Issue: Problem with a purchase shown on your statement
Subissue: Credit card company isn't resolving a dispute about a purchase on your statement
Consumer Complaint: The Capital One credit card company employees failed to inform me about the status of my ongoing dispute with two unauthorized purchases on my account, resulting in an overdraft that negatively impacted my credit score and my account balance. I waited months without any notification that a response had been posted/uploaded to my 'statements and documents ' account on XX/XX/2023, after my response on XX/XX/2023. During those months my account remained in overdraft and my credit score was negatively impacted by charges that I had disputed and did not authorize. On XX/XX/2023, I called the capital one fraud department and spoke with an employee who told me to submit a signed letter I had already submitted on XX/XX/2023. I realized that I was being given 'the run around " so I asked to speak with a manager. The Fraud Dispute Manager, XXXX, Employee # XXXX XXXX, told me that I had a 45-day deadline from the time of their response on XX/XX/XXXX, which put me over the deadline to continue my dispute. The unprofessional and neglectful customer support I received from Capital One employees was the only reason I was unaware of the status of my dispute claim. The capital one employees I spoke with also provided false phone numbers for the XXXX company. When calling the number provided, a random tax representative by the name of XXXX answered. I have no way to contact the XXXX company, however, capital one seems to be in contact with them but is providing little to no assistance in handling my dispute professionally.

Issue: Closing an account
Subissue: Funds not received from closed account
Consumer Complaint: I opened a 360 checking account with Capital one on XX/XX/XXXX. On XX/XX/XXXX I recieved an email from capital one stating that they've decided to close my account because they observed activity that was inconsistent with their terms and conditions. In the email they failed to mention the exact activity they observed me doing that violated their terms and conditions. In that same email I was told that a check will be mailed to my address on file within 7 to 10 business days. We are XXXX business days in and I still haven't recieved my check from them. I called their customer service line to speak with a representative and I was told that my account is under investigation and after the investigation my check will be mailed to me. In the email I recieved from them on XX/XX/XXXX they failed to mention an " ongoing '' investigation regarding my account. I honestly regret banking with them because they don't care about their customers and ive came across several customers of theirs on social media who had gotten their accounts closed without cause also. Legally, a bank must return any funds in your account, if they decide to close your account with them and I would like my check. Capital one has a big history of dishonesty with their customers and I don't trust them to honor the 7-10 business they say that they will take to send me my check.

Consumer Complaint: In accordance with the Fair Credit Reporting Act ( FCRA ) Capital One Bank, N.A. has violated my rights under 15 U.S. Code 1681 section 602 which states I have the right to privacy, 15 U.S. Code 1681 section 604 ( a ) ( 2 ) also states a consumer reporting agency can not furnish an account without my written instructions. Under 15 U.S. Code 1666b ( a ) a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. This collection account is also being reported with several different open/closed dates as well as different balances which is a violation of FCRA and Metro 2 Compliance. I have disputed this several times in attempt to correct the inaccurate information that is being report, however Capital One Bank, N.A. has yet to correct the account which violates 12 CFR 1026.13 ( d ) ( 2 ) that states the creditor or its agent shall not ( directly or indirectly ) make or threaten to make an adverse report to any person about the consumer 's credit standing, or report that an amount or account is delinquent, because the consumer failed to pay the disputed amount or related finance or other charges.

Consumer Complaint: On XX/XX/2022, I used my Capital One credit card to purchase flights from the XXXX website. Later that same day, I called XXXX to modify my reservations and was advised that this would cause additional fees. I told the agent to cancel my reservations and was place on hold. Capital One apparently suspected fraud and utilized its Account Validation system to prevent XXXX from proceeding to charge without my permission. It worked. I hung up from holding with XXXX and called Capital One. The Capital One agent advised that the charges could not yet be disputed as they were still pending but unfroze my card and said these charges would all be considered disputed once processed. Subsequently, both XXXX and I submitted documentation to Capital One. Although initially agreeing with me that these charges were unauthorized, Capital One has now reinstated most of the disputed charges. XXXX has falsely claimed that I agreed to settle this dispute. Despite my demand, Capital One has not provided any evidence ( since there can not be any ). Capital One has not formally acknowledged my responses disputing these charges. I have still not received and only learned of Capital Ones XX/XX/XXXX letter regarding a related claim by visiting your website. Its messaging web page is used only to memorialize communications favorable to the Bank.
