Consumer Complaint: On XX/XX/2021, I purchased a vehicle through Credit Acceptance Corporation. I paid almost half of the balance owed before the car was turned in with a balance of {$8600.00}. I tried to negotiate and keep the car even though it was a lemon, and I spent several XXXX XXXX XXXX trying to fix the vehicle with a car payment. I also became XXXX XXXX after this because of the XXXX I endured after putting money towards a vehicle that I no longer have and its on my credit file as a repossession that is affecting my credit worthiness.

Consumer Complaint: I am clear that those rights have been violated. Please see the list of violations that occurred during my consumer credit transaction to purchase the XXXX XXXX XXXX noted below. It is a fact that I provided a cash down payment in the amount of {$2300.00}, however per 15 USC 1605a no cash down payment can be collected when there is a finance charge. Pursuant to 15 USC 1662b it is illegal to require a down payment in conjunction with an extension of consumer credit. It is a fact that in the Retail Agreement It States that I have given the Dealership XXXX XXXX XXXX security interest. 15 U.S. Code 1667 ( 5 ) The terms security and security interest mean any interest in property which secures payment or performance of an obligation. It is a fact that I understand pursuant to 15 USC 1605, that the finance charge is the sum of all charges. On the 1st page of the contract the finance charge is misrepresented to be only {$10000.00} when in fact the sum of all charges would be {$27000.00}. This is a violation of 15 USC 1692e ( 2 ) ( A ). I am the Creditor. It is a Fact that I exercised my right to extend my credit. It is a Fact that I understand that Pursuant to 15 USC 1602 ( I ) ( M ) ( I ) The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. ( M ) The term accepted credit card means any credit card which the cardholder has requested and received or has signed or has used, or authorized another to use, for the purpose of obtaining money, property, labor, or services on credit. Once you obtained my SSN you accepted my ( Credit Card ) as payment. SSN belongs to the SSA And anything purchased with that identifier number Is an obligation of the United States. It is a Fact that the Pursuant of 18 U.S.C. 8 Means that your are in Violation of The False Claims Act ( FCA ), 31 U.S.C. 3729 - 3733. On the 1st page of the contract the finance charge is misrepresented to be only {$10000.00} when in fact the sum of all charges would be {$27000.00}. This is a violation of 15 USC 1692e ( 2 ) ( A ) Credit Acceptance has engaged in deceptive and abusive acts or practices in violation of the Consumer Financial Protection Act of XXXX ( the CFPA ), 12 U.S.C. 5531 ( a ), 5536 ( a ) ( 1 ), 5536 ( a ) ( 3 ), by obscuring the cost of credit for auto loans and taking unreasonable advantage of My lack of understanding of the risk of default and the severity of the consequences, as well as my inability to protect my interests. I was forced to obtain insurance misrepresenting the voluntary nature of add-on products. The members of XXXX XXXX XXXX staff did not even disclose that insurance was to be included with the finance charge, they just called XXXX insurance company on my behalf and made me contract with them separately. This is a violation of what is written in this law.

Consumer Complaint: On XX/XX/23 I called to get my balance and past due amount and how many days. I was told that I was 12 days late and wouldnt be reported as late if payment of {$300.00} was made on XX/XX/23. On XX/XX/23 I was reported late. Ive called several times and has gotten the run around. They lied like the call would be pulled and that I would get a call back in 24-48 hours on several occasions. On XX/XX/23 I was told that the Credit Department sent paperwork to dispute this matter and as XXXX nothing has been mailed. They give the wrong information purposely to report you late and charge crazy amount of fees. This company was sued in XXXX of this year for the same reasons. This is absolutely ridiculous and due to their company constantly giving the incorrect information my credit score has been affected.

I didnt get to see my paperwork because they uploaded it on a thumb drive and told me everything I sign will be on the thumb drive. 1 year later Im stuck trying to catch up on payment thinking the car would be XXXX because I put XXXX down. I looked at my paper work and realized the car that I have was sign for XXXX. Im a mom of 4 children I have no other choice but to try and struggle to pay my car loan or be without transportation! How can they jack my price that high and Cause me to go into debt? I have contacted this company and they have not answered multiple times. No CSRs have taken my call. I do not recognize this company nor balance. This is incorrect and needs to be removed. It is hindering me from purchasing a vehicle thru any dealership for they see this as a repossession in my name and that is not correct. I have never had a vehicle repossessed.

During the pandemic I was struggle to keep all my finances on place. I decide to do Bankruptcy during the bankruptcy the bank refuse to take payment I save the money after the discharge a give them a call I was informed I need to make a payment of {$2700.00} which I made as soon a make the payment I call them to make sure everything was in order. Per bank rep I need to pay a total almost of {$7000.00} which I explained that was not the amount I was told. Per supervisor I would be fine they have to granted the amount. On XX/XX/XXXX I decide to call the bank to verify the payoff of my car, I was informed my car was in repossessing status and I need to make a payment of {$5600.00} I ask why my car is in repossessing when I have being making my payment. Per rep the car has being in that status since XX/XX/XXXX because I failed to pay the other {$5600.00} back in XXXX. I'm being requesting to see my payment online they stated they don't have that option they can email to me. Per Credit acceptance rep I'm still owe {$35000.00} for this vehicle, do to the total cost was {$59000.00} at the end of the loan term. I verify with my financial institutions I already pay almost {$26000.00} for this car. I have stop the XXXX payment until I can get legal advice because I being pay for a car that can be picked up at any time and this people don't even send me a letter to let me know.
