Consumer Complaint: I was financed through XXXX XXXX for a XXXX XXXX XXXX. I had an accident, and the car was totaled. The company that initially did the appraisal to determine what the GAP insurance would have covered was not the company listed in my buyers ' contract. {$5700.00} has been reported on my credit report. First, the XXXX XXXX XXXX was not worth the amount that has been reported based on XXXX 's XXXX XXXX value. We had discussed settling the account at {$2500.00}. Under The Truth in Lending Act, it requires lenders to disclose information about all charges and fees associated with a loan. How does a settlement discussion of {$2500.00} goes to {$5700.00} for a car whose value is not even worth {$5000.00}. This is what companies such a Credit Acceptance has done targeting certain ethnic demographic 's reporting negative information to Credit Bureaus and including extra hidden fees that is not in the contract or in agreement with the value of the automobile.

Consumer Complaint: I have asked credit acceptance, XXXX XXXX and XXXX multiple times to remove my nonpublic personal auto account from the third parties ( XXXX, XXXX and XXXX ) because they didnt give me the option to opt out of their opt out disclosures and they refused. I have recently read the GRAMM-LEACH-BLILEY ACT under the Federal Trade Commission and they are failing to comply with the law. The GRAMM-LEACH-BLILEY ACT requires financial institutions companies that offer consumers financial products or services like loans, financial or investment advice, or insurance to explain their information-sharing practices to their customers and to safeguard sensitive data. The Gramm-Leach-Bliley Act seeks to protect consumer financial privacy. Its provisions limit when a " financial institution '' may disclose a consumer 's " nonpublic personal information '' to nonaffiliated third parties. The law covers a broad range of financial institutions, including many companies not traditionally considered to be financial institutions because they engage in certain " financial activities. '' Financial institutions must notify their customers about their information-sharing practices and tell consumers of their right to " opt-out '' if they don't want their information shared with certain nonaffiliated third parties. In addition, any entity that receives consumer financial information from a financial institution may be restricted in its reuse and redisclosure of that information. Credit acceptance, XXXX XXXX and XXXX has failed to disclose this information to me and knowingly and willfully withheld pertinent information regarding the disclosure of my information to affiliated and non-affiliated third parties, credit acceptance corporation, XXXX and XXXX knowingly, and willfully withheld information that explains how I the consumer can exercise that nondisclosure option. My account should be removed immediately!

Consumer Complaint: When the COVID-19 Pandemic began, Credit Acceptance Corp notified me that all payments would be deferred until the pandemic ceased. During this period of 8 months, Credit Acceptance notified me that i could pay what I could afford and that it would go towards my principle. At the time I was a full-time driver for XXXX with a direct contact to my mother who was fighting XXXX XXXX at the time. Due to her underlying condition, I was forced to stop driving for the company. At the end of the 8 month period, Credit Acceptance Corp contacted me via text /email and notified me that I had to contact them immediately. When I spoke to them they notified me that I now had nearly {$4000.00} due in auto loan payments and late fees. They went against on what they ensured, which is that all payments were going to be deferred. They forced me to pay the balance due and since i was unable to pay it in one month they began placing late fees onto my balance. They also reported to the credit bureaus that I was 90 days or more late on my loan. And each month after they were reporting 90, then 120, then 150 ... and so on all because I didn't pay what was accruing over the 8 months in one months time. They have been reporting late payments every month up until this day and I was never able to get caught back up. My credit report currently shows over 30 late payment remarks from them which deeply affects my payment history which is a significant portion of my score. Also, with late payments came late fees with Credit Acceptance Corp that pushed me {$10.00} more a month in debt.

