Consumer Complaint: My identity was stolen. I was alerted by 2 credit monitoring places of hard inquiries on my credit report. I found 3 fraudulent credit card applications. I have reported my identity theft to FTC and am following the recovery plan FTC has given me. XXXX XXXX XXXX and Capital One are both refusing to give me any written confirmation that they are doing anything. They flat out refuse to send me anything in writing. Both companies will only verbally say they will do their own investigation and if they decide it was fraud they will cancel the application and their investigation will take 60 to 90 days and then they will still not supply any written confirmation of anything

Consumer Complaint: On Wednesday, XX/XX/XXXX my wallet was stolen in it were several cards, cash, miscellaneous recipts, membership cards. The person ( S ) who stole the wallet used the Capital One card at the XXXX XXXX XXXX location aroun XXXX EST, when I called Capital One they confirmed it was used ; and the charges showed up on XX/XX/XXXX. The capital one representative I spoke to told me they would be disputing the claim and will issue a new card ( Call 1 ~15 minutes ). On the card there were five charges totaling {$5100.00} on XX/XX/XXXX on the card ending XXXX. Detail of the amounts below XXXX ) {$1400.00}. XXXX 2 ) {$650.00} XXXX ) {$1300.00} XXXX ) {$1400.00} XXXX ) {$280.00} It appears the reversal was done on the card ending with XXXX it appeared on my account individually for five transaction on XX/XX/XXXX. On XX/XX/XXXX, the amount was reversed of {$5.00}, XXXX then another {$5100.00} appeared on XX/XX/XXXX ; so the disputed amount now {$10.00}, XXXX across 10 amounts now because it was doubled for two. I contacted Capital One ( Call 2~15 minutes ) on XX/XX/XXXX and the representative indicated they would reverse it, I saw the reversal was applied for only 9 transactions. I still had a missing amount of {$1.00}, XXXX that did not get reversed. I contacted Capital One again on XX/XX/XXXX or XXXX ( Call 3 ~30 minutes spoke to supervisor ), they indicated they would reverse it and the reversal appeared on my account on XX/XX/XXXX. I see a charge back on my account on XX/XX/XXXX. I contact Capital One on XX/XX/XXXX ( Call 4 ~1. 5 hours spoke to 4 representatives ) told them of the issue nothing was resolved, the representative said they sent it to Fraud department for investigation. Contacted Capital One latter on that evening ( Call 5 ~45 minutes ), the representative stated they see the issues and would follow up, they were a supervisor and said they see the issue. On XX/XX/XXXX I see the amount of {$1400.00} was removed and added back to my account. This has to be esclated upwards I have not received resolve to my issue lingering on my account. Perhaps some government intervention will help. Its been over a month, it is clear to me Capital One specialists and systems are not equipped to handle a simple issue.

I provided documents including the owner/ service provider admitting that the service was faulty. When the service provider offered myself an alternative service and a later date, she never followed through with scheduling leaving myself with a faulty service and no accommodation. Capital One has no interest in protecting their customers.

Consumer Complaint: I called Capital One to close my account in late XXXX because we did not want to incur the annual fee of {$150.00}. I originally asked to waive the fee, but they would not do that. Capital One would not close my card and told me I had to wait until the fee was charged and that then, once it posted, I had 40 days to close my account to avoid the fee of {$150.00}. In early XXXX, I inquired again about having the fee waived or closing the account. Capital One told me that they would not waive the fee and that I had until XX/XX/XXXX to close the account to have the fee refunded. I closed the account on XX/XX/XXXX with a Capital One agent who confirmed I was within the 40 day window to have the fee refunded and that I should pay my full balance less the {$150.00}. She said that within XXXX to XXXX days the fee would be refunded. She said that she could not apply the reversal of the fee at the time I closed the account. It's been nearly one month since I closed the account and Capital One is now charging me interest on top of the {$150.00} that they promised to refund me. Other than that the account is paid in full and has never been late. Tonight, I spoke with a supervisor who said he would not refund the fee and now says I closed the account outside of the XXXX window and there is nothing he can do to reverse the fee. I'm extremely frustrated as I followed the rules and confirmed all of this on a recorded line on all the phone calls. The agents I spoke with said they documented each call in the notes. We want the fee revered and the account will then be at a XXXX balance.

Consumer Complaint: When I opened my account ( it was ING Direct back then ) the interest paid for their high yield savings account was over 3 %. As interest rates were cut in the years since that went down to 0.3 %. Now that the fed has been raising rates I assumed that the interest rate on my account was also being raised, as it was for my other high yield savings accounts. Apparently, to take advantage of Capital One 's current 3.9 % rate I have to close my Capital One 360 Savings Account and Open a Capital One Performance 360 Savings Account. Capital One automatically lowered my interest rate when the fed cuts rates, but to take advantage of a rate increase I need to open a new account? I was never notified that this would be the case. This has literally cost me thousands of dollars in lost interest payments. I don't know that it's criminal, but it feels like it comes pretty close. I called their customer service and was told I could file a complaint but there's a 45 - 60 DAY turn around time.

Clearly states that I have rights to my privacy. 15 u.s.c 1681 604 A section 2 : it also states a consumer reporting agency can not furnish an account without my written instructions. 15 u.s.c 1666b : A creditor may not treat payment on a credit card account under a open-end consumer credit plan as late for any purpose. Remove the late payments and update this account immediately as you are in direct violation of several laws under the fair credit reporting act.

This is all equivalent to a police report as well. This is my second request to you to remove these fraudulent accounts from all three of the credit bureaus before I take legal action. Send the validation of these accounts as well with your response back to this complaint. I want the account name, account balance, past due amount, and date of last activity verified and provided to me as well.
