Consumer Complaint: I have an account reporting on my credit belonging to GM Financial. I purchased a car from XXXX XXXX XXXX in XXXX. In XXXX my job was moving me out of the country and I did a voluntary surrender on this car. In XXXX I had a balance on the car of {$14000.00} but we settled on a balance of XXXX ( see Exhibit A attached ). In XXXX of XXXX met with a judge and agreed on an amount to have taken from my paychecks to satisfy the account. I was garnished from XXXX to XXXX. To my knowledge the balance was satisfied. I held the same job with the same corporation the entire time. But this account is STILL reporting on my credit with a balance of XXXX. This is an illegally calculated and reporting deficiency balance. I have reached out to GM Financial multiple times and received nothing but the court documents. Nothing relating to the satisfaction of the judgement. I find it hard to believe that 10+ years of garnishment has not settled this debt. I am desperately in need of help. According to my credit reports, my last payment was in XXXX, inaccurate! Just with the dates given and proven in the documents attached, this account is FAR past 7 years from default. I will fight with the courts on the satisfaction of the judgment but PLEASE remove this illegally reporting account from all of my credit reports. Thank you.

Consumer Complaint: Thank you for your response to my CFPB Complaint. However, your response has raised more serious questions that I demand a full investigation into, as the errors here and potential violations of the FCRA and the Fair Billing Act are egregious and seriously damaging to my credit worthiness. First and foremost, let me reiterate, when I returned the vehicle to XXXX XXXX XXXX I was ASSURED by our salesperson whom we have purchased several GM cars over the years, that our car was in excellent shape and we would not have any other liabilities. Naturally, as this is not my first time leasing, I did expect to be notified should something not go as planned or if I had any monies owed. In your response, you state that on XX/XX/2019, GM Financial mailed the final bill to me. This right here, is frankly where this whole thing likely fell apart. I moved on XX/XX/2019 to my new address of XXXX XXXX XXXX XXXX Im sure, that if you check the mailing address, you did not mail me that final statement or any subsequent statements to my address of XXXX XXXX XXXX Ct XXXX I have proof, escrow documents and property records, that support my statement that I bought and moved in XX/XX/2019. This detail here, explains why I never received any final statement. As you know, the fair credit reporting act requires that you properly notify a consumer that an adverse action may be taken against his or her credit report, and based on the facts you laid out, I was never in receipt of the disclosure as required by state and federal consumer protection statutes. Frankly, I am not interested in arguing federal statutes with you, I am a customer of GM Financial and a lifelong buyer of XXXX Cards. My husband has a GM, I drive GM and my children drive GM. I enjoy the experience of buying cars at my local XXXX XXXX dealer, and really see this whole thing as a giant error that is now causing me serious credit damage, which is translating into tens of thousands of dollars of hard costs since this credit damage is rendering me unable to refinance my mortgage to take advantage of the low mortgage rates available today. I am not sure of my obligation to inform you of my new address, as I had considered our relationship closed when I returned the vehicle in XXXX of 2019, and again, was assured by our salesperson at XXXX XXXX that no further costs would be necessary. I am a diligent consumer. I pay my bills and have no problems accepting responsibility for my errors, however, in this circumstance, I certainly hope you can see the unfairness of the situation. It is not my intention to engage in a pejorative stance with you, I am hoping you can see the error here, and remove/retract the negative items you have reported on my credit report in time for me to still take advantage of the low interest rates currently available. Should I continue to be damaged unfairly by this incorrect, unfair, and misleading credit reporting, I will have no choice but to pursue all legal remedies available to me, including the filing of a formal lawsuit against GM Financial to hold you responsible for the tens of thousands of dollars in damages I will have suffered by your error, and failure to act and correct your errors when formally notified of such. Thanks in advanced for your cooperation.

