Consumer Complaint: In XXXX XXXX, I initiated a credit transfer from Capital One credit card to my XXXX XXXX credit card in the amount of {$4300.00} That amount was charged to my XXXX XXXX XXXX, but had not been credited to my Capital One credit card. After a month of waiting for the payment to clear with Capital One, I called Capital One on XXXX XXXX XXXX to inquire why the payment from XXXX to Capital One had not been credited. I ended up on a XXXX way call between myself, and agent from Capital One, and an agent from XXXX XXXX. An investigation was opened by both parties, and the issue was resolved, with Capital One reducing my balance by {$4300.00} + interested charges that had been made in the previous statement. At this time, I had also sent a certified letter to Capital One disputing the incorrect statement that did not reflect the payment they received and cleared from XXXX XXXX. After the corrections had been made to my Capital One account, I was under the assumption that the matter was resolved and over. I then received a letter from Capital One dated XXXX XXXX XXXX that stated a credit was incorrectly applied to my account and and they fixed it by debiting {$4300.00} to my account. Today, XXXX XXXX XXXX I called Capital One to inquire how the the correction was reversed. They stated, in a recorded phone conversation, that I requested that {$4300.00} be refunded to XXXX XXXX. I at no time requested that verbally or in writing, so from my understanding, Capital One made an unauthorized and illegal balance transfer to XXXX XXXX. The agent that I spoke with confirmed that this was not a cancelled XXXX XXXX check causing the charge, but a check that Capital One made to XXXX, dated XXXX XXXX XXXX, check number XXXX. Again, this was not a request that I made through any official channel, online, or verbally. I stated that the payment was unauthorized and that I would like to open an investigation into the payment, and that I dispute the payment made to XXXX. I was told that the request for that payment to XXXX came from XXXX, and that I XXXX not dispute it or open an investigation, and that I needed to contact XXXX. I was also told that they can not tell me who or what XXXX is, connect me with them, or open an investigation regarding how XXXX determined that Capital One needs to send a payment to XXXX. Essentially they said that the error that Capital One made is not their problem and I have no recourse with them to resolve it. The purpose of this complaint is to resolve the illegal and unauthorized balance transfer from Capital One to XXXX that was made without my consent or request, verbally or in writing. This was an error on Capital One 's side, and should not be my issue to solve with XXXX. I expect Capital One to resolve this as they made this illegal error. Failure to do so will lead to small claims court.

Consumer Complaint: On XX/XX/XXXX I initiated a balance transfer to move the full balance of my Capital One credit card to my XXXX XXXX credit card. The amount to be transferred was {$11000.00}. The fee charged by XXXX XXXX for the transfer was 4.99 % ( {$550.00} ) and the term of the transfer was 0 % for 12 months. When I initiated the transfer from XXXX XXXX, I didn't have my Capital One credit card on me so I used the virtual card number provided by capital one as the recipient of the transfer. On XXXX I reached out to XXXX XXXX because I hadn't seen the transaction completed/posted with either bank. XXXX XXXX confirmed that they had issued a check on XX/XX/XXXX and sent the payment to Capital One and that the check had been cashed on XX/XX/XXXX. On XX/XX/XXXX I saw the transaction post to my XXXX XXXX card for the full value of the balance transfer ( {$11000.00} ) plus the 4.99 % fee but there still wasn't any record of this on the Capital One side. I waited until XX/XX/XXXX but when I still hadn't seen anything reflected in my Capital One account I reached out to their customer service line. I explained the situation to the Capital One rep and they requested that we initiate a 3 way call with XXXX XXXX so they could get the details of the balance transfer and confirm things on their end. After initiating the call and getting the check details from the XXXX XXXX rep, the Capital One rep informed me that the transaction wouldn't have gone through on their end because I used the virtual credit card number when initiating the transfer. They said that the transfer would have been rejected on their end and that I should be receiving a notice in the mail that the transfer was rejected and the money would be returned to XXXX XXXX within 2 weeks of the date the check was received ( i.e. XXXX ). I asked how long I should wait before calling back but the Capital One rep had already hung up the phone. However, the XXXX XXXX rep who had joined the call told me that the payment should have already been returned to them and suggested that I file a claim with their fraud department. She transferred me to that department and I initiated a fraud claim since Capital One had cashed the check but hadn't reflected the payment to my account. On XXXX I got a letter from XXXX XXXX stating that they had completed the investigation and confirmed the dates I provided above ( check # XXXX issued on XX/XX/XXXX for {$11000.00} and cashed by Capital One on XX/XX/XXXX ). They enclosed a copy of the cashed check and said the matter was considered closed on their end. In this experience XXXX XXXX was extremely helpful and gave great customer service but Capital One has been completely unhelpful and from what I can see they took the {$11000.00} from XXXX XXXX and have no intention of returning it or covering the cost of the balance transfer fee which was charged to me by XXXX XXXXXXXX because Capital One cashed the check ( despite their rep telling me that the transaction would have been rejected ).

