The company has the nerve to send me a letter stating they plan on selling my property at auction to make even more money after extorting me out of my interest payments for years, well I reported Credit Acceptance Corporation, Credit Acceptance Funding LLC, Credit Acceptance Auto Loan Trust and all its representatives to the Federal Trade Commission reference # : XXXX for book-entry securities fraud, extortion, tax evasion, embezzlement, and every other violation the companies are blatantly committing. I wrote the Governor in my state, and the Secretary of State. And I'm wondering my Account is still due XXXX in interest and the company is still playing in my face, my car better be back in front of my house immediately. no titles rights or interest past due to fraud. Consumer Complaint: I got approved for a auto loan in XXXX XXXX XXXX by credit acceptance. On XXXX XXXX, I made a payment arrangement on my XXXX payment for XXXX the only payment I was ever late on. I paid XXXX dollars that the representative from credit acceptance told me to pay and the remaining balance was split into XXXX payments, my new monthly payment was XXXX until the late balance was paid in full. However I totalled my vehicle 4 days later on the XXXX of XXXX. At that time I had full coverage and Gap from XXXX XXXX XXXX, on my vehicle. The balance on my vehicle at that time was XXXX. My Insurance company paid XXXX and sent XXXX to Credit acceptance after taking out my XXXX deductible. Credit acceptance said they applied my insurance check to the past due balance and late fee of XXXX first and the remaining balance towards the principal. which left me owing XXXX, Credit Acceptance said they would file for my Gap to pay the remaining balance, even though I wanted to do it myself, after finding out that I couldn't file myself or even speak to this Gap company because this gap company is allegedly a third party to credit acceptance but i have the same account number for Gap and credit acceptance, and this gap company told me they only correspond with credit acceptance and cant correspond with me, even though I pay them separately. Which I didn't know any of this until the accident. Credit acceptance sent over a Gap addendum to me by email that has my name on it electronically that I didn't sign or never seen at the time I purchased my vehicle from the dealership. I only signed that I purchased Gap and a warranty that only shows the amount of these warranty, -insurance. I never signed a contract for neither. When credit acceptance filed my Gap they reported to this Gap company that I had a late balance of XXXX instead of stating that the late balance was taking care of by my insurance company. Credit acceptance did this to keep me owing on the loan and charging me XXXX percent interest fees, even after they got my insurance check they are still charging me over XXXX dollars a month in intrest fee. Plus i still have a monthly bill of XXXX dollars due in XXXX as if I still owe on the loan. The Gap company only paid {$3300.00} stating I had to pay the late fee for XXXX of XXXX, also credit acceptance reported to gap {$81.00} for a contract service refund, that I didn't receive, and do not know anything about, I was also charged XXXX for taxes, tags and license. which my insurance company said they will not be reimburseing. My Insurance company also stated I can apply my insurance check the way I deemed fit since im the only one paid for it, and they only paid for the blue book value of my vehicle, and XXXX dollar deductible, there is no law in XXXX or XXXX, that states I can not pay the late fees out of my insurance check, that came from my insurance company. Plus there is no contract I signed with credit acceptance stating that in a event of a accident any check from my insurance company can only be applied to the principal and not late fees. I did sign that credit acceptance is not supposed to do Oral contracts and make up things not stated in the contract or add additional hidden stipulations to the original contract, this is considered a breach of contract. Therefore if credit acceptance applied my insurance check to the past due balance and late fees, like i requested, and they told me they did that first, then the only remaining balance that is left is the remaining balance of the vehicle. Also this Gap company allowed my insurance company to pay the XXXX deductible that was supposed to be taken care of by the Gap company that's stated in the addendum sent to me from credit acceptance, and the Gap company didn't hold themselves accountable to pay that, ,but trying to make me pay the whole XXXX that was taking out of my insurance check. Which my insurance company paid from the date of the accident which was the XXXX of XXXX. So i really only owe a 11 day payment for XXXX. credit acceptance did not even prorate that balance. Therefore this gap insurance is a fraud because the only remaining balance on my account is the remaining balance of the vehicle which this Gap company stand for guarantee auto protection that i thought i paid for, but this company is giving every excuse not to pay and keep me in contract and in debt, and or Credit acceptance just wanted to keep charging me ridiculous intrest and late fees on the XXXX and now up XXXX to now XXXX after 1 month of interest on the XXXX that should have been remaining and these fees are not even loan related. They are {$980.00} taxes, tags, title is not money i borrowed. Its money i already paid on my vehicle that my insurance company will not reimbursed. XXXX is a service contract refund that i didn't receive or do not know anything about. I'm also being charged 2x on my late fees and XXXX payment if my insurance check already took care of it.So I'm filling this complaint because I believe it's a conflict of interest with the Gap company and credit acceptance. Plus credit acceptance is just adding fees on me to keep me in debt with them. I receive XXXX and already loss my vehicle and this company doesn't care they just want to keep me in debt and keep applying interest rates to money I don't even owe and that's not part of a contract I signed with them.

