Consumer Complaint: Notice of billing error ( 12 CFR 1026.13 ) XX/XX/2022 RE : Account number : XXXX To whom may address my concerns, I have noticed several billing errors in the Truth-in-Lending disclosures section of the " Retail Installment Contract and Security Agreement ''. The first one being the number of payments as well as the amount of payments seems to be inaccurate on the Pavment Schedule, 16 CER 433,1 ( d ) which describes a purchase money loan in regards to the truth in lending disclosure is defined as : " A cash advance which is received in return for a " finance charge '' within the meaning of the truth in lending act and regulation z, which is applied, in whole or substantial part, to purchase of goods or services from a seller who ( XXXX ) refers consumers to the creditor or ( XXXX ) is affiliated with the creditor by common control, contract, or business arrangement. " Under Regulation Z also known as truth in lending the itemization of payments should mirror the finance charge amount as it is " the dollar amount the credit will cost me ''. The next billing error is the " down payment '' on the itemization of the amount financed. In pursuant to 15 U.S.Code 1605, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction.The {$3000.00} downpayment placed under section " XXXX '' which references gross trade-in ( if negative enter O here and enter the amount on line XXXX ), is in violation of 7 CFR 1436.10/c ) The down payment may not include any trade-in, discount, rebate, credit, deferred payment, post dated check, or promissory note to the supplier or contractor. The next billing error can be seen on the amount of credit provided to me or on my behalf. There is no authorized user other than the appointed attorney-in-fact by the consumer to receive any credits on behalf of the consumer. I am demanding additional clarification including documentary evidence of the procedures used to come up with these itemized amounts in accordance with Generally Accepted Accounting Principles ( GAAP ). These billing errors may be assumed to be a willfully intent on misleading and or deceiving the consumer of the character/ amount of any debt pursuant to 15 U.S.Code 1692e. All debt obligations and securities are owed to the United States 18 U.S.Code 8 Do NOT hinder nor delay the delivery of the consumer goods associated with the transaction.

Consumer Complaint: On XX/XX/XXXX I was influenced into finance two vehicles from a dealership, after contract was made, weeks later they asked for more money down to release my licenses plates and registration, had to called the police to force dealership to give them to me. Following month XX/XX/XXXX the state started mailing about taxes due and registration fees which were over {$2000.00} per vehicles. Went on back and forth trying to keep up with all of the ridiculous payments, Ive been so stressed, overwhelmed, XXXX and even XXXX because everything Ive been working on financially has quickly destroy. Continue to get mails from the state about suspending my license, my credit drop drastically. Is now XX/XX/XXXX and the bank has informed that the dealership is no longer in business. They have been prolonging a settlement with me.

Consumer Complaint: I purchased the vehicle when I had just started my job back in 2018, working part time. I was given an astronomical rate due to being miss informed and a young minority in a desperate situation. After a few years I lost my job and was unable to regularly maintain paying my car note. Especially after I had to replace the engine within the first few days of owning the car and replace the XXXX in the first year. I contacted the creditor and informed them of my situation and they were unconcerned to say the least everytime. I was threatened with late payment and repossession. At a point my vehicle was physically taken but never repossessed. I payed the owing balance. My car was also in a auto accident that still isnt settled. So I paid my car off my self. I've disputed the multiple lates the account created I am hoping to have the account totally removed from my credit history due to the misreporting of information.