Consumer Complaint: I've been a customer of GM Financial for two lease vehicles. I have NEVER been late until XX/XX/2019. I was XXXX with TWINS & me & my spouse was planning to purchase a home because our family was now expanding & we needed more rooms. We were on our way to a meeting with our mortgage consultant & it starts to snow & it turned into a blizzard. A truck zooming by spinned out in front of my husband 's car causing our vehicle to flipped over & hit thr bank. I was 6 months pregnant. They had to cut the top of the vehicle to get me out. My husband was injured & so was I. I had to have an XXXX XXXX. XXXX XXXX, died immediately out of the womb, XXXX XXXX XXXX XXXX XXXX was in XXXX ( I found out about the XXXX baby after I came out of XXXX ). XXXX XXXX died a few days later as well, he was the smallest. I was inpatient in the hospital while my last baby fought for his life. He soon died as well. I was released to a inpatient rehabilitation center, but now it was XX/XX/XXXX. My lease note was due XX/XX/XXXX. To be honest, the last thing that was on my mind was GM Financial. I had just lost XXXX kids & me & my husband were both injured & I had one child at home still. My mom brung my mail to my facility & I called GM Financial to explain the situation via online messenger. I paid it immediately, 32 days past due. I told them that I have a great credit report/score, no late with them or any financial institution on my credit file & asked if they could forgive the late payment as a good will gesture. They denied me after calling about it several times. I even emailed the CEO to explain & her assistants were very rude to me, unapologetic & lacked sympathy. I couldn't believe how they were handling me after this very vulnerable moment. The late marking was accurate, but due to no fault of my own. I had no control of the situation. I would've never been late if circumstances were different. This is the only late marking on my file. All the other institutions were so understanding. This negative marking has ruined my credit profile, has caused me to be denied other credit & low APR 's even with a healthy profile & a credit score of over 740. I have been a great customer to this company. I will never lease with this company again because this one minor thing has shown me how this company feels about me as a client. Out of all the people I've talked to at GM Financial about this, not one has even said, " I'm sorry for your loss. ''

Consumer Complaint: I am never late missing a payment to GM Financial on my car loan. I set up Auto Pay when I first got the loan. I have been on Auto Pay ever since and have never had to worry about my car payment. The bank account that I use, I use solely for bills. I have money direct deposited in, and then auto pay kicks in for my bills to pay each time every month. I have never missed a payment. I don't check my bank account very often, since it is a working flow of payments. I decided to check my bank account one day, and realized that my car payment had not been taken out of the account for the past few months. Worried and concerned, I quickly logged into my GM Financial account and saw that the Auto Pay had been turned off automatically. I never gave GM Financial permission to turn off the Auto Pay feature. I was not notified that the Auto Pay feature had been turned off, and was not aware that my bill was overdue. I did not receive a letter in the mail, or a phone call to notify me that my statement was overdue. I had no idea that I was behind on my monthly payments. As soon as I discovered this myself, I paid the full overdue balance and re-enrolled myself on the Auto Refill Program. Fast forward, and I found out that my credit score dropped XXXX points, and my father 's credit score ( who cosigned on the loan ), dropped XXXX points! We were extremely upset that this was all due to the Auto Pay being turned off without knowing, and the missed payment on the account. I called GM Financial and they told me there was nothing they could do about it. They said I was notified via email from " XXXX XXXX '' that the Auto Pay was shut off. I checked my email inbox, spam and junk folders, and I never received an email from XXXX XXXX. They told me that I turned off the Auto Pay on XX/XX/2020 and that a confirmation email was sent to me. I never turned off the Auto Pay and never received any emails from XXXX XXXX to notify me that Auto Pay was turned off. Of course, I told them I was extremely upset, because if I knew I turned off Auto Pay, I would have paid my bill right then. They told me that there was nothing I can do to dispute the derogatory mark on my credit report, due to me not paying my bill on time. I am extremely upset because I have never missed a payment in my life, and now my credit score and my father 's credit score have been extremely impacted, since GM Financial did not communicate with me that the Auto Pay was turned off. This will affect our credit scores for years to come, and impact our interest rates if we ever want to buy a home or a car.

