Consumer Complaint: Dear CREDIT ACCEPTANCE CO : XXXX ; In accordance with the fair credit reporting this account has violated my rights. 15 USC 1681 section 602 states I have the right of privacy. 15 USC 1681 section 604 A section 2 It also states a consumer reporting agency can not furnish an account without my written instructions. 15 USC 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Consumer Complaint: The name of the creditor in question is XXXX XXXX XXXX Now this was originally an auto lone for {$17000.00}? opened in XXXX. The vehicle was totaled in an accident in XX/XX/XXXX, and paid by the insurance. Ive called them before and theyll say they are going to remove this account but they never do. Instead they have put that i owe {$10000.00}, then {$10000.00} literally on the same report. Im not even sure where they got that from but my problem is that Ive never signed a loan or deal of any kind for that amount, and it even shows that the accouint is open and that ive never made a payment on this said balance or account. ive gotten nothing but the run a round from them.this account has been on my report for over 7 years as they continue to move the date, please help. it shows as if I have an open car loan that ive never made a payment on and that is totally false.

Consumer Complaint: I sent Credit Acceptance a tender of payment in the form of remittance transfer from your very own payment book that you provided, XXXX XXXX payment ( 15 USC 1693o-1 REMITTANCE transfers ) by certified mail to which you indicated in the first complaint response, that you do not honor legal tenders as well as never sending them back to me, if in fact you claim that you did not redeem. ( 18 US code section 1951 ) Which also proves that your inaccurately reporting that you received no payment is a complete deception. ( UCC section 3-306 ; UCC section 3-307 ). Credit Acceptance continues to insult my knowledge of the Federal Law, Consumer Law as well as Color of Law and Private Law. Fist violating my rights to " '' no obligation to a debt that was fulfilled by my very signature as principal. HJR 192 PUBLIC LAW 73-10. Violation of 15 USC 1611. Credit Acceptance is trying to cover up the fact that XXXX XXXX XXXX committed fraud in several aspects. I have proof for the IRS that I indeed was given another consumer 's transactional receipts and contract. I also have proof that there was no email sent to me with the original contract from XXXX XXXX. They only send a copy of the warranty. I can prove that I never received a copy of the original contract as XXXX XXXX XXXX claims. XXXX XXXX was sent a copy of the information they provided me with which was not a copy of my original contract from our consumer transaction along with my rigjghts ( 15 USC 1692 ( g ). 15 USC 1692 ( e ) 15 USC 1629 ( s ). You were paid and my car should not have been stolen, 18 USC 8 FCA.USC 1692 ( e ) and the 4th amendment.15 USC 1605.Credit Acceptance violated my rights as a consumer and as the living authorized representative of my living being.

On my reports it is showing that a loan was given, when there was no loan given as the transaction was a retail installment sales contract. THE CAR WOULD HAVE BEEN PAID OFF OR CLOSE TO IT!! I was even willing to go back to XXXXXXXX XXXX and have them put the negative equity on top of another loan but XXXX XXXX Auto told me I would have to have money and a cosigner if I had money in a cosigner I wouldn't be going for a subprime loan I am going to contact legal aid this week about the unfairness unethical and I'm going to contact my daughter-in-law and find out how long we was in the office and my son just like when I talked to you on the phone you talked around me the bottom line is I paid {$8000.00} for that car already what would you think is a fair amount for payoff that's what I want to know a fair amount what would you pay? I've lost a lot of sleep I get a lot of headaches I can not believe this..the " MAIN '' REASON FOR getting subprime is to pay it off trade it in for a brand new car ... .I am XXXX XXXX XXXX my DREAM IS TO DRIVE A brand NEW CAR.!! Every single night I was raised to be respectful and fair to other people..could you please talk to the owners of Credit Acceptance or whoever is in charge of the auto loans?? If there is a will there is always a way to resolve circumstances of a HARDSHIP..please look at my past payments .does n't that show how serious I am on making payments?
