Consumer Complaint: HARDSHIP LETTER To GM Financial Corporate Office Today is XX/XX/XXXX and I still have not received any kind of response regarding XXXX XXXX arguments against his car loan. He feels that GM is not willing to do anything but begin repossessing proceedings against him while he is in the hospital. The doctors have ordered XXXX XXXX to remain in the hospital for an indefinite period until they get his XXXX XXXX XXXX under control. MY COMPLAINT I am sending a new complaint to Consumer Finance criticizing that agency for indicating that our most recent complaint was a duplicate instead of something new. We strongly disagree with Consumer Finance, and we feel that 'GM Financial never responded to the concerns that XXXX XXXX has such as : ( never responded ) Failure to respond to XXXX XXXX in a timely manner. Failure to move the outstanding balance to the end of the contract. Failure to recognize XXXX XXXX 's illness. GM wants to repossess the car instead of coming up with a reasonable plan and working with XXXX XXXX. Failure to respond asking for an extension of payments until XXXX. Failure to respond to the fact that XXXX XXXX will be in the XXXX for an indefinite period. I think Consumer Finance is wrong in saying this is a duplicate, we are very frustrated with them that they ( consumer finance ) did not do anything to help me, instead they went along with GM which I think was wrong. What good is this agency when it's one sided, it appears that we ( consumers ) are not being heard and not having our concerns addressed by both parties, again this is not a duplicate. His body is deteriorating with this condition, and he needs to know what happens to the vehicle if he passes away. The doctors are concerned about his condition, and the thought of repossession is causing XXXX XXXX a lot of stress. Please can you come up with a reasonable plan because he does not know how much longer he must live. We are asking all GM Financial for some kind of assistance. He is sending you my most recent financial and health hardship letter because he wants to explain to everyone why he was late with payments. We are very concerned about his past due payments and one of the reasons he is late is because he suffered a XXXX XXXX XXXX. The attack was very serious which caused him to have XXXX XXXX XXXX. Due to the seriousness of his XXXX XXXX, he is facing financial hardship. He does agree on three principal short-term goals such as : make my payments as agreed by a payment arrangement, lower my monthly payment, and correct the errors shown in my credit report which need immediate attention. Another serious reason for asking for assistance is due to his wifes health condition, she had a XXXX XXXX, unable to walk, this has caused a heavy burden on XXXX XXXX trying to balance their lives. We have been communicating with most of his creditors to explain why he was late on my payments. We told them that XXXX XXXX suffered a third XXXX XXXX which caused a loss of job and valuable income ; my earnings to make the car payment has been reduced. To improve his standing with all his creditors and place a positive note on this, he will listen to everything that is placed on the table but one item that needs to be discussed thoroughly, its his monthly payment, its too high and he simply can not afford that kind of payment. From a doctors point of view, Regarding XXXX XXXX XXXX XXXX, it is very serious ; the family doctor diagnosed him as having congestive XXXX XXXX and an XXXX problem. To offset this, XXXX XXXX has a XXXX and pacemaker implanted in his chest. The doctors greatest concern is that his recovery from a third XXXX XXXX has been very slow, and stills suffers from XXXX XXXX XXXX which is monitored weekly by a monitor which transmits to the cardiologist daily his heart beats, rhythms, and pictures. XXXX XXXX is pumping only 30 % blood capacity throughout his system, and this is why its important to keep monitoring his daily activities. Meanwhile, due to the XXXX XXXXXXXX and XXXX XXXX and slow recovery, XXXX XXXX lost the job he had for twelve years ; his income dropped considerably which caused him to become late in making his car payments. The doctor states in his assessment that XXXX XXXX is unable to perform activities as before because of multiple medical co-morbidities, slow recovery from bypass procedure and exceptional shortness of breath. XXXX XXXX is also suffering from XXXX XXXX. He underwent XXXX XXXX on XX/XX/, the doctors removed his prostrate, according to his doctor. In summary, his wife and XXXX XXXX are undergoing serious health and financial hardship issues, this is why we are asking for some assistance, he wants to keep the car and please no repossession. XXXX XXXX is working on making two payments, and this has been difficult for him because of his XXXX XXXXl stay. He is unable to perform any kind of duty. He apologizes for the inconvenience this may have caused, but he does recognize the problem, and furthermore, he also knows that his attention has been on his health issues instead of his finances, which he wants to change. Consumer Complaint: I have attempted to work with GM Financial to bring my accounts current. However, I exhausted all resources that make sense. I am privied to ( 8 ) deferments through the life of the loans but have been denied. Additionally, I have gotten the run around from a collections manager for weeks. I spoke to a manager weeks ago he stated that he would assist. However, he has been spinning every time that I call up until today XX/XX/2023. He finally stated that he would not be able to assist me with any deferments. Furthermore, I am a victim of a predatory loan. The XXXX XXXX is worth XXXX I owe GM Financial XXXX with a interest rate of XXXX. I have tried to work with GM Financial by keeping good communication and trying to work things out. At this point I feel that I need to get an attorney involved if they will not correct the wrongs immediately.

