Consumer Complaint: On XX/XX/2023 the Consumer Financial Protection Bureau ( CFPB ) and the New York State Office of the Attorney General sued a predatory auto lender, Credit Acceptance Corporation, for misrepresenting the cost of credit and tricking its customers into high-cost loans on used cars. The car-buying experience turns into a nightmare for many of Credit Acceptances borrowers, who face unaffordable monthly payments, vehicle repossessions, and debt collection lawsuits. The joint complaint alleges that, among other things, Credit Acceptance hides costs in loan agreements and sets consumers up to fail. The complaint also alleges that Credit Acceptance violated New York usury limits and other consumer and investor protection laws. The lawsuit seeks to force Credit Acceptance to stop its illegal practices, reimburse harmed consumers, pay back wrongfully earned gains, and pay a penalty. And feel like i was a victim I purchased the car on XXXX and after reading the CFPB report 75 % that was mentioned in the article i can relate to. So I'm making this complaint too have credit acceptance removed from all 3 credit reports. Under the Consumer Financial Protection Act, the CFPB has the authority to take action against institutions violating consumer financial protection laws, including engaging in unfair, deceptive, or abusive acts or practices. The CFPB is seeking injunctive relief, monetary relief for consumers, disgorgement of unjust gains, and a civil money penalty.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: I had two different loans with credit acceptance corporation. One I was a co signer on the other I was the main borrower/signer. The one I was co signer on was impounded due to my sister who was the main signer being pulled over. It was placed at XXXX in the town we live in. XXXX refused to release the vehicle to me even though I was co signer, I contacted credit acceptance and told them the situation they ended up letting XXXX keep the vehicle and went after my wages to still pay what was left on the loan. XXXX sold the vehicle and I was left to continue to pay on it. My sister only owed less than XXXX to begin with and I paid thousands because they went after MY WAGES! I paid them {$160.00} a month for years until they said they were satisfied! They even had the audacity to send me the title after I paid them thousands of dollars and they knew I never had the vehicle. The vehicle I owned was repossessed after awhile and again I didnt owe much on it, I ended up getting it out of repo keeping it awhile longer then decided to just do a voluntary surrender. The payments and terms on the loan were ridiculous to begin with. These ppl take advantage of ppl with limited credit and income. But I still knew I was responsible for what I owed according to the loan terms. Well they resold the vehicle and again tried garnishing my wages for an amount more than what the loan was even for, they didnt even take in to account whatever they sold the vehicle for. Again I was stuck paying them {$160.00} a month for years with no vehicle to show for. I am actually STILL paying on this one. Its been very stressful and took a blow to my income that Im paying them thousands of dollars with nothing to show for it. They use a law firm called XXXX XXXX to attack your wages for ungodly amounts. They should be sued for pain and suffering and have to give people their money back and then some. The most recent garnishment I have from them was from XXXX and I am still paying {$160.00} a month. The previous one was from XXXX. I reached out to credit acceptance on multiple occasions but was always told to contact the XXXX XXXX XXXX XXXX!!!! These people are crooks!!

He didnt go over any of the paperwork nor did he give me a copy of them. The vehicle was only worth {$1800.00}. Per book value but they charged me over {$6000.00} for it and it also had over XXXX XXXX miles on it. I have jad to replace multiple parts and now the engine is blown in it as well as transmission issues. I am on a small income and now cant afford to get it fixed. Issue: Problems at the end of the loan or lease
Subissue: Problem with paying off the loan
Consumer Complaint: On XX/XX/XXXX, I leased a car XXXX XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) where the car was serviced before driving off the lot. Unfortunately, the car has not performed well because the car requires a new engine after a month and a half of ownership. I am disappointed because after I contacted management in regards to the problems I faced, I was turned away because of assumption of negligence in filling fluids. I purchased an extended warranty but the warranty company wants me to pay for the tear down of the engine to see if they may cover it. I believe I was sold a lemon.
