I got behind due to COVID they still were piling interest charges and late fees. I voluntarily surrender the car now they are trying to get XXXX dollars out of me. Taking me to court and saying I also need to pay the court cost and fees. After I surrendered the car they still kept charging me until it was sold. They are now in a current lawsuit against them because of their corruptive behavior. I know I'm not the only one fighting this with these people.

Consumer Complaint: Credit Acceptance Corporation has preyed upon me as a XXXX adult and continues to repossess my vehicle without first giving me the option to voluntarily meet in an agreed upon location as is required by Florida law. XXXX XXXX has charged me alleging that I must pay XXXX XXXXXXXX in order to now recover my vehicle. I only have XXXX payments remaining on the loan at XXXX XXXXXXXX. There is no way I owe this amount on an {$8000.00} vehicle when I was unlawfully required to put down {$4500.00} as a downpayment. This is the 3rd time this year Credit Acceptance has extorted me without showing me proof of what is owed on the car loan. Credit Acceptance has not provided me a ledger or an adequate contract that notes the amount I allegedly owe. Credit Acceptance does not have a valid security agreement nor a XXXX financing statement that would allow for them to hire a XXXX XXXX debt collector to steal and confiscate my car and narcotics within the vehicle. I am being targeted and coerced into being defrauded. Credit Acceptance shall not be allowed to oppress me while simultaneously and directly effecting my daily activities and my health as a whole. I am demanding proof and the immediate cessation of collection activities. Furthermore, Credit Acceptance continues to tarnish my reputation and cause me to be subject to prejudicial treatment as they continue to unlawfully report alleged late payments on my credit report when Credit Acceptance knows it does not have my consent not the authority to report such activity by law under the FCRA 15 USC 1681a ( d ) ( 1 ) ( A ). Remove the late payments and return my vehicle or I will be forced to take legal action.

Consumer Complaint: This complaint is about " Credit Acceptance Corporation " auto loan that is on my credit report, of {$6000.00} of loan initial balance {$8200.00} down payment of XXXX and total of {$9200.00} whit that was paid in full and paid off on XXXX date XX/XX/2021. I was illegally charged a fianc charge of extra " CASH '' down payment BY XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX IL in which the finance charge is supposed to be the sum of all charges, and i was forced to get insurance before leaving the car lot by both Credit Acceptance Corporation and dealership who are uncontract with one another and are business partners. 15 USC 1605 defines finance charge. 12 CFR 1026.4 says finance charge should be included. b ( 8 ). A charging a down payment where no cash should have been included is a violation of TILA 15 USC 1638 ( a ) ( 2 ) ( a ). and is misrepresentation the amount financed. Allegedly if the bank also required a down payment, it should have been in the finance charge. 15 USC 1662 averting of downpayment 12 CFR 1026.24 ( d ). H-1- credit sale model form has different charges then fianc charges allegedly. When the fianc charge is the sum of all charges? whereas i was forced to get insurance and pay extra down payment by seeing me as east prey. This is also a violation of the consumer credit contract 16 CFR Section 433.1 ( c ). and violation of 15 USC 1681s - 2 ( a ) ( 1 ) ( bii ). for false and inaccurate information. More importantly as they are civil liable and criminal liable to me under TILA violation within its own contract and a department policy violation and fraud for insurance violation within the auto loan car contract where i was forced to get insurance before i drove off the car lot, and it was not included in the finance charge. I was taken advantage of as so as my mother who was over XXXX XXXX XXXX as the co-signer. i state a claim under USC section 1640 as all parties are Incahoots with each other and under contract, by using as fraudulent scheme to deceive consumers, such as me who is an XXXX with a XXXX under the XXXX also and taking the advantage of a person XXXX XXXX XXXX XXXX XXXX 15 USC also states Civil lability provided in this section to any creditor who fails to comply with any requirements imposed under this part, including any requirement under 1635 of this section 1635 of this title, subsection ( f ) or ( g ) of section 1641 of this title, or part D or F of this subchapter with respect to any persons liable to such person. under 15 USC section 1640 - civil lability -1635 ( f ) ( g ) 0f 1641 Credit Acceptance corporation and dealership labial under downpayment of joint contract complain tent states CLAIM under 12 CRF 1026 has requirement and violation where they are civilly and criminal liable, this is a CFPB, CFRA, TILA and FDCPA violation and any unknown to me at time of complaint filed. I was also subject to Racial Disparities of overcharging, and paying double the amount the car was valued and sold for

Consumer Complaint: In XX/XX/XXXX I had went to search for a vehicle that would be reliable and just in a certain price range that I would be able to afford. I came across a car lot just off of XXXX at the XXXX XXXX XXXX XXXX There was a XXXX XXXX XXXX that was just within my budget priced at {$11000.00} which with payments I felt confident to be able to pay off within a reasonable time. I came back to the lot the next day and traded in my XXXX XXXX towards the total and spent the whole day with a gentleman at a desk to cover the contract for the XXXX. Everything seemed to make sense and I signed the contract and made several months worth of payments that were around {$400.00}. One day I wanted to inquire about what I still owed on the XXXX so I called the credit acceptance company and asked what the amount I still owed was at and I was told that I owed around {$34000.00}. At that point I thought there must be some sort of confusion and that they had pulled up the wrong account. When I spent a whole business day with the gentleman in the lot to cover the contract, I had asked him 20-40 times throughout the discussion of the contract if there were anything on each page worded to change the overall price or finance of the XXXX in which every time he assured me no not at all sir this vehicle is {$11000.00}. Once realizing that I had been scammed and had taken a loan that I would actually not be able to afford I surrendered the XXXX and had lost my means of transportation. On top of that they sued me in court immediately and my credit has been ruined since XXXX. I am currently still on a homeless veterans program to assist with my living situation and to this day, even though I am permanently and totally XXXX through the VA from a service connected injury I still can not be approved for a home loan to provide for me, my wife and XXXX children. The account sits at {$11000.00} today and is preventing me from moving forward in getting my home loan through XXXX XXXX. I would have never agreed to anything that would have caused my life to collapse this way and at that time exceeded my budget so greatly. When I went back to the dealership to ask questions about what had happened they were no longer a car lot and the business was now an audio shop. I need help, thanks.

Consumer Complaint: After I was informed that the company would not call me on Sundays anymore, I was able to set up a payment arrangement to pay my debt. They said they would not call me at all. I thought that was extreme, but fine with me I can call you, and I have. On XX/XX/2023 I paid XXXX for my car note and on Friday XX/XX/2023. I paid a XXXX payment. I am just trying to catch up. I was going to make two payments a month and I found myself short for the payment on XX/XX/2023. I paid more than half. Well, they called me Friday, and Saturday, and the worst day of all Sunday. That was my original complaint. about was Sunday. I was in worship service, and they called I asked the young lady if she wanted to join me in service since it was online. I am so frustrated because previously I allowed them to speak to me any way they wanted and then the calls came consistently on a Sunday when I asked not to do that. I tolerated it a lot.
