement : or email, etc ), that this was all due at 1 time. GM financial insists that they dont do that as it is a final bill, and " oh well, '' from there CSR I spoke to today. Credit now shows delinquent and has hurt my credit immensely. I paid the balance off immediately once I saw my credit score drop @ XXXX points. I am asking for a reverse in this delinquency?

Consumer Complaint: We have two very critical complaints. Part 1. GM Financial 's online payment system consistently was problematic which caused payments to be skewed, unrecorded, or improperly assigned to the correct month. We were unaware of the discrepancies in their billing system for the following reasons : their online system was difficult to navigate and we were unable to review monthly payments as assigned per month ; was often offline/unavailable due to their IT issues ; no matter when we paid every month, their online system consistently reported that we owed a month 's payment ; numerous calls to Customer Support were unproductive- they shared inaccurate information, promised numerous times to mail hard copies of our monthly reports which we never received, and failed to fulfill other promises such as correcting information held by the credit reporting agencies. To summarize the below information : our credit has been negatively impacted by two false cases of unrecorded payments, which were paid, but which GM Financial used to then report on our credit history a total of 6 'over 30 days ' late payments in XXXX and XXXX. The following are facts that we can prove : XXXX. XXXX XXXX we made a payment within 30 days and we were never informed there was an issue with that payment either online or by mail. GM Financial, unbeknownst to us, then took our XXXX payment and applied to XXXX, and took our XXXX payment and applied it to XXXX, causing all three months to be recorded as over 30 days late. After 3 months of recording incorrectly, they corrected their mistake in XX/XX/XXXX. GM Financial, however, never corrected our payment history report and listed those 3 months XXXX XXXX, XXXX, XXXX XXXX as all being over 30 days late to all credit reporting agencies. XXXX. XXXX XXXX the EXACT same situation occurred in XXXX. XX/XX/XXXX payment not recorded, then XXXX 's payment was applied to XXXX, and XXXX 's payment was applied to XXXX. GM Financial, unbeknownst to us, corrected their mistake again but failed to edit any of their credit reporting mistakes. Other than being continually confused by their online/hard copy payment statements, we were unaware that they had reported these inaccuracies due to their own failed system until we went to lease a new car and our credit report was revealed. Since that time, we have had two lengthy conversations with GM Financial representatives that have had numerous short ones that have yielded no positive results. Part 2 : We are contesting GM Financial 's report that there was excessive damage and wear to the car when it was returned at the end of the lease. Before returning our leased vehicle, we took it to a body shop to have any damage repaired. The day we went to the dealer to return the leased car, no representative was there to review and check in the car. We requested that a dealer rep be present to look the car over but were told that they would contact us when they were ready for inspection and allow us to be present. We received no notification. The report received by GM FInancial showed damage that was not present when we released the car. Furthermore, after reviewing the photograph, it is obvious to us that it was not our car in the photograph due to the following : 1. in the photograph, there was a picture of the vehicle 's engine compartment and there were numerous oak leaves packed under the hood- we have no oak trees on our property and furthermore, we were diligent to keep the engine compartment clean when the vehicle was in our possession ; 2XXXX the front bumper was replaced immediately prior to returning the vehicle and the picture revealed a great deal of dust and dirt that could not have been accumulated in the short week 's time prior to its return to the dealer ; 3XXXX the body shop prior to releasing the vehicle, corrected any damage and the damage shown in the photograph did not exist when we dropped off our vehicle ; 4. there was an identical car in the background of the photograph which we believe was, in fact, our leased vehicle. Bank statements and GMFinancial website statement screenshots that demonstrate and prove the inconsistencies can be provided by request as needed to resolve and support our dispute.

GM Financial is only applying these items as credits towards my future payments essentially making my payments and interest free loan to GM Financial. I have asked multiple times to have my overpayments applied towards principle with no help or confirmation. I can not reach an in person representative and feel GM Financials practices are misleading the consumer.

Consumer Complaint: To Whom It Concerns : I received a credit alert today ( again XXXX from GM Financial stating that my account is 120 past due, which is incorrect and being erroneously reported to the 3 credit bureaus. I received a phone call from GM Financial the month of XXXX asking for a payment that I did make and to no avail, GM still reported to the bureaus, I was delinquent 120 past due on the XXXX of XXXX. On the XXXX of XXXX, GM Financial reported that the account was a charge off. Today, on XXXX XXXX GM Financial reported that I am 120 days past due. GM received payment from me, $ XXXX from my insurance ( as the vehicle was totaled in an accident ) ; as well as, GM received money from my warranty YET they are still reporting twice a month which is against FDCPA rules. I have attached a copy of this information to this report. In addition, I was told over the phone by the representative that the account would not be closed if I made a payment, yet as you can see on this credit alert I have attached, after GM Financial took the payment- they turned around and reported the account CLOSED-CHARGE OFF. Now, they are still sending late notifications to the credit bureau??? I am going to sue GM FINANCIAL pursuant to misrepresenting the amount of the debt ; ( 2 ) repeatedly calling me to annoy me into making a payment and reporting this erroneous information after received payments are collected and the company is still reporting false information to the credit bureaus. I receive calls from GM first thing in the mornings, all day, evenings and EVEN on the weekends- Sunday 's for XXXX Sake! They have threatened me saying if I do not make a payment, the loan would be charged off-yet I made a payment and as you can see from the attachments they reported it 'charged off '' after they received a payment in XXXX!!! Additionally, I keep having to block their calls because they are constant. Each time I block them, they call from a different number and the viscous cycle starts all over again!!!! Notwithstanding they have collected monies from my warranty and were supposed to notify me of the amount, they have not and are misrepresenting the amount of the debt! GM has continuously reported to all the bureaus false information more than once every month for several months. If I am correct, this is a violation as well, they will send false information one day and then turn around and report something different the next. Please see attached proof and pay special attention to the dates GM is reporting!!!!

