Consumer Complaint: XXXX is involved in a financial scam creating fake accounts using customer information and selling those accounts to debt collectors in order to generate a profit. I have tried to contact them in order to remove the fraudulent account, but they refuse to have any leadership look into the problem, then have customer agents tell me the account is closed and satisfied, but when I ask for paperwork to give the collection agency they hang up on me or tell me I dont need any. The fake account is a charge for {$130.00}. Issues like this happen every single time we have updated an address with them we receive things like, insane fees, incorrect charges on our account, randomly multiple fake accounts appear, degrade our service and then blame us for it and refuse to actually solve any of those issues or lie and say that the issues are resolved when they arent. They have even come out to our home and removed a splitter in order to cut our service while it was active and in good standing! We have only ever had 1 account with them and it is current. Any assistance you can provide is greatly appreciated.

Issue: Written notification about debt
Subissue: Didn't receive notice of right to dispute
Consumer Complaint: CONVERGENT OUTSOURCING ( Original Creditor : XXXX XXXX ) has failed to send me a response with my requested information for alleged collection account XXXX within the first five initial days of receiving my dispute. I have already been suffering enough with this inaccurate data on my credit report, I prepare ways to circumvent talking about my financial status or shortcomings with everyone from family members to co-workers causing changes in the relationships that have shaped my life until this day. The stress that comes with this alleged debt ruining my creditworthiness can not be managed. As a single mother, the financial expectations I am required to meet are unimaginable and it is a no-brainer that if I had the financial boost that good credit offers I would be in better shape to face daily challenges that come with my current predicament. Due to lenders turning down my applications I was forced to move out of my original state and ended up at my current address with no family or close friends to vent to leaving me visiting more social programs to help me deal with my stress and anxiety. Now that I contact this company about this alleged debt there is no response?? furthermore CONVERGENT OUTSOURCING ( Original Creditor : XXXX XXXX ) is also reporting this alleged debt as an " Account '' which is inaccurate according to USC Title 15 1693A2 Therefore at this point this collection agency is knowingly furnishing false data on my credit report in violation of15 U.S. Code ? 1692e. False or misleading representations and I demand them to Cease and desistfurnishing this alleged debt and notify all credit reporting agencies to delete it immediately. You have caused me additional stress, frustration, credit damage, and costs. You have also waived your opportunity to amicably resolve this issue without the need to litigate. I intend to forward this matter to an attorney or initiate litigation against you under the FDCPA. Until you are formally served process, you may resolve my FDCPA claims by doing the following : ( 1 ) cease and desist debt collection, ( 2 ) delete all of your credit reporting, and ( 3 ) pay me {$1000.00}. The {$1000.00} must be made payable to the order of XXXX and received within ten ( 10 ) days.

Consumer Complaint: In response to complaint ID : XXXX and XXXX My is XXXX XXXX, an agent for principal XXXX XXXX. I am a federally protected consumer, holder in due course, and attorney in fact. I am making this complaint against Convergent Outsourcing for violating multiple cease and desist notices received on XX/XX/XXXX through CFPB Complaint number XXXX and XX/XX/XXXX through CFPB Complaint number XXXX. I have never received any communication about this alleged debt prior to it being furnished to my consumer report. Convergent outsourcing has violated my individual right to privacy by continuing to commit abusive, deceptive, and unfair debt collection practices with no regards for federal law. I have never contracted with Convergent Outsourcing so Convergent Outsourcing has no lawful authority to be in possession of my identifying information. This is identity theft. Attached are the following exhibits : Exhibit A is the fraudulently furnished tradeline to my consumer report. Exhibit B is Convergent Outsourcing response to CFPB complaint number XXXX. Exhibit C is an identity theft affidavit filed with the FTC. Exhibit D is Convergent Outsourcing response to CFPB complaint number XXXX. Convergent Outsourcing has stated Convergent Outsourcing does not believe that we have violated any laws. We strive to report accurate information as required by federal law. Convergent is within the requirements of the FCRA as it pertains to our responsibility as a 3rd party debt collector when furnishing data to the credit reporting agencies. I disagree. Pursuant 15 U. S. Code 1692g ( c ), my failure to validate this this alleged debt shall not be construed as an admission of liability. I never received any validation documents prior to the furnishing of this alleged debt which is a violation of 15 U. S. Code 1692d ( 4 ), which the FTC defines as debt parking. In a statement from the FTC, Reporting debts first and asking questions later or not at all can land collectors in a steaming alphabet soup of FDCPA and FCRA violations. Convergent Outsourcing has stated On XX/XX/XXXX, XXXX placed this account in our office to collect a balance on their behalf of {$1600.00}. I am aware that in accordance with Article 9, the assignment of a defaulted note is illegal. Both the assignee and the assigned are both liable for violations under 15 U. S. Code 1692e ( 12 ). Convergent has openly admitted to unlawful extortionate activities and shall be held criminally liable for aggravated identity theft. Convergent Outsourcing has stated We sent you several validation notices. I have never received a validation notice from Convergent Outsourcing. I would need for Convergent Outsourcing to provide me with documentary evidence such as a tracking number or a return receipt bearing my wet signature proving they in fact attempted to lawfully validate this alleged debt with me prior to the furnishing this alleged debt to my consumer report. Without this documentary evidence, this has been a fraudulently furnished tradeline with forethought and malice to bring harm to me and my financial reputation and Convergent Outsourcing shall be held criminally liable under 18 U. S. Code 894. Convergent Outsourcing has stated On XX/XX/XXXX, we mailed you documents obtained from XXXX, validating the balance that they state is owed. These documents were sent to you again on XX/XX/XXXX. Convergent XXXX has openly admitted to securities fraud and sending false and deceptive forms as an attempt to commit theft by deception. Convergent XXXX and XXXX shall both be held criminally liable for racketeering activity. Convergent Outsourcing has stated Convergent Outsourcing can confirm that the information was sent was to your current address. Please note that the validation information we have provided you is specific to the requirements we are obligated to provide according to the federal law that governs our industry as it relates to validation of debt. Due to Convergent Outsourcing openly committing fraud with no regard to federal law, I would be remiss to just take their word for it. Without proof, this is hearsay. Provide proof that you attempted to lawfully validate this alleged debt prior to furnishing it on my consumer report. Convergent Outsourcing has stated This information is directly from XXXX. On XX/XX/XXXX, we received your initial Consumer Financial Protection Bureau complaint. In response to your complaint, we mailed you a fraud packet to your current address. To date, we have not received the requested information. In response to your complaint, this account remains in a disputed status. To date, Convergent Outsourcing has not produced any documentary evidence, such as a trilateral contract, that they have any lawful right to have my identifying information or to collect on this alleged debt. Convergent Outsourcing has stated This account remains reported to the credit bureaus with accuracy as disputed. Convergent Outsourcing has never attempted to validate this alleged debt prior to furnishing it to my consumer report and is openly committing unlawful extortionate activities with forethought and malice to coerce me into paying this alleged debt they claim I owe. Convergent XXXX is using unlawful extortionate means to collect on this alleged debt and shall be held criminally liable under XXXX XXXX XXXX XXXX XXXX. This is my final attempt to have this matter rectified before pursuing legal matters. If Convergent XXXX would like to continue committing fraud and unlawful criminal activities, this matter can be further discussed in federal court where I have no intention on pursuing any monetary amount.