Consumer Complaint: YOU BROKE THE LAW!!!!!! You are in violation of the following subsections of the FCRA ( Fair Credit Reporting Act ) 15 USC 1681. I would like to make it clear to your company, and those in positions of Authority at your company that congress makes it clear that the banking system is dependent Upon my consumer reports being fair, and accurate to me, Pursuant to 15 USC 1681 ( a ) ( 1 ). Pursuant to 15 USC 1681 ( a ) ( 2 ) congress made it clear that you are an elaborate mechanism with no real standing, or authority. Pursuant to 15 USC 1681 ( a ) ( 3 ) You were not given this role. You assumed this vital role, and because of your assumption you have negatively affected my life, and those around me causing me severe hardship, mental stress, and XXXX. because of you assuming this role, Pursuant to 15 USC 1681 ( a ) 4 ) You were unfair in reporting this erroneous information without First consulting with me the consumer. You have no proof that this transaction even took place.You were also impartial because you allowed information to be reported while only hearing one side of the story. You also infringed upon my right to privacy by having a conversation about me with a third party, and reporting this information as result of that third party. I am demanding rescission pursuant to 15 USC 1635. Pursuant to 15 USC 1681 ( a ) ( b ) You did not meet the needs of commerce because this was not Fair and equitable to me.. This information is not accurate, nor is it relevant to me. Nor was this False informaton properly utilized to a manner that is or was equitabie to me. If This transaction even took place it should've been confidential so you in fact betrayed my confidence. You are in violation of 15 USC 1681a ( d ) ( 2 ) ( A ) ( i ) If this was a factual transaction ( Which you would not know because you were no there ) it would in fact be a transaction that solely took place between me and the person who allegedly made this report. Only a NATURAL PERSON can validate an alleged obligation NOT AN CORP. I will like rescission of this transaction also pursuant to 15 USC 1692 ( h ) return all alleged debts paid on this closed account. Pursuant to 15 USC 1681a ( 2 ) ( B ) " any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device '' Should be excluded from a consumer report. The definition of a credit card under 15 us 1681 is the same as it is under 15 USC 1602 ( 1 ) which is " the term " credit card '' means ANY card, plate, coupon book or other credit device existing for the purpose of obtaining, money, property, labor, or services on credit '' Notice, congress said ANY card. The credit card referred to in the following section is my social security card. This is the credit card I used to originate every consumer credit transaction below. They should all be removed from My consumer report pursuant to 15 us 1681a ( 2 ) ( B ). Consumer Complaint: I financed this vehicle I believe in XXXX and on the report it shows that I refinanced this in XXXX. Also, I voluntarily gave up the vehicle to them because I became ill with XXXX and could not keep up with the payments and it states that it was involuntary repossession. I know they sold the vehicle and it says on my credit report the wrong balance. It should be lower than what it is. Its still reporting higher than it should be. Also, Ive been trying to get this removed from my credit for false Information because its holding me back from purchasing my home. Ive gotten it removed from XXXX, but the others will not remove it. I got a letter from them years ago, but it was from the law firm theyve sent it to requesting the money. Ive sent them my information and hospital information to show proof that I was sick at the time. I have not received anything else from them about this vehicle or a settlement or anything. Consumer Complaint: Dear Consumer Protection Bureau, I am writing to you in regards to a case of inaccurate information being reported on my credit report and the refusal of both the credit bureaus and the creditor- Credit Acceptance to correct or clarify the reported status of such account on my credit report. The current status reported on my credit report has negative implications that impact me both financially and psychologically. I am contacting you as a last resort to help me mitigate this error with the creditor. Below are the steps i attempted to take to correct this matter and I documented them as follows : Initially, I was notified of an account on my credit report being 180 days past due. Knowing I did not have a current account 180 days past due I submitted an initial inquiry to the credit bureaus for clarification of the status of this account. it was brought to my attention that this was the same account as a derogatory car loan that I cosigned for my sister in XX/XX/XXXX. However the account was closed and marked as collection. I have contacted the credit bureaus on XXXX XXXX to request to correct the inaccuracy of this account showing open and 180 days past due since XXXX of XXXX but to no success. I have contacted the original creditor by means of certified mail XX/XX/XXXX USPS tXXXX # XXXX to ask to correct the status of this account ( this account is not an open account nor is 180 days past due ) I received no response. On XX/XX/XXXX I made a call to creditor to inquire the outcome. I have been told by the customer service representative in collection department that they did receive my request and response has been sent to a different address not the one I clearly indicated in the letter to be contacted at. Led me to believe no one has actually red through letter or paid any attention what was asked from them. After clarifying the address issue I again relayed the violation Fair Credit Reporting Practices regarding the status of the account changed from Collection status to a OPEN ,180 days late from XX/XX/XXXX through current day ( XX/XX/XXXX ) without any arrangements or payments made. They sent me a form to fill out and to send to their reporting dispute department listing specifically what I dont agree with and request to explain or correct. I filled out the form with complete and detailed statements that the account status can not be reopened without any arrangement actually made. Ive mailed it back to the creditor on XX/XX/XXXX via certified mail tracking number # XXXX On XX/XX/XXXX I got a really general and short response dated XX/XX/XXXX stating Credit Acceptance is in receipt of your credit reporting dispute. Based on our investigation, we have concluded that the information provided by Credit Acceptance to the credit reporting agencies is complete and accurate and doesnt require modification, deletion, or other correction Without any detailed explanation or any specific details regarding sudden change of status. In fact if you look at the Date of Status it has not been updated since XX/XX/XXXX at all. These actions do affect my credit as it looks like I have an open car loan when in fact its been closed. This is outright a bullying method to force people to contact you and try to collect for debt that has passed any legal statute of limitations.