Consumer Complaint: Account # XXXX I had an accident in my car. The insurance didnt cover the accident since the person driving was not covered under my policy. Credit acceptance then called me and demanded a settlement amount to clear the remaining balance which is fair. Although they did not inform me that every month that the full settlement amount was not paid I would get a late payment remark on my credit report ( {$6000.00} ). Since I did not have all the money readily available I decided to call and ask for assistance. The representative told me not to worry about the late payment remarks on my credit that since Ive never been late in the past they would do a good will adjustment and remove those late payments once the balance was covered. After three months I was able to pay the whole balance and close the account. Since then I have been unsuccessful in getting those late payments removed from my credit score even after putting in a letter of goodwill adjustment. To this day my credit score has suffered and no one at credit acceptance has been able to help me fix this error even after I was told I would have no issue getting this removed. Can someone please help me rectify and remove these late payments. Before the settlement I was never late.

Consumer Complaint: On XX/XX/2023 financed a XXXX XXXX XXXX with Credit Acceptance Corporation ( CAC ). The XXXX XXXX XXXX was purchased from Impressive auto sales in XXXX, PA. Spoke to salesman XXXX on XXXX asked price of car and was advised it cost {$8900.00}. XXXX asked me if I liked the car and to submit loan application on impressive auto sales website. Later in the day XXXX informed me that I am approved for the loan. XXXX asked me how much down payment I am able to put down. Advised XXXX I can put {$1500.00} down payment and would be in the next day to test drive car. On XX/XX/2023 test drove XXXX XXXX and agreed to move forward. I asked XXXX again how much the car cost and he said it cost {$10000.00} because I am financing the car. I informed XXXX that the car is advertised for {$8900.00} and when I spoke to him on the phone and informed him I would be financing car, the price did not change. XXXX then said my monthly payments are {$280.00} for 66 months. I asked XXXX what the out the door price is and he would not tell me. I informed XXXX my XXXX score is XXXX and I dont know how he got to the monthly payment amount. XXXX refused to show me any documentation only to mention that in order to do the deal I have to get a warranty that is included in the loan for {$1600.00}. I needed a car to get back and forth because there is no public transportation to take me to work and back home. I really feel taken advantage off and ripped off. I paid the {$1500.00} down payment with the warranty included, which I did not want. The total amount financed is XXXX and monthly payment of {$280.00}. I called CAC on XXXX and canceled the auto warranty issued by XXXX XXXX. CAC deducted {$1600.00} of my loan and left an unpaid balance of {$10000.00} with monthly payment of {$280.00}. If is not fair the I still have the same monthly payment of {$280.00} when CAC deducted {$1600.00} when I cancel the contract. Moreover, I deserve a lower finance rate because my XXXX score was XXXX. Its amazing that CAC never provided my XXXX score to me before loan was issued. With loan balance of {$10000.00} on XXXX my monthly payment would be {$240.00} for 66 months with interest rate of 18.99 %. How it is now pay on balance of XXXX on XXXX, my monthly payments are still {$280.00} for 66 months with interest rate of 25.68 % which is illegal in Pennsylvania.

Consumer Complaint: I, XXXX XXXX, the consumer and natural person, were denied credit with a XXXX score and no counter offer by Credit Acceptance Corporation when I applied for a new XXXX XXXX for approximately {$50000.00}. Adverse action against a consumer is AGAINST THE LAW according to the Equal Credit Opportunity Act which is codified in 15 U.S.C 1691c and is pursuant to civil liability under 15 U.S.C 1692k. You are subject to criminal liability for violating 15 U.S.C 1691 as I have proof that I was discriminated against by Credit Acceptance Corporation due to the response I received. I have attached it to this letter. Credit Acceptance Corporation is in violation of 15 U.S. Code 1642, U.S.C 1681m and 12 cfr 1002 because I, the consumer, made an application in good faith, but credit was not issued. Furthermore, because my social security number ( credit card ) was used and I received NO benefit. This is proof of fraudulent activity ( unauthorized use of credit card ) on behalf of Credit Acceptance Corporation. Since you are the borrower and borrowed my application, I'm in demand for the borrower to retract/return my application ( security ). If Credit Acceptance Corporation fails to make any reasonable procedures to resolve this matter and compensate me for the use of my credit card I will indeed make Credit Acceptance Corporation criminally and civilly liable for all actual damages pursuant to 15 USC 1681n and 15 USC 1681o. I will also follow up with an invoice for said violations ( { {$10000.00} } per violation ).
