Subissue: Problem with balance transfer
Consumer Complaint: I was offered a 0 % intro on balance transfers and purchases for 15 months By Capital One XXXX XXXX Credit Card. Because of this offer, I was inclined to apply and seconds later I received an email informing me that I was approved. I waited to get my card in the mail. I activated my new card. I set up my online account. I attempted to make my first balance transfer and was not able to successfully complete. I called customer service and the first person informed me that if I was given an offer then it must be given to me. The representative could not help me but transferred me to a representative that could. I was transferred to a female that with the name of XXXX XXXX id # # XXXX. XXXX informed me that the terms were changed, I was given an alternate product and I was given the option to accept, and I accepted. However, I never was given the option of alternative terms and I was never notified in writing or email of said alternate terms. The terms in the documents that were sent to me via email never mentioned that I was not approved for my initial offer. It only spelled out the transfer fee of 3 %. Nowhere in the documents was it written that I could not make balance transfers and that I was not approved for that benefit of this card. XXXX XXXX informed me that if I didn't like it then I can close the account and that I could not escalate the matter or dispute the matter any further than her. She told me she has a supervisor but does not get involved in customer matters.

Consumer Complaint: I have paid my bill for my Walmart credit card on the due date on XX/XX/XXXX and was assessed a {$28.00} late fee on the same day as the payment due date. I paid my bill on the due date of XX/XX/XXXX and once again I was assessed a {$41.00} late fee. Why am I being assessed a late fee when I paid my bill on time. CapitalOne uses automated systems to automatically charge a late fee to consumers. Customers should have until XXXX XXXX on the payment due date to make their payment and CapitalOne should not have early payment cut off times. CapitalOne is the only credit card company that utilizes early payment cut off times. CapitalOne should not employ automated systems to aggressively and automatically assess late fees on the same day as the payment due date. CapitalOne should not be so aggressive with assessing late fees. As a CFPB report on late fees concluded the late fees are not to incentivize on time payments and are used to increase the credit card company bottom line and profit. CapitalOne should explain why they have a XXXX cut off time while other credit card companies give customers until XXXX XXXX on the payment due date. CapitalOne should also have to explain why they are so aggressive in assessing late fees and assessing late fees on and as soon as the same day as the payment due date.

Consumer Complaint: My mom received a call from XXXX XXXX XXXX and XXXX on XX/XX/XXXX and they told her that I had listed her as a reference and to have me contact them. I called them and found out that they were trying to collect debt from XXXX for a credit card I supposedly had and hadn't paid on. I explained that I didn't have any credit card at that time and it wasn't until much later that I had a credit card. The person I spoke to said the info about the card would be sent to my home and it would take about a month. At that time, I told her to not contact my mother in regards to this anymore. She also advised me that if it was a family member that had the card in my name I could taken them to court over it to get the money. I contacted Capital One at that time because I knew the card wasn't mine and I was concerned that someone had my personal information and potential fraud/identity theft was involved. I spoke to two separate people in two different departments at Capital One and neither one found anything under my name for a card with missed payments or having gone to collections. I didn't receive anything further from XXXX XXXX XXXX XXXX XXXX until they left a voicemail on XX/XX/XXXX that said I had 24 hours to respond or judgement would be filed against me. They also contacted my mother again despite me telling them not too. I spoke to someone today, XX/XX/XXXX, in regards to this and was told that the card in question was from Capital One that I used to make purchases from XXXX to XXXX. I again told them that this wasn't me and I didn't have a card at that time. The person I spoke to said that the total amount owed including attorney fees was {$3500.00} and I would receive a subpoena to appear in court over this matter at either my home or my place of employment. She also said they could/would place a lien on my vehicle as well as my home. This is not debt that I owe, and I have received never received anything from this company other than the contact to my mother and the voicemail that I received. I have purchased several cars, a home and had a personal loan after this supposed debt went to collections and none of the credit checks ever showed any debt owed to Capital One ( or anyone ). I also routinely check my credit report and there has never been a card for Capital One prior to the ones that I have now which I opened in XXXX and XXXX. I asked if this matter could just be sent to the credit bureau so I could dispute it there since I wasn't receiving anything from the company and was told that's not the way it works.

Issue: Managing an account
Subissue: Problem using a debit or ATM card
Consumer Complaint: I am the victim of identity theft. On XX/XX/2023, XXXX criminals repeatedly accessed my Capital One Debit Card through internet fraud. One is disguised as XXXX XXXX the other presents as XXXX gaming. Together, they took over {$500.00} from my account. When the first withdrawal ( for {$89.00} from XXXX ) occurred, I reported it immediately to Capital One. Their representative thanked me for calling ( XXXX employee ) while more charges advanced. I told her the fraud was going on as we spoke. She did not understand. I repeatedly asked for my debit card to be shut down. I dont think the representative understood the problem because English was not her first language. After perhaps ten minutes on the phone, she finally put me on hold, shut down my card and returned. She then told me I could not file a dispute until all the charges ( which are pending ) actually POST to my account. I have no money. All my money was stolen as she held me on the phone. By the time I got off the phone, the criminals had taken over {$500.00}. According to Capital One, I must do without all that money until the transactions actually post. Until then, the thief enjoys my money ; I have nothing.. I want someone too investigate this fraud, stop the posting of these transactions BEFORE the theft is completed. What is the purpose of a pending transaction if the card-holder can not dispute? I need help.