Consumer Complaint: Capital one continues to try to charge me for for charges I did not make. When you tell them the charge they issue a credit then take the credit back the next day. They do no investigation whatsoever. Which is more and more striking as fraud. No credit card company does this. I spike to one of the venders who admitted the errors and apologized, yet capital one is taking back the credits they issued and will see the credit coming back from the venders who recognize the errors.This in itself says something is wrong with capital one. I have no intention of using their card services again ever after this is resolved. It's one thing for the consumer to say fraud occurred and there to be no proof, but for fraud to occur and a vender admits to it after capital one cited the transaction was accurate, says that Capital one credit is not following federal regulations. I have attached all the letters from then, in the past 6 days, I've seen them do this so many times, that I want nothing to do with them. Its ridiculous, there is one from XXXX where uhaul admitted they did not have the machine booked online. charged anyway, then I contacted Capital one, they credited the account then took the credit back, citing as shown they found no dispute or fraud that the charge was valid, yet uhaul admitted they did not have the machine and credited the account back. Capital one is engaging in consumer fraud.If the vender admits after the credit was removed it means capital one never investigated anything, and I've seen this too many times with capital one. .

Consumer Complaint: XXXX XXXX XXXX in XXXX Va and Capital One both denied me a car loan using erroneous information from XXXX. The details of my credit history is as follows. I have a credit score of XXXX, can't get much better than that. I have NO loans and the majority of my purchases are on my XXXX XXXX card that I pay off in full every month. there are a couple of credit cards from stores etc, I hardly use them and I. pay each and every one in full at the end of the month. I am retired, I own my home, no mortgage. No car payments or other consumer loans. I have assets in excess of {>= $1,000,000} the majority is in my retirement investment account, the rest in a bank or is real property. by any account I am an excellent credit risk. The explanations from XXXX and Capital One, make no sense and couldn't be a conclusion gleaned from the experian credit report. I believe I am the victim of discriminatory credit practice.

Consumer Complaint: On XX/XX/XXXX, I pulled my credit report and noticed that there was some inaccurate information regarding my credit score. I noticed that my credit reports have been ruined by this company on information that has not been validated. My consumer credit reports have been ruined due to the businesss abusive and deceptive practices. I contacted the credit card agency with a letter regarding my findings and still have not received a response and it has been more than 30 days since the letter has been sent. My complaints were as followed : To whom it may concern : Please note that this is not a refusal to pay off the account but a notice sent as per the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692 ( G ) Section 809 ( B ). This notice states that your claim is disputed and validation of the account is required. As I did not authorize consent for Capital One to report anything on my consumer report. Pursuant to federal law 15 U.S.C. 1692 a ( 3 ) When I pulled my consumer credit reports on XX/XX/XXXX I noticed that my credit reports have been ruined by this company on information that has not been validated. My consumer credit reports have been ruined due to the businesss abusive and deceptive practices. I noticed that there were inaccuracies on my consumer reports, such as the balance of {$5900.00} and late payments reported, as well as a closed account and a charge-off by your company. This has destroyed the lively hood for my children and I to live sustainably, such as purchasing a home of our own, and being able to take care of their necessities. This is very disheartening for me and has caused a lot of emotional distress for myself and my children. This notice is not a request for verification of the account or proof of my mailing address but a request for validation made pursuant to the FDCPA laws. I humbly request that your agency/office sends me valid proof of claim that I am legally obligated to pay you and that late payments were made and updated pursuant to 15 U.S.C 1666B. I am demanding the removal of the negative items if the information is not validated. ( A copy of any sort is not evidence ) The original must be furnished with WET INK SIGNATURE, including 3-308, and 3-302 ) and proof that it is my signature. Due to this reason, if any negative item is reported to any of my credit reports by your agency or the agency that you represent, then I will be compelled to take legal steps against you for the below-mentioned reasons under 15 U.S.C. 1692 ( a ) ( 1 ) as well as the following : *Misuse of my copyrighted property *Violation of the Fair Credit Reporting Act ( F.C.R.A. ) *Defamation of character *Violation of the F.D.C.P.A *No consent was given *Invasion of privacy I would like to inform you further that if any action is taken during the validation period which could be regarded as detrimental to any of my credit reports, then I will seek advice about initiating a lawsuit.