Consumer Complaint: XXXX XX/XX/XXXX I spoke with GM Financial Customer Service and a customer service supervisor who was able to note my account and approve to reverse the late reporting for XX/XX/XXXX in XX/XX/XXXX this was a huge step as I have disputed this for over a year I was told this would be resolved in 45 days or less I was also told I would receive a letter in the mail showing the corrections. I have sent emails and called GM Financial to only find myself holding on the line for two or more hours and then get hung up on by customer service and collections. when requesting a supervisor I am told someone would call me back and that never happens furthermore when I call in for status no one knows what I'm talking about and I have to talk to 10 people for the tenth person to finally read the notes and see where it has been documented that my credit would be reversed. however I would need to wait yet another week or two and I have although this is a violation the Federal Credit Reporting Act. I have a statement from GM clearly showing XX/XX/XXXX was in deferment their records would also show this I'm not sure why this would be so complicated. I have also provided the XXXX statement showing that my payment was late but never 30 days late this information is their own records. If only someone would simply read what I am providing there is nothing hard about this discrepancy. GM responses received are redundant they simply remind me of my contract terms and list what they are currently reporting late which is incorrect this is bad Business this is bad record-keeping and when you report incorrectly to all 3 bureaus this can be devastating 2 a customers such as myself this is my final attempt The Next Step will be the Federal Trade Commission who implement Credit Reporting Act guidelines which are very clear additionally there should be no late reporting on my account XXXX are errors XXXX lates were due to XXXX. I'm simply asking in your response to provide me your Executives contact not your supervisor I think this is very important to have someone review how long I've endured these discrepancies in the lack of effort to correct them and shouldn't go to legal action the amount of cost for something so small

Consumer Complaint: I am writing to insist that 3 inquiries/late comments on my credit report from GMC Financial be reviewed and withdrawn and expunged. These all relate to a final bill for my GMC XXXX, XXXX truck lease that was sent to me in XX/XX/XXXX and then inexplicably marked past due in XXXX ( 30 days ) then again in XXXX ( 30 days ) and XXXX, XXXX ( 60 days ). The final bill was received in the mail in XX/XX/XXXX. The bill was higher than anticipated and included unwarranted charges. At that time, I immediately contacted GM Financial. The agent agreed and told me that the final balance would be reduced. I requested a written confirmation. The agent said : " We don't do that '' to which I responded : " How do I know that the bill was in fact reduced without a written confirmation? ". The agent then advised me this would be confirmed in writing. In the months following I received several automated robo calls in which I was asked to enter my social security number in order to review the specific issue. I responded to the calls by repeatedly requesting that a bill with the reduced balance be sent to my home address. The calls were impossible to authenticate and I was inclined to not provide my social security number because I was never asked to provide the GMC lease number that appeared on my monthly statements while the lease was in progress. It was not until XX/XX/XXXX before I received any additional communication in writing from GMC Financial. GMC 's records confirm that no other written communication was sent to me. This was confirmed to me on the phone by a GMC representative. Once I received the statement in XXXX, XXXX, I responded and the bill was paid in a reduced amount shortly thereafter. The reduced amount was what was originally agreed to in XXXX, XXXX. BUT not until XXXX, XXXX was the reduced amount submitted to me in writing. My credit report/rating was negatively impacted for this same final bill as it was reported three ( 3 ) times as past due on XXXX ( 30 days ) then again in XXXX ( 30 days ) and XXXX ( 60 days ). Again, ONLY in XXXX, did I receive written confirmation of the actual final balance in a reduced amount. I require that these 3 faulty inquiries/reports on my credit report be reviewed and withdrawn/expunged. I am writing to this agency in an effort to correct what I believe to be a frivolous practice by GMC Financial. I contend that this methodology of billing is a clear violation of the Fair Debt Reporting Act and The FDCPA as it shows a careless and improper course of conduct by GMC Financial.

Consumer Complaint: GM Financial is reporting an erroneous debt on my credit file and it must be removed. I recently checked my credit and noticed this debt on there and I do not owe this debt. This car should have been completely covered with my GAP insurance. I submitted the paperwork a while ago and haven't hear back from GM Financial. They however, continue to negatively report on my credit. This needs to be removed and you need to report accurately.

Consumer Complaint: Car loan was re-financed with XXXX XXXX and GM financial is still reporting that my account is open with them on credit report. They are also reporting two late payments on my credit report, which they were just moved to the end of the loan. I called twice and still can not get this resolved. It is impacting my credit profile and dropping my credit score. Gm financial needs to report to all credit bureau 's that the account is closed, paid in FULL, and they need to update the bureau 's that there were not late payments. If not corrected within 30 days, I will seek legal action.