Consumer Complaint: Had this car for 2 months, and tried to return it. The salesman would not budge. He knew they were charging way over what the car was worth. We would surrender the car, but we need to have something for work. The car is not safe, I've had 2 spin outs, and there is no FWD. Gm Financial will not help with lowering the payments. I talk to them regarding the payment plan, and they still call me 3 days later. I even had a guy hang up on me, because he wanted to flap his mouth the whole time. They also play good guy, bad guy. The person you talk to just says, we will note the account of your payment arrangement, then someone calls you, to tell you what you already talked about 2 days ago. So stupid!! I lost my job 4 months ago, due to a shut down, and can't make all the payment. I am XXXX, and on unemployment. GM does not care. I feel like filing bankruptcy, but don't want to. I wish I never heard of the dealer in XXXX, and GM Financial!! They have enough money, so why can't they give people a break? All these big dealerships, need to be taught a lesson. Lets boycott the big names, and buy used. I bet they would stop these practices. I know there are a lot of inventory unused, but people are so money greedy, they don't want to get to people, and families that are barely making a living!!

Consumer Complaint: I received a response for my previous complaint that said GM Financial has sent a response to the consumers complaint offering an explanation of the account status and a point of contact for follow up questions. Also it said GM Financial has submitted a request for an account adjustment per the consumers correspondence. In the response Gm financial stated : On XX/XX/XXXX, a cease and desist of telephone communication was documented to the account to ensure you do not receive further telephone calls, as requested. While you XXXX no longer receive telephone calls regarding the status of the account, GM Financial will continue to communicate with you to the extent allowed by law. You must contact GM Financial if you want to remove the do not call status from the account so that we XXXX contact you again at the phone number you allow. But the cease and desist letter I sent clearly stated to Please cease and desist all collection activity regarding this account immediately. XXXX XXXX XXXX ( c ) Ceasing communication Cease and Desist all collections activity regarding this alleged debt and PROMPTLY Delete it from all consumer reporting agencies that you have reported this inaccurate, incomplete, erroneous and misleading information to at once. Also gm financial XXXX GM Financial is required to report truthful and accurate information to the credit reporting agencies. We reviewed the account data sent to them and determined the information is accurate. On XX/XX/XXXX, the date we last reported, the account status was charged off with a {$18000.00} deficiency balance and an account payment history of XXXX, XXXX and XXXX. The date of the reported delinquency is XX/XX/XXXX. As a result, we are unable to make any changes or deletions to the credit bureau reporting of your account which is done in accordance with the Fair Credit Reporting Act ( " FCRA '' ). but upon checking my credit file the last reported date was in XXXX of XXXX also the date opened on all three are completely different, and the date of last activity are also completely different on all XXXX credit bureaus. The response also stated that gm financial sent an adjustment request to the credit bureaus but there has been no adjustment made. Exactly what adjustment is suppose to be made?
