Consumer Complaint: Hello, I recently submitted a request to have the 30 day reporting on my auto loan removed because the bank account they attempted to pull from was not my bank account. I did not ADD or REMOVE the bank account they attempted to pull from. On XX/XX/XXXX, Capital One Auto Finance pulled a payment for {$370.00} from Bank account ending in XXXX, this is not my bank account, on file, I selected my bank account XXXX. When I spoke to a customer service representative, they said that the account ending in XXXX was the ONLY bank account I had on file for XXXX XXXX XXXX. It did not show XXXX was added or used at the time of payment and that I should fill out a dispute. They said to fax in my bank statement to prove I had funds available from my XXXX XXXX XXXX account which I did. I had {$1400.00} available for withdraw that week. I received a letter from Capital One yesterday, XX/XX/XXXX, indicating just that they concluded the reporting was accurate. This is inaccurate. I have no idea why this pulled from XXXX, the account was not even an option on my account and the representative did not see it either. Even if they pull up the audit trail of accounts added and removed at that time, they can not prove I added that account and removed it. I want this removed. I paid the payment immediately once I received notice from the credit reporting services I use.

Consumer Complaint: I have 2 random 30 day late payments from Kohls but i never received a bill. Not sure if they sent it to the wrong address and auto payment isn't an option. They only call me after the payment is missed and then I pay right away but 2 times they put late payments on my credit. It should not be on there because it was not my fault since i didn't know that it was due. Can you please help me get it removed? I have tried disputing it with the bureaus but not had success. Thanks

Consumer Complaint: An unknown person opened a credit card under my name with the company Capital One. This was not me who signed up for this card. They spent over the limit on the card. It was opened in XXXX and I figured it out by looking at my credit report with a new inquiry. This significantly dropped my credit score. I called capital one and theyre opening an investigation.

Consumer Complaint: I signed up for a credit card thru Capital One solely for the purpose of utilizing the advertised Virtual Credit Card features. This feature allows you to create a pseudo card number to protect your privacy by not revealing your actual card number when making purchases online. I was told by several employees before signing up that this feature would be available to me right away once I received the card. The website that advertised this card also says this feature comes with the card. When I finally received the card ( after a long long wait ), this feature was not available to me. I called customer service and they said this feature isnt available immediately, and can take anywhere from 1 week to 90 days to start working. Theres no controlling this they said, and it will randomly just become available so theres no telling how long you will have to wait for the feature to become available. I think possibly the main issue ( I figured this out on my own ) is the feature uses 2 factor authentication when signing up for the feature. It has you enter in your phone number and it uses your carrier to verify your identity. When I try to do this it says the system can not verify my identity, even though my name thru my carrier matches the name on my account perfectly. I called 3-4 times, no one was able to help me, even after speaking with tech support and several managers. I asked to be contacted by the managers manager, and they said this was not available to me. No one offered to help in any way, and I still do not have the advertised feature.

Consumer Complaint: Hello This month capital one closed all three of my credit cards. I had set up automatic payments and I went into the online portal to cancel them because it was supposed to be coming out of my checking ending in XXXX and not my capital one checking. I cancelled the payments in the system and I made my payments normally. Somehow the online system did not process my auto payment cancellation and continued to attempt to take payments out of an empty not in use capital one checking. I didnt find out about this until my account was closed. I received no calls. My account was closed because the online app was defective in cancelling the auto payment I set up. I have only had XXXX valid returned payment over a year ago from a XXXX XXXX account as that account was closed. I have never gone 30 days late on any of these accounts and I always paid my balance down. The automated online system did not cancel out the autopayment as requested. I am requesting that capital one reopen my accounts. Please.

