Consumer Complaint: Credit Dispute-Failure to Honor Insurance Claim and Filing a bogus and unsubstantiated derogatory credit remark. XXXX XXXX XXXX Attachments XXXX ( XXXX minutes ago ) to fax Regarding the Item identified on the credit report as XXXX opened XX/XX/2020, date of last payment XXXX 2020, and as a charge-off for {$8400.00} with a past due amount of {$6300.00} reported by Capitol One Auto Finance XXXX I believe this is a false derogatory credit claim caused solely by the lender or creditor, identified as Capitol One Auto Finance ; and of no action, nor inaction of this lendee in total nor impart. Attached, I have supplied copies of communications supporting that the remaining, outstanding amounts or balance of said loan ought to have been satisfied by the Guaranteed Asset Protection Insurance Provider, in full effect at the time of the loss. The attached documentation will support that unknowingly to this borrower, and while I was XXXX, XXXX, and XXXX from the XXXX XXXX : Capitol One Auto Finance, after having received a total loss, pay-out from the insurer of the at-fault party and finding a remaining balance, did initiate a claim with the Gap insurance for the remainder of the balance owed. Capitol One Auto nor the GAP provider has contacted at any time this borrower, It is now alleged by the Guarantee Asset Provider that Capitol One never completed the submission of all necessary documentation to process the claim or to receive payment. Capitol One Auto Finance Alleged that documentation competed. To date, the amount remains on my credit report as a derogatory remark and failure to pay, this borrower did attempt on multi [ le occasions to communicate with the lender and the GAP insurance, only to be offered a settlement payment plan to satisfy the outstanding amount. Also, the GAP insurance provider alleges that although this borrower took the initiative to collect all possible supporting documents and forward copies to both parties, due to the amount of elapsed time since the initial filing that the claim would no longer be considered for payment. Consumer Complaint: I have two credit cards issued by Capital One Bank ; XXXXXXXX XXXX XXXX XXXXXXXX XXXX, and Capital One Quicksilver Card XXXX. I've had the Capital One card for nearly 5 years, and the XXXX 's card for nearly 2 years. I have never missed a payment on either of these cards. In XXXX, 2023 I received letters that these accounts were now closed, with the only reasoning cited being " Capital One has discovered adverse past or present legal action involving an individua or entity associated with the account ''. I called Capital One Customer Service in an effort to get additional information and was told that they could or would not give any, and that I should check with my County Court to get further information. I did just that, and could find nothing that would prompt Capital One 's action. Moreover, I have other credit cards through XXXX, XXXX, XXXXXXXX XXXX, and others ; and none of them have taken this course of action. In Mid XXXX I received a Notice of Data Breach, from one of my creditors, indicating that in XX/XX/2023 suspicious activity was discovered in their systems and that information had been compromised. Law enforcement, including the FBI, was brought in and the investigation is still in progress. Because of this I was offered complimentary credit monitoring and identity protection services. I have little doubt that this issue is associated with Capital One 's actions. Unfortunately, they won't give me the information necessary for me to research the issue.