GM Financial will not acknowledge that they withheld that information. However the agents on the phone have. the only response has been from a letter from XXXX XXXX XXXX XXXX Department XXXX Complaints XXXX XXXX ) XXXX ( w ) | ( XXXX ) XXXX ( f ) XXXX does not answer or return calls. In her letter she stated - XXXX does not cover any payment extensions you may have received throughout the life of the account. she also recommends calling the XXXX number if we have any further concerns. When this occurs the agents do not know who to connect us to and send us to a random voicemail when asked to speak with a supervisor who also will not return the call. - GM Financial is Avoiding our requests to speak with a supervisor. - That XXXX coverage was financed ( while paying interest ) on the loan by GM financial - GM Financial offered a payment extension and never disclosed accepting the extension would affect another product being financed by you. This was never mentioned during call when the offer of the extension was made.

Consumer Complaint: I attempted to contact GM Financial via telephone ( placed on hold ), text ( kept switching operators - wanted me to type a large text about the complaint etc - waste of time for a complaint ), and internet ( I received an error that they couldn't accept the complaint and to try again later. I also attempted to make a dispute with TransUnion via the 'start a dispute Online ' link but received a message that their site was not working. The letter I wrote is below. This auto loan was opened on XX/XX/XXXX. I received a statement and paid more than the minimum payment every month for 18 months until XX/XX/XXXX with a balance of approximately {$15000.00}. I have not received ( and I doubt a statement has been mailed ) a statement since XX/XX/XXXX. I assumed that I was ahead on principle, thus would not receive another statement until GM collected the 5.9 % interest they were losing due to the quick payoff. Then COVID arrived and I was grateful that I made those large payments and would not have to worry about a car payment for a while. Note : I do not want nor have I requested to do business online with GM Financial. In XXXX of this year, XXXX, I received a call from GM Financial stating they had not received a payment from me and the account was delinquent {$440.00} for XXXX ( Apparently the bill was due on XX/XX/XXXX - Im thinking my initial conversation with an operator occurred XX/XX/XXXX or XXXX XXXX to 4 days after the due date ). I immediately let them know I did not receive a statement. The operator asked for my address indicating it was listed as XXXX thus maybe it didn't get to me for some reason. It was updated to XXXX XXXX XXXX. Weird since I received statements for 18 months across XXXX - XXXX. I was asked to make a payment online and I informed the operator that I intended to make a payment thru the mail when I received the statement. The operator provided the GM Financial mailing address as well as my account # to write on my check just in case I didnt receive the statement. I was reminded, the due date is the XXXX of each month and if I don't receive a statement, especially because of COVID and the complications with mail not getting where it is supposed to go in a timely fashion, to send a payment even if I dont receive an invoice. ( Hmmmm - what is going on here? This doesnt feel right. Im smelling smoke. ) I waited many days ( I'm not sure how many ) confident I could rely on GM to do the right thing and mail an invoice, but it did not arrive. I again received calls from GM Financial and decided to make an online payment of {$3000.00} on XX/XX/XXXX. Note : I support our US Postal Service and I do not want to do online banking! A couple of days ago, I received a bill from another company indicating my FICO score had dropped to XXXX - What? I don't remember the last time my FICO score was below XXXX. This is not right. I printed the XXXX Credit Report to find that GM Financial had made an adverse report stating, 'Maximum Delinquency for 30 days in XX/XX/XXXX for {$420.00} '. This is not accurate since the amount was due XX/XX/XXXX and payment was sent XX/XX/XXXX. This is GM 's error, not mine and I would like this to be removed from my credit report. As an FYI, I have not received a statement from GM Financial since XXXX of XXXX. Some quick observations : I received messages from and talked to several different operators - customer service was excellent!! I want to believe GM is committed to conducting business ethically, honestly, acts with integrity, takes accountability for results, and does the right thing. Research indicates this is questionable. I have not had any problems with the US Postal Service, not during COVID or during the months when the Trump Administration deliberately tried to hamstring the USPS in advance of the XXXX election to help his re-election bid. I consider this incident predatory and hope it wont happen again. I would like my credit report corrected since I have not received a statement from GM Financial since XX/XX/XXXX. This is GM 's error, not mine. The payment was not 30 days delinquent since it was due XX/XX/XXXX and payment was received by GM on XX/XX/XXXX. Again, I do not want to conduct online banking and prefer to use and SUPPORT the U.S. Postal Service thus expect a statement as soon as possible.
