Consumer Complaint: This car was put in my name without my knowledge. I eventually took possession and sold car but the debt has remained. This creditor has violated my rights in contravention of the Fair Credit Reporting Act. Specifically, the creditor has infringed upon my right to privacy as outlined in 15 USC Section 1681b, Section 602s. Additionally, under 15 USC Section 1681, Section 604a, subsection 2a, the creditor is prohibited from providing information about my account without my written consent. Furthermore, under 15 USC Section 1666b, a credit issuer is not permitted to categorize a payment on a credit card account as late for any reason under an open and consumer plan.

You and I are fully aware of the laws designed to ensure that credit bureaus exclusively report veracious credit information. It is abundantly clear that the incorporation of such blatant falsehoods in my report is either a colossal error on your part or a grievous misstep by the reporting creditor. I am seething with frustration over the unjustifiable inclusion of the following erroneous details in my credit report : GM FINANCIAL XXXX and please take note that, I do not consent to an electronic communications. I request all responses be in writing throughtheusps and I am the person making this complaint & I give cfpb authority to investigate this claim. I still don't know why it didn't post but they should have contacted me to let me know something happened. It could have very easily been an error on their website which is always down with issues. I have never missed a payment on anything and it's totally ridiculous that this was reported instead of alerting me. I demand that it be removed from my credit report. Once I found out the payment never was made I of course paid it and the XXXX Payment.

Consumer Complaint: On about Fri, XX/XX/2023, I call XXXX XXXX ' customer service asking about the alleged account for my automobile. GM Financial claimed I owed them money so I asked for the original contract that I signed with them so that I can tender the account. They didn't not send it. GM Financial sent me the purchase contract that I signed with XXXX XXXX of XXXX. According to XXXX, XXXX received payment for the Agreement ( Debenture ) and also transferred the debenture to GM Financial as the company who purchased that said debenture. XXXX said their transaction was completed with the day of the purchase. Nowhere in my contract names XXXX XXXX XXXX as my creditor nor have I sat down with any agent of GM Financial to create any agreement. If I did it wasn't given full disclosure on XXXX XXXX ' involvement and to my understanding that makes the contract unconscionable. On Tues, XX/XX/2023 XXXX XXXX XXXX repossessed my Truck ( Automobile ) using a company named Loss Prevention Services at about XXXX. I first called GM Financial and spoke XXXX agents. XXXX # XXXX which was the XXXX agent I spoke to informed me that the debt was Charged Off. After I put them on notice that they weren't supposed to take my truck according to 15 USC 1692e ( 4 ), she said that GM Financial had a lien on the truck and didn't know what a XXXX XXXX XXXX filing was. I told her that XXXX should have filed that in order to repossess my property. She wasn't sure so she transfer me to her supervisor XXXX # XXXX. I spoke with her and she confirmed that there is no UCC 1 lien and no warrant signed by proper authorities to repossess my Truck. They refused to return my Truck knowing these facts : XXXX. that they are not the owner my truck, nor do they have permission from me, to repossess it 2. There is not a Proper Lien on the car nor a Judge signed warrant for the property 3. Has not provided proof of claim that I owe them or that they gave me a loan 4. Is collecting security interest on a debenture and requiring me to pay them more on a contract I tendered with XXXX and which also they claim was Charged off. XXXX. Has broken the law knowing that repossession on a debt is illegal So far the only documents GM Financial has sent was a copy of my contract with XXXX and a letter that wasn't notarized from a responsible party. This has put me in an awkward position and is causing me unjust hardship. I'm a single mother of XXXX and a veteran. Please help me resolve this issue.

These inaccurate items are not only embarrassing ; they are preventing me from obtaining the credit I deserve. As you and I are both aware, there are laws that ensure that credit bureaus report only accurate credit information. It is evident that the inclusion of this inaccurate information is a mistake on either your part or the reporting creditors part. Also, I'm the XXXX filing this complaint, and I give Consumer Financial Protection Bureau ( CFPB ) authority to investigate this claim. I did not notice that these features was missing immediately. Additionally, I was not informed about the missing chip for the park assist by the dealer only through calling XXXX XXXX XXXX. Furthermore, I have reached out to the dealer, gm priority care, gm financial, and the XXXX XXXX XXXX in regards to the issues that I am experiencing with this $ XXXX purchase. ( XXXX ) Complaint has been filed with the XXXX against XXXX XXXX of XXXX. ( XXXX ) Complaints have been filed with the XXXX against General Motors. There has been no resolution in this matter. Lastly, the dealership has lied and stated that I shuffled ( throwing ) some papers around to give reason why I am not allowed on their premise. The dealership can not provide proof of any such behavior, because it never happened. However, this is untrue and is defamation of character. Additionally, I have video recordings for my protection each time that I was on XXXX XXXX XXXX XXXX XXXX XXXXXXXX. XXXX, XXXX XXXX XXXX representatives have been upset with me since I submitted a bad review to XXXX on XX/XX/XXXX in regards to this vehicle sale. Lastly, I have the phone recordings of conversations with XXXX XXXX ( Sales Manager ). Including agreeing to take care of the equipment issues. Also, the conversation when I attempted to schedule the appointment that he requested to observe vehicle. Per phone this recording you will be able to hear the belligerence from from XXXX XXXX towards me for asking the representative XXXX, do they provide loaner vehicles?. XXXX got on the phone and stated that " I was giving her a hard time ( referring to XXXX ) and that I am not in the drivers seat in this matter ''. Overall, I have experienced disrespect, XXXX, and bad customer service with this dealership. Additionally, I am a victim of a bait and switch car sale.