As a quick mention, there's a case filed by the cfpb and the attorney general of New York on XX/XX/2023 against this company for unfair, deceptive, and abusive practices to further back up my claim. [ CFPB & XXXX of New York vs. Credit Acceptance Corp ]. In CREDIT ACCEPTANCE CORPORATION terms and conditions they agreed not to share my information with non affiliates. XXXX, XXXX, and XXXX is not an affiliate of CREDIT ACCEPTANCE CORPORATION nor are they " bureaus ''. The only true credit bureau is the CFPB and they DO NOT furnish consumer reports as stated in federal law. As a response to my cfpb, they said I signed an agreement that they could share my information to the credit bureaus however the cfpb is the ONLY bureau and consumer reporting agencies are NOT bureaus. If this company believes they are I demand that they provide me with federally stated proof. I am also asking that you validate this debt by sending me the book entries security. Where is my XXXX CREDIT ACCEPTANCE CORPORATION XXXX XXXX writing off debt with the IRS without XXXX out XXXX as required by the IRS for debts greater XXXX { {$600.00} }. CREDIT ACCEPTANCE CORPORATION has been HEREBY PUT ON NOTICE that they are furnishing incorrect inaccurate information. Consumer Complaint: Credit Acceptance is reporting a balance for a car repossession account on my credit reports. However, the company did not follow the laws and provide me with the required state notices after the car was repossessed. The company was required by law to send me a notice about the car being available for sale at an auction or a private sale. The company did not provide this notice. After the car was sold, the company was required to by state law to send me a notice notifying me of the same with a break down of the fees and any balance due. The company did not send this notice either. This is a violation. Due to the company not providing the required state notices, they can not collect any balance from me and can not report a balance owed from me to any credit reporting agencies.

Consumer Complaint: I had a XXXX on or about XX/XX/, I had to go on FMLA leave from my employer due to my untimely health event. While you are on FMLA you do not earn your paycheck but your job is secured. I phoned Credit Acceptance requesting a difference and or any way they could assist. I was vehemently denied any assistance on my monthly payments, and told they don't offer those programs. I began working again on XX/XX/, however, I was demoted, and reduced to part time, with restricted hours, which is already being addressed by my attorney and employer. I have been making payments on my vehicle on a bi-weekly basis, attempting to " catch up ''. I have received 8 to 10 phone calls daily from credit acceptance, some after XXXX XXXX. These are threatening phone calls, and excessive. This is not helping my recovery, but instead is causing undue stress to my health conditions. I have requested intermittent FMLA from my employer as other health conditions have been exposed by the initial health event. I do not need or invite their continued harassments when I have been attempting to get caught up on my finance loan. These business practices should be investigated.

Consumer Complaint: Credit Acceptance : Back when XXXX hit, I was in a difficult situation regarding making payments, I worked at a sandwich shop and those type of retail/food places were hit hardest regarding hours and pay. I called in, which I have plenty of times and they always end up giving me wrong information but i am sure its not notated, I mentioned hardships and they offered a program for XXXX. My understanding of the program when I spoke to a representative was that they would put my payments on hold until I got back on my feet or found a different job that could supply me with the total of my monthly payment. Fast forward to when I did end up getting a stable job with stable hours to pay for my car payment, they mentioned I was about XXXXXXXX XXXX PAST DUE. They did not inform me all the payments I missed would become past due payments. I now am XXXXXXXX XXXX past due because of XXXX, the only way I am keeping my car is paying XXXXXXXX XXXX more a month on top of my car payment to lessen the XXXX XXXX. I make payment plans instead of autopay just due to how I operate. I was told the other day by a representative I had a two day grace period to make my payment after the " payment plan '' pay by date. That was on the XXXX and I ended up getting paid on the XXXX. They added XXXX XXXX onto my payoff amount recently due to the two day late payment. They request I pay my monthly payment ON top of another XXXXXXXX XXXX to create a new payment plan since the initial one created on the XXXX was broken due to me trusting the previous rep about the XXXX day grace period.I feel they took advantage of my misunderstanding regarding the covid plan put in place back in XXXX. Not to mention, my catalytic converter was stolen off my car back in XXXX and my own dealership couldn't help me with a new one because the dealership XXXX XXXX that I went through to get the car initially cause of my not-so-great credit score also ended up getting all the catalytic converters stolen from their own cars on the lot.