Consumer Complaint: On XX/XX/XXXX I used the bill pay feature on my checking account. I set up the bill pay by entering the name of the institution ( XXXX XXXX XXXX ), the address, the phone number and the account number. I sent {$700.00} for a car loan. On XX/XX/XXXX XXXX XXXXXXXX XXXX reached out to let us know that they had not received our payment even though is had posted on XX/XX/XXXX as sent. We thought that maybe it needed more time but they called again on XX/XX/XXXX and we asked out bank for proof that the transaction had occurred. They sent the proof of transaction to us and we shared that information with XXXX XXXX XXXX. They noticed that the correct routing number was not used. The routing number that was used was to XXXX XXXX XXXX in Missouri. We call Capital One and filed a claim. It was denied and they stated that they dis as we instructed and sent the payment. We spent hours talking to supervisors at Capital One and filed an appeal with their notes and again it was denied today. We call again and were told that we need to find the money ourselves and that there is nothing they can do to help us. When we filled out the information for the bill pay we were not asked for a routing number, it was automatically generated by the bank and was sent to the incorrect institution. There was not an error on our part and the bank is refusing to help recover our money that they sent to the wrong institution.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: My name is XXXX XXXX XXXX, a federally protected consumer, and I am making this complaint against XXXX XXXX XXXX XXXX for violating a cease and desist notice multiple times they received on XX/XX/XXXX and for continuing to invade my individual privacy by committing abusive, deceptive, and unfair debt collection practices ( See Exhibits 1 - 5 ). On XX/XX/XXXX complaint XXXX XXXX, XXXX XXXX XXXX XXXX stated in their response, As XXXX XXXX indicated in his Complaint, he is requesting that XXXX cease and desist from further contact. XXXX has noted their system of record of XXXX XXXX cease and desist request on both Accounts. XXXX will not contact XXXX XXXX unless required or allowed by law. Pursuant 15 USC 1692c ( c ), it clearly states to cease ALL forms of communication through ANY and ALL mediums. XXXX XXXX XXXX XXXX has repeatedly violated the cease and desist notice. XXXX XXXX XXXX XXXX has committed multiple Fair Debt Collection Practices Act ( FDCPA ) violations and violates my federally protected rights. XXXX XXXX XXXX XXXX has failed to provide competent evidence that I have any legal obligation to pay the alleged debt. A copy of the Consumer Agreement and account statements ARE NOT sufficient to validate the debt. Validation REQUIRES presentment of the account and general ledger statement signed and dated by the party responsible for maintaining the account. Per UCC 9-201, I request XXXX XXXX XXXX XXXX to provide me with the original accounting under the Federal Rules of Evidence ( FRE ) 1002. Furthermore, XXXX XXXX XXXX XXXX has no legal standing to sue, nor legal standing to collect debts in Arizona. I have not validated any alleged debt with XXXX XXXX XXXX XXXX, and my failure to dispute the validity of this alleged debt shall not be construed as an admission of liability pursuant to 15 USC 1692g ( c ), yet XXXX XXXX XXXX XXXX sued me. As of XX/XX/XXXX, I have not received any documentary evidence, such as a trilateral contract, giving XXXX XXXX XXXX XXXX ANY right to collect on this alleged debt. XXXX XXXX XXXX XXXX is doing unlawful extortionate activities and theft by deception by attempting to furnish false and deceptive forms. XXXX XXXX XXXX XXXX has committed Aggravated identity theft pursuant to 18 USC 1028A. I never gave XXXX XXXX XXXX XXXX verbal, nor written approval, nor did I give ANY authorization for any of my personal or financial information. No consent is identity theft. XXXX XXXX XXXX XXXX is attempting to collect via Identity Theft while utilizing the court systems to do so which is misleading. An Identity Theft Report has been submitted through the Federal Trade Commission ( FTC ) and will also file a complaint with the Secretary of State. Since personal and financial information was obtained by this law firm, XXXX XXXX XXXX XXXX is acting as a debt collector, which also is a violation of the FDCPA which states that a debt collector can not be a law firm and a debt collector ; it has to be either/or but can not be both. Finally, as I stated in my previous complaint XXXX XXXX on XXXX, I am aware that all charge-offs are sold to a securitized trust ( FAS 140 ) and what remains on the transaction is an empty Account. For a creditor to have any legal standing they must repurchase the debt. They can not collect what they do not own and still proceed to collect on it, let alone illegally place an Account with a third party ( XXXX XXXX XXXX XXXX ) to attempt to collect. This is misleading and deceptive which violates Federal and State Laws. Once the alleged loan goes into default and is assigned to a debt collector, the effective law changes. The FDCPA is now the law under which action is governed. Once under the conditions of the FDCPA, debt collectors have no legal right to ply the legal remedies owed only to creditors who make loans, including notices of default, assignments to servicers, substitutions of trustees, etc. XXXX XXXX XXXX XXXX is in violation of 15 USC 1692j ( a ) because its unlawful to design, compile, and furnish ANY FORM knowing that such form would be used to create the false belief in me, the consumer, that the creditor is participating in the collection of or in an attempt to collect an alleged debt.

Consumer Complaint: Subject : Complaint against Capital One regarding the misleading offer and unfulfilled bonus Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against Capital One regarding their Savour card and the false advertising of a {$200.00} bonus offer on spending {$500.00} within the first month. Despite meeting and exceeding the spending requirements, I was informed that I am not eligible for the promised bonus. This situation has caused me significant inconvenience and frustration, and I seek your assistance in rectifying this matter. On XX/XX/XXXX ( or in that week ), I applied for the Capital One Savour card primarily because it advertised a lucrative offer of a {$200.00} bonus when spending {$500.00} within the first month of card membership. The offer was a deciding factor for me to choose Capital One as my financial service provider. However, to my dismay, after spending a total of {$800.00} within the specified timeframe, Capital One notified me that I was not approved for the bonus. Feeling misled and deceived, I immediately contacted Capital One 's customer service on two separate occasions, including today ( XX/XX/XXXX ), to seek clarification and resolution. Regrettably, each interaction with their representatives left me dissatisfied and without a satisfactory explanation for the denial of the bonus. This lack of transparency and accountability from Capital One is highly disappointing and does not align with the standards I expect from a reputable financial institution.
