Issue: Closing an account
Subissue: Funds not received from closed account
Consumer Complaint: My husband and I opened new joint checking and savings accounts with Capital One between XX/XX/XXXX and XXXX XXXX. Over the next month, we began transferring our funds from our other banks ( XXXX, XXXX, XXXX ) to Capital One ; the sum of those transfers was appx. {$15000.00}. After our wedding in early XXXX, we virtually deposited multiple checks we received as wedding gifts totaling ~ $ XXXX without issue. Over the next few days, we received email confirmation that the checks had been successfully processed. On XX/XX/2023, we received an email stating " We're restricting your Capital One 360 account ( s ) until we can verify your recent account activity ... Based on the results of our review, your account ( s ) may be closed and your balanceplus all interest earnedwill be transferred to your externally linked checking account. If you don't have an externally linked checking account or if the account linked is no longer open, a check will be mailed within 7-10 business days to the address on file. '' We spoke with a customer service representative that day ( XX/XX/XXXX ) who told us our account had already been closed but we were not told why. Over the next month we called multiple times and left at least 2 voicemails at the number sent via email email but did not receive callbacks. We received a letter from Capital One around XX/XX/XXXX stating that one of the checks we attempted to deposit was flagged as " altered or fictitious '' so we assumed this was why our account was closed. ( We did not alter the check and have the original check still, which appears to us as normal. We also contacted the person who gave us the check who said it was flagged by their bank as well and they were unsure why. ) However, we have still not received further communication or our money back from Capital One. Today ( XX/XX/XXXX ), we messaged Capital One customer service at XXXX and got ahold of a representative who gave us a direct service line. The person we spoke to told us that our account had been closed but did not state a reason but that we would not get access to our money until our account had been investigated. She told us that an investigator had not yet been assigned to our case. She was not able to give us any information about when we would be able to access our funds or information about when an investigator would be assigned or when the investigation would be complete. It has now been more than 3 weeks since our account was closed and we have no idea when or if we will be able to access our money and no specific contact point within Capital One to track this process.

Consumer Complaint: On or around XXXX I voluntarily surrendered my XXXX XXXX to capitol one bank. I followed the requested steps and gave the car back in good condition. The bank accepted my request and took the car back and sold it at a public auction. I knew I would be responsible for the balance after the sale. I filled bankruptcy shortly thereafter and this debt was included in my XXXX XXXX case. For a very long time I hear nothing from capitol one about this matter. Then in the later part of XXXX i get a letter from capitol one telling me that the title to my car will be sent to me if there are no balances owed. If there is a balance, I would be responsible to pay it back. I was livid when I got this notice and called capitol one immediately. I told them you are sending me an illegal letter and this account has been included in bankruptcy and I am not responsible for any monies owed you. I then told them they are sending illegal letters without the proper verbiage on it. For example, the letter they sent me does not have any wording about bankruptcy and letting me know I am not responsible for any payback 's due capitol one. in their fancy way they were trying to collect a debt if there were any payments due them. They also sent me letters without my consent and as I mentioned this debt was wiped away in bankruptcy. It gets better capitol one sent me a tax form for unclaimed income from the shortage of the car sale. They also sent the same falsified tax document to the IRS. I was in the middle of filling my taxes and had to include this false document. This bank violated my bankruptcy rights, sent a false document to the IRS, tried to make me include more income then was actually made. I escalated my complaint to the president 's office who was no help at all. Capitol One admitted to their mistakes and offered nothing as compensation for their errors and many violations under the bankruptcy code. I tried to negotiate an out of court settlement and they declined to work with me nor offer anything to make this right. I am now filling complaints with all the government agencies that govern them. Once I file all my complaints. I will hire an attorney to move forward and file a class action lawsuit for falsifying records to the IRS, sending me letters trying to collect a debt while it was included in a XXXX XXXX bankruptcy, violations under the bankruptcy codes in South Carolina.