Consumer Complaint: The company Credit Acceptance is currently investigating a car loan that was taken out using my personal information which I have been trying to have removed from my credit report for several months. I am filing this complaint to ensure this is taken seriously and this account is thoroughly investigated. On XX/XX/XXXX I called in and spoke to a representative by the name of XXXX who was extremely rude and did not take my claim seriously she told me the account was too old to dispute and that their was a judgement filed against me in XXXX New York she then advised me to send an email to XXXX with an identity theft affidavit, my ID, and a sheet of paper with my signature written XXXX times. For the record I was born in the state of New York but I have never resided in XXXX New York I sent the email to credit acceptance with the requested information as well as a letter requesting that they provided me additional information about the account so I could provide as much assistance as possible in investigating how this account was opened. I never received response but my credit report said the dispute was resolved. I contacted the credit bureaus to affirm the account does not belong to me and they said unfortunately they rely on XXXXredit Acceptance to complete an investigation and they recommended that I contact the Consumer Financial Protection Bureau. I lost my job so for a period of time my focus was elsewhere dealing with my loss of employment. On XX/XX/XXXX I decided to call back in again and I spoke to a representative by the name of XXXX who was a lot more helpful she advised that the vehicle loan was for a XXXX XXXX XXXX and that this loan was associated with the same address some other fraudulent accounts were opened she gave me specific instructions to write an email to XXXX and to provide an identity theft affidavit, my ID, and my signature on a piece of paper 5 times and to submit this information no later than XX/XX/XXXX. XXXX also provided me with an Account # XXXX and told me to follow up with the complaint resolution team at ( XXXX ) XXXX. I followed up on XX/XX/XXXX and spoke to an account specialist XXXX who essentially claimed that I have ownership of the vehicle and insisted that a " XXXX XXXX '' called me and left a message for me which I told her I had no record she also stated that she had several phone calls on record of me requesting vehicle repairs in the past and a phone call with me on an old telephone number claiming ownership of the vehicle on XX/XX/XXXX which I told her is simply untrue. I have not had that old telephone number in quite sometime and I personally gave them an updated telephone number on XX/XX/XXXX. I then requested to speak to XXXX XXXX and she told me XXXX XXXX and all of the Managers were in a meeting. On XX/XX/XXXX I spoke to XXXX XXXX and she stated that she did call me on my telephone number XXXX and perhaps there was a misunderstanding of the statements made by XXXX. She confirmed that she received the email but the ID was cut off and she also wanted a copy of my social security card which made me feel extremely uncomfortable. I was then told that the signatures I sent in as requested was a match to the contract on file which is impossible. She then advised that she has recorded calls and my voice matches the voice on the recordings and they have records of calls made by them to me and vice versa from my old telephone number XXXX the issue I have with that is that I did not have the number XXXX at that time and I told her the statements being made were making me feel as though their willingness to do a true investigation is becoming questionable. The account for this vehicle was opened in XX/XX/XXXX and closed shortly after in XX/XX/XXXX. If this vehicle was purchased in the state of New York why would there be a telephone number registered to the state of Florida make and receive calls? XXXX XXXX then alluded me to the fact that the information used to verify income was a pre-paid card of some sort which I then pointed out is another red flag that the account was fraudulently opened.She stated that the payments were made through XXXX XXXX which is also another well known vehicle for scams and fraud. Prior to ending our call she provided me medical assistance beneficiary information as proof of address which is also very strange I have never lived in the state of New York or been on any public assistance and I asked her if it was a customary practice for their company to take that type of information as proof of address. As someone who works in the medical field myself Credit Acceptance could not call and verify the information on any letter provided due to laws that protect sensitive personal information in regards to medical records.Ms. XXXX states that the letter came from XXXX XXXX XXXX Department and she provided me the telephone number XXXX she insisted that the investigation would come to a stop if I did not send in the full copy of my ID and my social security card I then let her know that I would search for the social and call the number to XXXX XXXX XXXX Department at the number provided XXXX. Once I got home on XX/XX/XXXX I called the number she provided and the phone just rang and rang with no automated set up, directory, or messaging service which leads me to believe the number is not a real number and the document used must also be a document produced as a result of fraud. To be sure I googled XXXX XXXX XXXX XXXX and the number that comes up is XXXX I spoke to a XXXX in their office and she stated she could find no record of my name in their system. Again. I am filing this complaint to ensure my name is cleared from this auto loan and I would like a fair and complete investigation which I have requested several times.

Consumer Complaint: I filled a complaint with the XXXX after I mailed a certified letter to Credit Acceptance regarding Deleting a old account for a car my brother use to own, and received information about the Repossession that shows that the payments remained in default and it should of been deleted off my credit report as of XX/XX/XXXX. On the letter I received from Credit Acceptance it showed that they added a repossession cost dated XX/XX/XXXX for {$390.00}. The account was listed current on XX/XX/XXXX, and starting XX/XX/XXXX it was a balance of XXXX and remained in default. When the car was repossessed in XXXX it was a balance of XXXX before the added repossession fee. So going off the Fair Credit Act it was suppose to be deleted 7 years from the default date which would of been XX/XX/XXXX, and they're still reporting negative remarks on my credit report. I just want this to be handled and deleted like it suppose to be.
